between KING-MICHAELSEN, INC., a Corporation, party of the first iaSiA itO
part, and the CITY OF SJI.LHJA, KANSAS, of the second part:
CONVEYAJJCE OF EASEMENT

WHEREAS, the party of the second part, pursuant to the
laws of the State of Kansas, has created a Lateral Sewer District
Number 223 which includes certain lots in the City of Salina, Saline
County, Kansas, according to the recorded plat thereof; and
WHEREAS, the party of the second part, as provided by law,
intends to and is going to construct an eight-inch Lateral Sanitary
Sewer, beginning at a manhole in Quincy Street at the point of the
intersection of said Quincy StrGet and an east and west public alley
next north of Russell Avenue, thence west to the center of said
alley from said manhole for a distance of 450 feet to a manhole to
be c';,nstructed in said alley; thence (a) due north as a 6" V.C.P.
Sewer from said manhole to be so constructed for a distance of 70
feet and (b) thence due south as a 6" V.C.P. Sewer from said manhole
to be constructed in said alley a distance of 70 feet; and
SO, NŒv, THEREFORE, WITW~SSETH, the party of the first part,
in consideration thereof and other good and valuable consideration,
receipt of which is hereby acknowledged, doth hereby grant, bargain,
sell and convey unto second party an easement in, over and across
a certain portion of said Benefit District, on and adjacent to the
Une of the construction of said sewer, more particularly described
as follows, to-wit:
The West Five (5) feet of the South
Sixty-Five (65) feet of Lot Twenty-
Five (25) on Claflin Avenue and the
West Five (5) feet of the north Six-
ty-Five (65) feet of Lot Twenty-Six
(26) on Russell Avenue, all in the
Addi ti on to the Grounds of Kansas
Wesleyan Universi tv, an Addition to
the City of Salina, Saline County,
Kansas;
all for the right of ingress and egress by party of second part, its
servants, officers, employees and contractors, for the purpose of
constructing, maintaining, repairing and replacin~ said sewer and all
connections, manholes, flush tanks and other appurtenances thereto,
in accordance with the plans and specifications now on file in the
office of the City Clerk of the City of Salina, Kansas, which such
plans and specifications are hereby incorporated herein and ~~de a
part hereof by reference.
IN WITNESS WHEREOF, the said first party has hereunto caused
this conveyance to be signed on its behalf by its President, there-
unto duly authorized to do so, and to be attested by its Secretary, and
has caused its common seal to be hereunto I£ffixed, the day and year
last above written.
