EASEMENT AS TO MARIPOSA PARK COMMON AREA
FOR PRIMARY STORM WATER RUNOFF DETENTION
Mariposa Homeowners Association, a Kansas not-for-profit
corporation, fee owner of Mariposa Park Common Area as shown on the
recorded plat of Mariposa (Blocks 1 through 6), a subdivision of
the City of Salina, Saline County, Kansas, the plat of which was
filed for record in the office of the Register of Deeds on
April 26, 1989 at 2:55 p.m. and there recorded in Plat Book
Volume A-8 at page 25,
for good and valuable consideration, DOES HEREBY GRANT AND CONVEY
UNTO THE CITY OF SALINA AN EASEMENT on and over the following real
estate:
Mariposa Park Common Area, a portion of Block 1 of
Mariposa (Blocks 1 through 6), a subdivision of the City
of Salina, located in Saline County, Kansas,
to construct, maintain, and operate a primary storm water runoff
detention structure upon said Lot 12, including, but not limited
to, an earthen dam, an inlet orifice structure with trash racks,
and elliptical corrugated metal pipe, an outlet channel and
spillway, and concrete erosion control structures, which
improvements confer a special benefit upon Mariposa (Blocks 1
through 6), a subdivision of the City of Salina.
Said improvements shall be maintained pursuant to "Restrictive
Covenants (To Maintain Storm Water Detention Structure)" dated
March 1,1990 and recorded with the office of the Register of Deeds
of Saline County, Kansas contemporaneously herewith.
This instrument shall not be amended or modified in any manner
without the prior approval of the Planning Commission and governing
boày or the City of Salina, Saline County, Kansas.
IN WITNESS WHEREOF, the fee owner has caused this easement to
be executed and delivered on this 1st day of March, 1990.

BE IT REMEMBERED, That on this 1st day of March, 1990, before
me, the undersigned, a notary public in and for the County and
State aforesaid, came James T. Graves, President of Mariposa
Homeowners Association, who is personally known to me to be the
same person who executed the within instrument and such person duly
acknowledged the execution of the same.
IN TESTIMONY WHEREOF, I have hereunto subscribed my name and
affixed my official seal on the day and year last above mentioned.
