ORDINANCE NUMBER 6391

AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City of
Salina, Kansas, all in the sum of $402,737.72, to pay the cost of improving certain streets
in said city to be designated as Series Number P-183.
WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and
performed for the construction of the following street improvements to the City of Salina,
Kansas, to -wit:
The paving with 6" reinforced concrete of streets in
Edgemere Addition except Willow and Redwood Drive from
Lot 13, Block 5 south, Birch Drive from Lot 10, Bboek 8
south, Hemlock Drive from Lot 8, Block 9 south and
Cherokee from Pueblo to Republic.
The paving with 61t reinforced concrete of all streets in
Sunset Manor Addition except those on the east side of
Broadway Boulevard.
The paving with 6" reinforced concrete of all streets in
Likins Foster Addition except Oak Street from Pawnee
midway to Bechtold Avenue.
The paving with 7" concrete pavement of Crawford Avenue
from the west line of Steahlin Avenue to the west line
of Edgemere Addition
As provided for by Resolution Numbers 2019, 2028, and
2031.
WHEREAS, the total cost of said improvements has been ascertained and the portion thereof i
the amount of $71,106.55 to be paid by general taxes to be levied upon all taxable property
within said city for the improvement of squares and areas formed by the crossing of streets
and alleys and for the improvement of any of said streets, inhere the same is through or
adjacent to property of the City for which the City is liable, for which bonds are to be
issued; and
WHEREAS, the total cost of said paving and grading of said streets, which are to be paid by j
special assessments and to be levied upon lots and pieces of ground liable for the payment
of said paving and grading in said streets has been ascertained and has been hereby found
and determined to be the sum of $332,517.43 which amount has been heretofore duly assessed
and apportioned to the several lots and pieces of ground liable therefor,,.aoaording to law
provided for in the Ordinances of the City of Salina, Kansas, relating thereto, duly passed
and approved of which amount the sum of $886.26 has been duly paid by the property owners

liable therefor, leaving a balance of $331,631.17 for which bonds are to be issued; and

WHEREAS, bonds in the aggregate sum of 2,737.72 are to be issued to pay the actual cost

BE IT ORDAINED by the --board of CTuissioners of the City of Salina, Kansas:
Section 1. That the foreg6fng. preambles be and they are hereby adopted as a part of
this ordinance and that for the purpose &g providing funds to pay the cost of improvements
hereinabove referred to and described in the or�rtvces and resolutions of said City and
hereinbefore referred to, there shall be issued Interne - Improvement Bonds of the City of

Section 2. Said bonds shall be signed by the Mayor and shall be attested by the
signature of the City Clerk and the corporate seal of the City shall be affixed thereto and
said bonds shall have attached thereto interest coupons representing the interest thereon,
which coupons shall be in the form provided by law add shall bear the printed or lithograph
facsimile signatures of the Mayor and City Clerk of said city and said bonds and interest
coupons shall be registered in the office of the City Clerk and in the office of the Audito
of State as required by law.
Section 3. Said bonds shall be designated as Series P-183 and shall be in the form and
shall contain recitals substantially as follow*, to -wit:

KNOW ALL MEN BY THESE PRESENTS, that the City of Salina, in the County of Saline, State of
Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to
the bearer the sum of DOLLARS in lawful money of the
United States of America, on the first day of , 19 , with
interest thereon from the date hereof at the rate of
per cent per annum, payable semiannually on June 1, and December 1, in each year, on
presentation and surrender of the interest coupons hereto affixed as said coupons become
severally due, both principal of and interest on this bond being payable at the office of
the State Treasurer of the State of Kansas, in the City of Topeka, Kansas, and said City of
Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and
resources of said city are hereby irrevocable pledged for the payment of said principal and
interest at maturity.
This bond is one of a series of 402 bonds of like date and tenor, excepting denomination,
interest rate and maturity, aggregating the principal sum of $402,737.72 issued by the City
of Salina, Kansas for the purpose of paying the cost of constructing paving and grading
improvements in said city by the authority of and in full compliance with the providions,
restrictions and limitations of the constitution and laws of the State of Kansas, including
Sections 10-101 to 10-127, 12-601 to 12-608, and 13-1011 and 13-1011a, and 12-6a01 to
12-6al7, all of the General Statutes of Kansas, 1949, and amendments thereto, and all other
provisions of the laws of said state applicable thereto, and this bond and all other bonds
of this series, and all interest thereon are to be paid by the City of Salina, Kansas.
And it is hereby declared and certified that all acts, conditions, and things required to
be done and exist precedent to and in the issuance of this bond have been property done and
performed and do exist in due and regular form and manner as required by the constitution
and laws of the State of Kansas, and that the total indebtedness of said city, including
this series of bonds, does not exceed any constitutional or statutory limitation.
IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it
to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City
Clerk and the coupons hereto attached to be signed with the facsimile signatures of said
officers and this bond to be dated the first day of December, 1959.

Section 4. The Mayor and City Clerk are hereby authorized and directed to prepare and
execute the bonds hereinbefore described and to advertise and sell the same in the manner
provided by law, and when duly executed and registered to deliver said bonds to the purchas
of purchasers thereof.
Section 5. The full faith, credit and reyources of the City of Salina, Kansas, shall
be and the same are hereby irrevocable pledged for the prompt payment of said bonds and all
interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually
make provisions for the payment of the principal and interest on said bonds as they
severally become due by levying taxes and assessments upon the property liable therefor as
provided for by law.
Section 6. This ordinance shall take effect and be in force from and after its
publication once in the official city paper.
