EASEMENT
THIS INDENTURE, made this ~~ day of December, 1971, by and between
Q.A. APPLEQUIST and FLORENCE APPIrQUIST, his wife, and D. M. LAGER BERG and
CAROLYN N. LAGER BERG, his wife, Parties of the First Part and THE CITY OF
SALINA, KANSAS, a municipal corporation, Party of the Second Part, WITNESSETH:
That the said Parties of the First Part for a good and valuable
consideration, receipt and sufficiency of which is hereby acknowledged,
do by these presents grant, bargain, sell and convey unto said Party of
the Second Part an easement in, over and across a certain tract of land
owned by the Parties of the First Part more particularly described as
follows:
A tract of land located in Block 2, South Industrial Area,
Saline County, Kansas, being more particularly described as
follows:
Beginning at a point that is located 12.5 feet north
of the southeast corner of Lot 11, Block 2, South
Industrial Area, Saline County, Kansas, thence north
a distance of 10 feet, thence west a distance of 226
feet, thence south a distance of 10 feet to a point
that is 12.5 feet north and 26 feet west of the south-
east corner of Lot 13 of said Block 2, thence east a
distance of 226 feet to the point of beginning.
Said tract contains 0.05 acres more or less.
for all of the rights of ingress and egress of the said Party of the
Second Part, its servants, officers, employees and contractors for the
purpose of constructing, installing, repairing, replacing and maintaining
public utilities, in perpetuity.
IN WITNESS WHEREOF, the said Parties of the First Part have hereunto
set their hands the day and year first above written.
