ORDINANCE NUMBER 7

AN ORDINANCE ratifying and confirming a contract with M. L. Michaelsen doing business as
Michaelsen Construction Company for the construction of Main Sanitary Sewer District "AL"
and Pump Station and Lateral Sanitary Sewer Districts 407, 408, 409, 410, and 411, and
providing for the issuance of Temporary Notes to pay the cost thereof, pending the issuance
and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the
M. L. Michaelsen Construction Company, hereinafter referred to as the"Contractor" as
submitted to the Board of Commissioners on February 16, 1960, which is hereby found to be
the lowest and best bid for such work, and the contract awarded by the Board of Commissions s

of said City to said contractor and signed on behalf of the City by its Mayor on February 23,
1960, for the construction of certain public improvements in the City of Salina, Kansas, to -wit:
Main Sewer "AL"
(1) Beginning with a sanitary sewer pump station to be constructed
at the intersection of Talley Drive and the easement at the rear
of Block 1, Ingermanson Heights Second Addition to the City of
Salina, Kansas, which will pump sewage to an existing manhole which
is located at the rear of Lot 25, Block 1, Ingermanson Heights
Addition,
(2) thence east with a 10" clay pipe sewer main along a line
10 feet south of the center line of Talley Drive to a point
10 feet west of the center line of Harold Avenue where manhole
# 1 will be built,
(3) thence southeast with an 8" clay pipe sewer approximately
135 feet where manhole # 2 will be built,
(4) thence continuing southeast with an 8" clay pipe sewer
approximately 285 feet to a point 10 feet west of the center
line of Harold Avenue where manhole # 3 will be built,
(5) thence continuing southeast with an 8" clay pipe sewer
approximately 345 feet to a point 10 feet west of the center
line of Harold Avenue where manhole # 4 will be built,
(6) thence continuing southeast with an 8" clay pipe sewer
approximately 280 feet to a point 10 feet west of the center
line of Harold Avenue where a manhole # 5 will be built,
(7) thence continuing southeast with an 8" clay pipe sewer
approximately 250 feet to a point 10 feet west of the center
line of Harold Avenue where manhole # 6 will be built,
(8) thence continuing southeast with an 8" clay pipe sewer
approximately 105 feet to a point approximately 20 feet west
of the center line of Harold Avenue where manhole # 7 will
be built,
(9) thence continuing east with an 8" clay pipe sewer
approximately 190 feet where manhole # 8 will be built,
(10) thence continuing east with an 8" clay pipe sewer
along a line 10 feet south of the canter line of Harold
Avenue, approximately 380 feet to a point 15 feet east of
the west line of Lot 31, Block 7, Ingermanson Heights
Second Addition to the City of Salina, Kansas, where
manhole # 9 will be built, which will be terminus of
Main Sewer "AL"
(11) Lateral 407, beginning at manhole # 2 thence east with
an 8" clay pipe sewer approximately 200 feet along the center
line of easement at the rear of Lots 2 and 3, Block 1, of
said Addition, which will be termdnus of Lateral 407.
(12) Lateral 408, beginning at manhole # 3, thence northeast
with an 8" clay pipe sewer along the center line of easement
at the rear of Lots 7, 8, and 9, Block 1, Ingermanson Heights
Second Addition, thence crossing Kenny Avenue into Block 2,
in said Addition, along the center line of easement through

Block 2, to the southwest corner of Lot 1, Block 2, thence
south along the center line of easement to a point 10 feet
north of the center line of Andrew Avenue, thence east and
crossing Page Avenue into Block 6, along the center line of
easement at the south side of Lbt 1, Block 6, to the southeast
corner of said Lot Is thence south along the center line of
easement at the rear of Lots 3 and 5, Block 6, to the rear
of Lot 8, Block 6, of said Addition where a manhole will be
built, thence a stub east and a stub west, 50 feet each way
where manholes will be built which will be terminus of Lateral 408.
(13) Lateral 409, beginning at manhole # 4, thence northeast
along the center line of easement through Block 3, of said
Addition to the rear of Lot 21, of said Block 3, fdhere a
manhole will be built, thence a stub north and a stub south,
50 feet each way where manholes will be built which will be
terminus of Lateral 409.
(14) Lateral 410, beginning at manhole # 5 thence northeast
with an 8" clay pipe sewer through Block 4, of said Addition
along the center line of easement to the rear of Lot 15,
Block 4, of said Addition where a manhole will built, thence
a stub north and a stub south, 50 feet each way where manholes
will be built which will be terminus of Lateral 410.
(15) Lateral 411, beginning at manhole # 6 thence northeast with
an 8" clay pipe sewer along the center line of easement through
Block 5, of said Addition to the northwest corner of Lot 19, of
said Block 5, where a manhole will be built, beginning at the
southwest corner of Lot 20, Block 5, thence north along the center
line of easement to the rear of Lot 25, Block 5, where a manhole
will be built, thence a stub west and a stub east, 50 feet
each way where manholes will be built which will be terminus
of Lateral 411.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made part of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated oost of said improvements
as shown by the sworn estimates of the City Engineer on file in the Office of the City Cle
which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the office of
the City Clerk and in accordance with the proposals of bhid contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,

the total amount thereof not to exceed the amount of $ 0 e j C 3._y -for such work, such
notes to bear interest at not to exceed 5 per cent per annum and to mature not later than
December 1, 1961, and to be issued in such amounts and at such times as may the money for
the payment of the cost of such work be required, such notes to be issued to said contracto
and to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in
lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from and after
its adoption and publication once in the official city paper.
