EASEMENT
This Indenture, made this ~ day of 1~~~!~ ,
1986, by and between Unified School District No. 305, Salina,
Kansas, hereinafter referred to as the "Party of the First Part"
and the City of Salina, Kansas, a Municipal Corporation, herein-
after referred to as the "Party of the Second Part".
WITNESSETH:
The said Party of the First Part, for good and valuable
consideration, the receipt and sufficiency of which are hereby
acknowledged, does by these presents, grant, bargain, sell and
convey unto the said Party of the Second Part, a permanent
easement in, over and across a certain portion of land owned by
the Party of the First Part, more particularly described as
follows:
A tract of land situated in the Northeast Quarter
(NE/4) of Section Thirty-six (36), Township Fourteen
(14) South, Range Three (3) West of the Sixth Principal
Meridian in Saline County, Kansas, more particularly
described as follows:
Commencing at the Northwe st corner of said Quarter
Section, thence Easterly on a bearing of N89°40'00"E
along the North line of said Quarter Section a distance
of Forty-nine (49) feet; thence SOOO20'00"E a distance
of Forty-five (45) feet to the true point of beginning;
thence N89°40' OO"E along the North property line of
Salina South High School (USD 305) a distance of One
Thousand Nine Hundred Nine (1,909) feet to the East
property line of said property; thence SOOO20'00"E
along the East property line of said property a
distance of Ten (10) feet; thence S89°40'00"W parallel
to the North property line of said property a distance
of One Thousand Nine Hundred Nine (1,909) feet; thence
NOOO20'00"W a distance of Ten (10) feet to the true
point of beginning. Said parcel containing Nineteen
Thousand Ninety (19,090) square feet more or less;
for all of the rights of ingress and egress of the said Party of
the Second Part, its servants, officers, employees and contrac-
tors for the purpose of constructing, installing, repairing,
replacing and maintaining a sanitary sewer line, in perpetuity.
IN WITNESS WHEREOF, the Unified School District No. 305,
Salina, Kansas, has caused this instrument to be executed on the
date written above.
