Kansas, have declared that they deem it necessary to curb, gutter, pave and grade Albert

WHEREAS, each of the said Resolutions were published for six days in the Salina Journal, a
daily newspaper, published in the *Aid City, and being the official city paper, and the
majority of the resident property owners owning a majority of the square feet of the lots
or real estate liable to taxation for the cost of said improvements and did not within
twenty days from the date of the last publication thereof file with the City Clerk a
sufficient protest in writing against the nakdit of said improvements, no protests of any
kind having been filed, SO NOW, THEREFORE
BE IT ORDJI M by the beard of Commissioners of the City of Salina, Kanas:
Section 1. That it is necessary and it is hereby ordered that Albert Avenue, from
the west 61" of Quincy Street to the east right-of-way of the Union Pacific Railroad , in
said City, be curbed, guttered, paved and graded with conctete (Thirty-three (33) feet wide
from back of curb to back of curb) with excavation thereof, and graded to the established
paving grades and paved between the guttering lines thereof.
Section 2. That it is necessary and it is hereby ordered that Ellsworth Avenue, from
the east line of Lewis Street to the west line of Ohio Street, in said City, be paved and
graded with concrete (Twenty-eight (28)feet wide from toe of gutter to toe of gutter)
with excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 3. That it is necessary and it is hereby ordered that Fourth Street, from
the south line of Antrim Avenue to the south line of Otis Avenue, be paved and graded
with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) with
excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.

from back of curb to back of curb) with excavation thereof, and graded to the established
paving grades and paved between the guttering lines thereof.
Section 8. That it is necessary and it is hereby ordered that Leslie Avenue, from
the west line of Quincy Avenue west to its terminus in Block 9, Gebhart Manor Addition,
in said City, be curbed, guttered, paved and graded with concrete (Thirty-three (33) feet
wide from back of curb to back of curb) with excavation thereof, and graded to the
established paving grades and paved between the guttering lines thereof.
Section 9. That it is necessary and it is hereby ordered that Leland Way, from the
north line of Wayne Avenue to the south line of Albert Avenue, in said City, be curbed,
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb) with excavation thereof, and graded to the established paving grades and
paved between the guttering lines thereof.
Section 10. That it is necessary and it is hereby ordered that Hbith Twelfth Street,
from the north line of Hamilton Avenue to the north line of Lot 15, Block 49, Reimold's
Military Replat, in said City, be curbed, gutterid, paved and graded with concrete (Thirty-

Section 14. That it is necessary and it is hereby ordered that Antrim Avenue, from
east line of Santa Fe Avenue to the east line of Fourth Street, in said City, be curbed,
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb) with excavation thereof and graded to the established paving grades and paved
between the guttering lines thereof.
Section 15. That it is necessary and it is hereby ordered that Beverly Drive, from
the west line of Viemont Avenue to the west City Limit, in said City, be curbed, guttered,
paved and graded with asphalt (Thirty-three (33) feet wide from back of curb to back of cu
with excavation thereof, and graded to the established paving grades and paved between the

Section 16. That it is necessary and it is hereby ordered that Elgin Drive, from the
west line of Rocket Avenue to the east line of Beverly Drive, in said City, be curbed,

Section 17. That it is necessary and it is hereby ordered that Greeley Avenue, from
west line of Upper Mill Drive to the east line of Clarmont Drive, in said City, be curbed,

Section 18. That it is necessary and it is hereby ordered that Jsmesen Avenue, from

Section 21. That it is necessary and it is hereby ordered that Otis Avenue, from the

Section 22. That it is necessary and it is hereby ordered that Park Street, from the

in said City, be resurfaced with hot mixed asphaltic concrete, with excavation thereof,
and graded to the established paving grades and paved between the guttering lines thereof.
Section 23. That it is necessary and it is hereby ordered that Rocket Avenue, from
south line of Beverly Drive to the south property line of Blocks 1 and 2, Moose Addition,
in said City, be curbed, guttered, paved and graded with asphalt (Thirty-three (33) feet
wide from back of curb to back of curb) with excavation thereof, and graded to the
established paving grades and paved between the guttering lines thereof.
Section 24. That it is necessary and it is hereby ordered that Sunset Park Drive,
the east line of Republic Avenue to the north line of Sunset Drive, in said City, be paved
and graded with asphalt (Thirty-three (33) feet wide from curb to curb) with excavation
thereof, and graded to the established paving grades, and paved between the guttering
lines thereof.
Section 25. That it is necessary and it is hereby ordered that Sunset Park Drive,
from the mouth line of Republic Avenue to the west line of Sunset Drive, in said City, be
paved and graded with asphalt (Thirty-three (33) feet wide from curb to curb) with
excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 26. That it is necessary and it is hereby ordered that stapler Avenge, from

excavation necessary therefore, of each of the streets or portions thereof described in
Sections 1 to 39, both inclusive, of this otdinance, with the following type of

necessary &wading of each to the established paving grade,
and paving thereof with 6 inch reinforced concrete,
providing that in the event of the non-availability of
reinforced material that then said pavement shall be
constructed with concrete to -.a depth of 7'inches between
the curb and gutter line on each side thereof and within the
limits of said streets hereinbefore described; and the
paving thereof with eight inch hot mixed asphaltic concrete
between the curb and gutter line on each side thereof and
within the limits of said streets hereinbefore described.

oath, detailed estimates of the cost of such work and improvements.
Section That after such plans and specifications have been made and prepared by
the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners
may advertise published advertisements in the official city paper of the City of Salina,
Kansas, for three consecutive days for the receipt of sealed proposals for the improving
of said streets with the kind of material named and specified in the preceding section
hereof, and for the excavation and grading necessary for the completion of said work, and

after the receipt of such proposals, the Board of Commissioners may and are hereby authorized
and directed to let contracts for the improving of said Streets sdLth the materials selected)
by them to the lowest responsible bidder or bidders thereof, as determined by the Board of
Commissioners, and for such i=avation and grading. Said Board reserves the right to reject
any or all bids`
Section 4 That for the improving of the above mentioned streets, such assessment
shall be made for the full cost thereof according to law on all lots and pieces of land to
the center of the block on either side of the streets to be improved according to the
appraisers valuation thereof, without regard to the buildings or improvements thereon for
the distance to be improved.
Section � .' After the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterested appraisers, householders, who after having
taken an oath to make a true and impartial appraisement, of all lots and pieces of land
liable to assessment and taxation as aforesaid, as may be designated by the Board of
Commissioners of the City of Salina, without regard to the buildings or improvements
thereon and after making such appraisement shall return to the Board of Commissioners of
said City and said Board of Commissioners shall designate a time and place for the hearing
of any complaints that a&# be mad* as to the vAlue of any lots and pieces of land
appraised as aforesaid, of which due notice shall be given in the official city paper,
at which hearing hhe Board of Commissioners may alter any valuation of any lot or piece
of land, if, i� their opinion the same has been appraised too high or too low.
Section 46. That for the purpose of paying the cost of the work and improvements in
this ordinance provided for, the Board of Commissioners are hereby authorized and directed
to issue internal improvement bonds of the City of Salina, in an amount not to exceed the
contract price for the work of such improvements and to run for a period of ten years and
be payable in ten equal installments, together with interest not to exceed five per cent
per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas
and for the purpose of paying the principal and interest on said bonds as they severally
become due and payable the Board of Commissioners shall apportion and assess against the
lots and pieces of land within the taxing district of such improvements special assessments
covering the cost of such improvements and the apportioniant herein contained shall hold
good for all of the installments that are to be collected from the specific property
chargeable with said improvements. Such assessments and apportionment ordinance shall
contain the total amount of tax apportioned to each tract, piece or parcel of land within
the taxing district and shall state the number of annual installments in which such taz
is to be collected; and thereafter the City Clerk shall annually, at the same time other
taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of
all property liable to such work and assessments, together with the respective amounts due

on each of said tracts, pieces of land, which amounts shall include the annual installments':

and interest on all unpaid balances for one year at the rate of not to exceed five percent
per annum on such amounts so certified vhilch-shall be collected as other taxes are collected;
PROVIDED; that for the purpose of defraying the cost of improving the intersections and area
formed by the crossin: of streets and alleys, and for the grading of said streets where thel
