WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements to the City of Salina, Kansas, to -wit: Curbing, guttering, paving and grading of Clark Street (Thirty-three (33) feet wide from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6)inch crushed rock base, from the north line of Armory Road to a point 136.5 feet north of the north line of South St[eet, as provided for by Resolution Number 2120 and Ordinance Number 6326. Paving and grading of Franklin Street (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the east side of Custer Street to the west line of Sheridan Street, as provided for by Resolution Number 2111 and Ordinance Number 6326. Paving and grading of Fifth Street with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north line of Harsh Avenue to the south line of Euclid Avenue, as provided for by Resolution Number 2125 and Ordinance Number 6326. Curbing, guttering, paving and grading of Westwood Road (Thirty-thre e (33) feet wide from back of curb to back of curb) with two (2) inch hot asphalt mix over a six (6) inch crushed rock base, from the north line of Winona Street to the south line of Teakwood Street, as provided for by Resolution Number 2201 and Ordinance Number 6378. WHEREAS, the total cost of said improvements has been ascertained and the portion thereof it the amount of $99,259.50 to be paid by general taxes to be levied upon all taxable property within said city for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets, where the same is through or adjacent to property of the City for which the City is liable, for which bonds are to be issued; and WHEREAS, the total cost of said curbing, guttering, paving and grading of said streets, whic are to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering, paving and grading of said streets has been ascertained and has been hereby found and determined to be the sum of $389,893.13 which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor according to law provided for in the Ordinances of the City of Salina Kansas relating thereto, duly passed and approved of which amount the sum of $36,427.53 has been duly paid by the property owners liable therefor, leaving a balance of 4353,465.60 for which bonds are to be issued, and WHEREAS, bonds in the aggregate sum of $452,725.10 are to be issued to pay the actual cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Said bonds shall be signed by the Mayor and shall be attested by the Signature of the City Clerk and the corporate seal of the City shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signature of the Mayor and City Clerk of said City and said bonds interest coupons shall be registered in the Office of the City Clerk and in the office of the Auditor of State as required by law. This bond is one of a series of 452 bonds of like date and tenor, excepting denomination, interest rate and maturity, aggregating the principal sum of $452,725.10 issued by the City of Salina, Kansas for the purpose of paying the cost of constructing, curbing, guttering, paving and grading improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-127, 12-601 to 12-608, and 13-1011 and 13-1011a, all of the General Statutes of Kansas, 1949, and amendments thereto and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said City, including this series of bonds, does not exceed any constitutional or statutory limitation.
