AN ORDINANCE ratifying and confirming a contract with the Brown and Brow& Construction
Company for the construction of certain improvements on certain streets in the City of Salina,
Kansas, and providing for the issuance of temporary notes to pay the cost thereof pending the
issuance end sale of bods.
j BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the
Brown and Brown Construction Company, hereinafter referred to as the "Contractor" as submitter
to the Board of Commissioners on November 3, 1959, which is hereby found to be the lowest and

i best bid for such work, and the contract awarded by the Board of Commissioners of the City to
said contractor and signed on behalf of the City by its Mayor on November 10, 1959, for the
construction of certain public im}rovensats in the City of Salina, Kansas, to -wit:

1. The curbing, guttering and paving of:
(a) Belmont Boulevard from the west line of Roach Street
to the west line of Mayfair Drive.
(b) Roach Street from the south line of Belmont to the
south line of Lot 5, Block 13, Bdbmont Addition.
(c) Edward Street from the south line of Belmont to the
south line of Lot 5, Block 16, Belmont Addition.

(d) Wesley Street from the south line of Norton Street
to the south line of Lot 5, Block 18, Belmont Addition.
(e) Kensington Street from the east line of Quincy Street
to the south line of Lot 10, Block 20, Belmont Addition.

(f) Mayfair Drive from the east line of Quincy to the south
line of Lot 8, Block 21, Belmont Addition.
(g) Quincy Street from the south line of Kensington Road
to the south line of Lot 1, Block 6, Belmont Addition.
2. The sanitary sewers to serve all lots and parcels within the
boundaries of the benefit district hereinafter described.
3. Sidewalks, five fleet wide of 4 inch concrete to be placed one
foot inside property line on all streets to be paved under 1. (A),
(b)j, (c) , (d) . (e)j, (f) , and (S) •
at and for the unit price for said work contained in said proposal, which proposal and contrac
are hereby referred to and made parts of this ordinance, be and the same is hereby ratified
and confirmed, said proposal being within the estimated cost of said imprewem uts as shown by
the sworn estimates of the City Engineer on file in the office of the City Clerk,which
estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the plans
and specifications therefore prepared by the City Engineer on file in the office of the City

Clerk and in accordance with the proposal of said contractor and under the terms of said
contract, all of which are hereby referred to and made a part of this ordinance.

Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,
the total amount thereof not to exceed the amount of $257,997.30, for such work, such notes
to bear interest not to exceed 5 per cent per annum and to mature not later than Decenber 1,
1961, and to be issued in such amounts and at such times as money for the payment of the cost

of such notes being issued to said contractor and to be redeemed and cancelled at the time

that permanent bonds are issued in lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from and after it
adoption and publication once in the official city paper.
