6493 GO Bonds P-185CONSOLIDATED-SALINA 1 u ORDINANCE NUMBER (Published in Thq Salina Journal RuQX" 1960) AN ORDINANCE authorizing and providing for the issuance of Improvement Bonds of the City of Salina, Kansas, all in the sum of $551,385.64, to pay the cost of improving certain streets in said city to be designated as Series Number P-185. WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements in the City of Salina, Kansas, to -wit: The curbing, guttering, paving and grading with 6" reinforced concrete, two lanes 24 feet in width, with a 13 foot median lane between the two concrete lanes on Ohio Street from the north line of Wayne Avenue to the north line of Greeley Avenue, as provided for by Resolution Numbers 2123, 2140, and 2148. The curbing, guttering and paving with 6" reinforced concrete, 26' wide, back to back, Willis Avenue from the east line of Haskett to the west line of Hageman. The curbing, guttering and paving with 6" reinforced concrete, 26' wide, back to back, of Maple Avenue from the east line of Haskett to the west line of Hageman Avenue. The curbing, guttering and paving with 6" reinforced concrete 33 feet wide, back to back, of Garden Avenue from the east line of Haskett to the west line of Hageman. The curbing, guttering and paving with 6" reinforced concrete, 33' wide, back to back of Hageman Avenue from the south line of slab on Broadway Boulevard to the south line of Garden. The curbing, guttering and paving with 6" reinforced concrete 33' wide, back to back, of Haskett Avenue from the south line of Willis Avenue to the south line of Talley Drive. The curbing, guttering and paving with 6" reinforced concrete 33' wide, back to back, of Talley Drive from the west line of Haskett to the west line of Ingman Road. as provided for by Resolution Numbers 2122, 21420 and 2149. The paving with concrete, 28 feet wide, toe of gutter to toe of gutter, Shawnee Avenue from the south line of Crawford Avenue to east line of Seminole Avenue. The paving with concrete, 28 feet wide, toe of gutter to toe of gutter, Seminole Avenue from the west line of Shawnee Avenue to the north line of Republic Avenue. The paving with concrete, 28 feet wide, toe of gutter to toe of gutter), Mohawk Avenue from the south line of Lot 16, Block 6, of Sunset Manor Addition, to the north line of Republic Avenue. The paving with concrete, 28 feet wide, toe of gutter to toe of gutter, Franklin Avenue from the east line of Mohawk to the west line of Shawnee. as provided for by Resolution Numbers 21621 2175, and 2178. 1 1 CONSOLIDATED -SALIVA 44# 4 WHEREAS, the total cost of said improvements has been ascertained and the portion thereof in' the amount of $220,020.62 to be paid by general taxes to be levied upon all taxable property', within said City for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets, where the same is through or adjacent to property of the City for which the City is liable, for which bonds are to be issued; and WHEREAS, the total cost of said curbing, guttering, paving and grading of said streets, whic� are to be paid by special assessments and to be levied upon lots and pieces of ground liableii for the payment of said curbing, guttering, paving and grading in said streets has been ascertained and has been hereby found and determined to be the sum of $343,394.62 which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor according to law provided for in the Ordinances of the City of Salina; Kansas, relating thereto, duly passed and approved of which amount the sum of $12,029.60 hhs been duly paid by the property owners liable therefor, leaving a balance of $331,365.02 for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $551,385.64 are to be issued to pay the actual cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Said bonds shall be signed by the Mayor and shall be attested by the Signature of the City Clerk and the corporate seal of the City shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographe facsimile signatures of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the Auditor of State as required by law. Section 3. Said bonds shall be designated as Series P-185 and shall be in the form shall contain recitals substantially as follows, to -wit: CONSOLIDATED-SALINA 1 1 No. UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND Series P-185 $ KNOW ALL MEN BY THESE PRESENTS, that the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of DOLLARS in lawful money of the United States of America, on the first day of 19 with interest thereon from the date hereof at the rate of per cent per annum, payable semiannually on May 1, and November 1, in each year, on presentation and surrender of the interest coupons hereto affixed as said coupons become severally due, both principal of and interest on this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas, and said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 551 bonds of like date and tenor, excepting denomination, interest rate and maturity, aggregating the principal sum of $551,385.64 issued by the City of Salina, Kansas for the purpose of paying the cost of constructing, curbing, guttering, paving and grading improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-127, 12-601 to 12-608, and 13-1011 and 13-1011a and 12-6a01 to 12-6al8, all of the General Statutes of Kansas, 1949, and amendments thereto, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City Clerk and the coupons hereto attached to be signed with the facsimile signatures of said officers and this bond to be dated the first day of November, 1960. Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall i be and the same are hereby irrevocally pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually make provisions for the payment of the principal and interest on said bonds as they severally become due by levying taxes and assessments upon the property liable therefor as provided for by law.
