6483 Sidewalk ImprovementsCONSOLIDATED-SALINA 1 1 ORDINANCE NISIBER 6483 (Published in The Salina Journal �t , 1960) AN ORDINANCE providing for the construction of certain sidewalks, for the payment of the cost thereof, and how the same shall be assessed and the manner of the payment therefor. WHEREAS, as provided for b$ Resolution Numbers 2326, 2330, 2331, 2361, 2384, 2398, duly published in the official city paper on the 25th of April, 4th of May, 1st of June, 11th of July, and 26th of July, 1960, the Board of Commissioners determined the necessity of and directed that the owner or owners of certain lots to construct certain sidewalks immediately adjacent to their respective lots within 30 days from the date of publication thereof; and WHEREAS, the said owner or owners, or a part of them faildd to cause said sidewalks to be so constructed, and SO NOW, THEREFORE BE IT ORDAINED by the Board of Camissioners of the City of Salina, Kansas: Section 1. That it is necessary and it is hereby ordered that certain sidewalks be constructed along the following course, to -wit: Sidewalk for Lots 1 to 12, inclusive, Block 1; Lots 1 and 2, Block 2; Lots 1, 2, and 3, Block 3; Lots 1 to 6 inclusive, Block 4, and Lot 1, Block 7, all in Claremont Heights Addition to the City of Salina, Saline County, Kansas. A property line sidewalk, 5 feet wide adjacent to Lots 1 to 16, inclusive, Block 3, Cloud Addition on Maple Street from the north line of Cloud Street to the south line of Bachtold Avenue in the City of Salina, Saline County, Kansas. A property line sidewalk, 5 feet wide adjacent to Lots 16, 17, 18, and 19, in Block 3, Cloud Addition on Bechtold Avenue from the east line of Maple Street to the west line of Beach Street in the City of Salina, Saline County, Kansas. A property line sidewalk, 5 feet wide adjacent to Lots 1 to 22 inclusive, Kraft Manor Addition, Blocks 4 and 5, on 8ebhart Street from the south line of Cloud Street to the north line of Charlotte Street in the City of Salina, Saline County, Kmsas. The west parking of Beach Street from the south line of Bachtold Avenue to the north line of Cloud Street in said City and abutting Lots 20 to 34 inclusive and lot 19, all in Cloud Addition to the City of Salina, Saline County, Kansas. A property line sidewalk 5 feet wide adjacent to Lots 21, 22, 23, 24, 25, 26, and 27, dock 4, Belmont Addition on Quincy Street from the south line of Wayne Avenue to the north line of Kensington Road in the City of Salina, Saline County, Kansas. A property line sidewalk 5 feet wide adjacent to Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10, Block 4, Belmont Addition on Wesley Street from the south line of Wayne Avenue to the south line of said Lot 10 in the City of Saline, Saline County, Kansas. A property line sidewalk 5 feet wide adjacent to Lots 6, 7, 8, 9, 10, 11, and 12, Block 3, Belmont Addition on Wesley Street from the south line of Wayne Avenue to the north line of Norton in the City of Salina, Saline County, Kansas. A property line sidewalk 5feet wide adjacent to Lots 16, 17, 18, 19, 20, 21, 22, and 23, Block 2, Belmont Addition from the south line of Wayne Avenue to the north line of 'Wesley Stowe to the city of Salina, Saline County, Kansas. A property line sidewalk 5 feet wide adjacent to Lots 1 to 12 inclusive and the Brace E. Stewart School Grounds from the south line of Wayne Avenue to the north line of Delano tsaleverd in the City of Salina, Saline County, Kansas. A property line sidewalk 5 feet wide adjacent to Lot 15, Block 2; Lots 26 and 12, Block 1; brace E. Stewart School grounds; Lot 1, Block 16; Lots 11 and 1, Block 13; Lots 9 and 1, Block 11; Lots 15 and 1, Block 10; Lots 13 and 1, Block 9; Lots 6 and 1, Block 8, from the south line of Wayne Avenue to the south lines of Lot 1, Block 16 and Lot 15, Block 2, Belmont Addition to the City of Salina, Saline County, Kansas. A property line sidewalk 5 feet wide adjacent to Lots 1, 2, 3, and 4, Block 11; Lots 15, 16, 17 and 18, Block 10, Belmont Addition, from the south line of Belmont Boulevard to the south line of Lot 4, Block 11, and Lot 18, Block 10, Belmont Addition to the City of Salina, Saline County, Kansas. A property line sidewalk 5 feet wide adjacent to Lots 1 to 7 inclusive of Block 10 and Lots 13 to 19 inclusive of Block 9, Belmont Addition from the south line of Belmont Boulevard to the south line of Lot 7, Block 10, and Lot 19, Block 9, in Belmont Addition in the City of Salina, Saline County, Kansas. A property line sidewalk 5 feet wide adjacent to Lots 1 to 8 inclusive, Block 9, and Lots 6 to 10 inclusive, Block 8 Belmont Addition from the south line of Belmont Boulevard to the west line of Ohio Street in the City of Salina, Saline County, Kansas. Section 2. That for the work and improvements herein provided for the City Engineer shall, on or before the 11th day of October , 1960, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work dnd improvements. Section 3. That the work and improvements herein provided for shall be constructed in accordance with the approved plans oad specifications on file in the Office of the City Clerk and the Office of the City Engineer of the City of Salina, Kansas, as made and provided for by law and the ordinances of said City. Said plans and specifications are incorporated herein by reference. Section 4. That after the City Engineer has filed the detailed estimate above ordered, the Board of Commissioners may advertise by advertisement published in the official city paper of the City of Salina, Kansas, for three (3) consecutive days for the receipt of sealed proposals for constructing said sidewalks according to plans and specifications set out in Section 1 hereof, and that said Board of Commissioners may and are hereby authorised and directed to let contracts for said sidewalk construction to the lamiko restemsible COMOLIDATED-SAUNA . 1 1 ! bidder or bidders therefor as determined by the Board of Commissioners, said Board reserving the right to reject any or all bids, if no bids shall be received within the f estimate, the Board of Commissioners shall have the lower to do such work and make such improvements within the estimated cost thereof as provided by law. Section 5. That when said sidewalk or sidewalks have been constructed then special assessments shall be levied against said lot, lots or parts of lots for the full cost or pro rate abutting footage cost thereof and the Board of Coumissioners shall levy an I assessment against each lot or piece or land abutting said sidewalk, by ordinance, and the property owner or owners shall have 30 days after the publication thereof in which to make full payment of the assessment. The City Clerk shall mail a notice not less than 15 days prior to the end of said 30 days period to the owner or owners of the property or parts i thereof as shown on the records of the Office of the Register of Deeds, but failure of thel owner or owners to receive the notice shall not effect the validity of the assessment. i Section 6. That for the payment of the cost of the construction of the above mentioned sidewalks, assessments in four (4) approximately equal installments shall be made against the property abutting on the sidewalks. Section 7. That for the purpose of paying the cost of the work and improvements in this ordinance provided for, the Board of Commissioners are hereby directed and authorised to issue internal improvement bonds or scrip of the City of Salina, Kansas, in an amount not to exceed the contract price or cost of such improvements. Said bonds or scrip shall run for a period of four (4) years and be payable in four (4) equal installments, together with interest not to exceed five per cent (5x) per annum, and for the purpose of paying the principal and interest on said bonds or scrip as they severally bee one due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvement and the apportiosmsntAiertis contained shall hold good for all of the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amounts of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually at the same time other taxes are certified, certif3 to the County -Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts and pieces of land, which amounts shall include the annual installments on all unpaid balances for one year at the rate not to exceed five per cent (5Z) per annum on such amounts so certified i which shall be collected as other taxes are collected. That pending the issuance and sale of bonds or scrip as aforesaid the temporary notes may be issued from time to time to pay the accrued cost thereof in the manner and form required by law. CONSOLIDATED-SALINA n 1 Section 8. This ordinance shall take effect and be in force from and after its adoption and publication once in the official city paper.
