between PHYLLIS HINES AND JAY N\. HUmS,..
first part, and the CITY OF SALINA, KANSAS,
WHEREAS, the party of the second part, pursuant to the laws
of the State of Kansas, has created a Lateral Sewer District No.
which includes certain lots in the City of Salina, Saline County, Kansas,
according to the recorded plat thereof; and
WliEREAS, the party of the second part, as provided by :Law,
intends to and is going to construct an eight-inch Lateral Saniblry
Sewer in said district and an easement is needed over and through cer-
tain land of .first par':;ies; and
so, NOW, TB~REFORE, WITNESSETH, the parties of the first part,
in consideration thereof and other good and valuable consideration, re-
ceipt of which is hereby acb10wledged, do hereby grant, bargain, sell
and convey unto aecond party an easement in, over and across a c€trtain
portion of said Benefit District, on and adjacent to the line of the
co~lstruction of said sewer, more particularly described as follows,
to-wi t:
The West Ten (10) feet of Lot Twenty-nine (29) on
Republic Avenue, in the Addition to, the Grounds of
Kansas Wesleyan University, an acidition to the City
of Salina, Saline County, Kansas;
all for the right of ingress and egress by party of second part, its
servants, officers, employees and cont~actors, for the purpose of con-
structing, maintaining, repairing and replacing said sewer and all con-
nections, manholes, flush tanks and other appurtenances thereto in accord-
ance with the plans and specifications now on file in the office of the
City Clerk of the City of Salina, which such plans and specifications are
hereby incorporated herem and Dade a part hereof by reference.
