05-10280 Vacate A-Plus Gal Add(Published in the Salina Journal on June 16, 2005) ORDINANCE NUMBER 05-10280 AN ORDINANCE PROVIDING FOR THE VACATION OF THE PLATTED RESTRICTED ACCESS ON OLD U.S. HIGHWAY 40 (PACIFIC AVENUE) IN THE A -PLUS GALVANIZING ADDITION IN THE CITY OF SALINA, SALINE COUNTY, KANSAS. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. That the governing body is in receipt of a request for a 35 -foot break in access along the north side of Old Highway 40, the centerline of said break in access being 165 feet from the east line of Lot 1, Block 1 of the A -Plus Galvanizing Addition. Section 2. That in accordance with the City of Salina standard platting policies, the entire southern property frontage of Old U. S. Highway 40 (Pacific Avenue) was platted with "restricted access control" until the owner submitted development plans for that portion of the property. Section 3. That the governing body finds that no private rights will be injured or endangered by vacation of the restricted access that the public will suffer no loss or inconvenience j thereby, and that the vacation of the restricted access should be granted. Section 4. That for the purpose of recording this ordinance with the office of the Saline !, County Register of Deeds, this vacation of restricted access relates to that tract of real property described as Lot One (1), Block One (1), A -Plus Galvanizing Addition Section 5. That this break -in -access (driveway) is for the exclusive agricultural uses related to the relocated two (2) 24' x 112' hay sheds as shown on Exhibit "A". Section 6. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
