6389 GO Bonds S-181CONSOLMATLD-SAL?NA 1 ORDINANCE NUMBER 638 (Published in The Salina Journal 1)�' 0,6 M b&t_ , 1959) AN ORDINANCE providing for and authorizing the issuance of Improvement Bonds of the City of!. Salina, Kansas, in the sum of $105,502.41, to pay the cost of constructing Intercepting and', Main Sanitary Sewers and certain Lateral Sanitary Sewers and Storm Sewers, and pumping station in the City of Salina, Kansas, which bonds shall be designated as Series S-181. WHEREAS, pursuant to proceedings duly had according to law, certain Intercepting and Main and certain Lateral Sanitary Sewers and Storm Sewers, and pumping Station have been constructed in the City of Salina, Kansas, in Main Sewer Districts and certain Lateral Sanitary Sewer Districts, as follows: Schippel and Circle Storm Sewer as provided for and authorized by Ordinance Number 6248. Main Sanitary Sewer "AF", Lateral Sanitary Sewer Number 373, as provided for and authorized by Ordinance Number 6217. Pump Station as provided for and authorized by Ordinance Number 6218. Intercepting Sewer "AG" as provided for and authorized by Ordinance Number 6255. Lateral Sanitary Sewers Numbered 374, 375, 376, 377, and 378, as provided for and authorized by Ordinance Number 6266. Lateral Sanitary Sewer Number 379 as provided for and authorized by Ordinance Number 6270. WHEREAS, the total cost of said sewers constructed in and as the sewer districts above mentioned amounted to a total of $106,404.25. WHEREAS, it is hereby found and determined that the sum of $55,370.02 is against property belonging to said city and is to be paid by general taxes to be levied upon all taxable property within said city, and the sum of $51,034.23 is to be paid by special assessments levied upon lots and pieces of ground liable for the payment of said sewers in the sewer districts mentioned, which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefore according to law and as provided for in the Ordinances of the City of Salina relating thereto, of which amount the sum of $901.84 has been paid by the owners of the property liable therefor, leaving a balance of $50,132. for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $105,502.41 are to be issued to pay the actual net cost thereof; SO, NOW THEREFORE BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles are being hereby adopted and made a part of this ordinance and that for the purpose of providing funds to pay the cost of the hereinbefore described, there shall be issued and there hereby are issued Internal Bonds of the City of Salina, Kansas, in the total principal sum of $105,502.41, which issue bonds shall consist of 105 bonds numbered 1 to 105 inclusive, all dated December 1, 1959, Q420M Numbered 1 to 55 inclusive shall bear interest at the rate of four per cent per annum; and bonds numtered 56 to 105 inclusive, shall bear interest at the rate of three and three-eighths per cent per annum, said interest being payable semiannually on June 1, and December 1 each year to be evidenced by interest coupons as herein provided for, and said bonds shall become due serially in denomination as follows: Bonds Numbered 1 to 10 for $1,000.00 each except Number 1 is for 1,502.41 due June 1, 1961. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the City shall be affixed thereto, shall have attached thereto interest coupons representing the interest thereon, which shall be in the form provided by law and shall bear the printed or lithographed facsimile signatures of the Mayor and the City Clerk of said City and said bonds and interest coupons i shall be registered in the offices of the City Clerk and the State Auditor as required by law. Section 3. Said bonds shall be designated as Series 5-181, and shall be in the form and shall contain recitals substantially as follows, to -wit: C aN SOL iDATED-SAL iNA D 1 1 UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND No. Series S-181 $ i KNOW ALL MEN BY THESE PRESENTS, that the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted and fbr value received hereby promises to pay the bearer the sum of DOLLARS in lawful money of the United States of America, on the first day of , 19 with interest thereon from the date hereof at the rate of per cent per annum, payable semiannually on the first days of June and December in each yeah, on presentation and surrender of the interest coupons hereto affixed as said coupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas. This bond is one of a series of 105 bonds of like date and tenor, excepting denomination, interest rate and maturity, aggregating the principal sum of $105,502.41, issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing Intercepting and Main sanitary sewers, and certain lateral sanitary sewers, and storm sewers, and pumping station, in said city by the authority of and in full compliance with the providions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-127, Sections 12-617 to 12-620, Sections 12-626 to 12-629, and Sections 13-1013 to 13-1018, all in the General Statutes of Kansas, 1949, and amendments thereto, and all other provisions of the laws of said state applicable thereto and this bond and all other bonds of this series, and all interest thereon, are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions and things required to be done and to exist precedent to and in the issuance of this bond have been property done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds does not exceed any constitutional or statutory limitations.
