AN ORDINANCE PROVIDING FOR THE CONDEMNATION OF CERTAIN NECESSARY
PROPERTY OR INTERESTS IN PROPERTY FOR THE USE OF THE CITY OF SALINA,
KANSAS, IN MAKING IMPROVEMENTS FOR OFFSTREET PARKING FACILITIES FOR
SAID CITY OF SALINA, KANSAS, AS PROVIDED IN RESOLUTIONS NOS. 2264,
2289 and 2292.
WHEREAS, the Board of Commissioners of the City of Salina,
Kansas, has heretofore duly authorized the undertaking of acquiring
and improving property for offstreet parking facilities as provided
in RESOLUTIONS NOS. 2264, 2289 and 2292; and
WHEREAS, in connection with said offstreet parking facilities
the Board of Commissioners deems that the property or interests in
property hereinafter described are necessary for the purpose of
providing property for said offstreet parking facilities; and
WHEREAS, all of the requirements of the laws of the State of
Kansas prerequisite hereto have been complied with;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF SALINA, KANSAS:
SECTION I. That it is hereby declared necessary that the
following described property or interest in property located in
the City of Salina, Saline County, Kansas, be acquired by condemna-
tion and emminent domain as provided by law for improvement for
offstreet parking facilities of the City of Salina, Kansas.
SECTION II. That the following property located in Salina,
Saline County, Kansas, be and it is hereby condemned:
Tract A. the South Half (52) of Lot Ninety-six
(96) on Fifth Street of the Original Town (now
City) of Salina, Saline County, Kansas; and
Tract B, a portion of the South Twelve (S 121) of
the North Thirteen and five -tenths feet (N 13.5')
of Lot One Hundred Fifty-two (152) on Santa Fe
Avenue of the Original Town (now City) of Salina,
in Saline County, Kansas, said tract being bounded
on the top by a horizontal plane, parallel to the
ground, Ten feet six inches (10' 6") above the
existing sidewalk level at the Northeast corner
of said lot, and reserving to the owners thereof
full use and enjoyment of the area above said
horizontal plane.
SECTION III. That upon taking effect of this ordinance, the
City of Salina shall present a written application to the Judge of
the District Court of Saline County, Kansas, as provided by law,
for the appointment of three (3) Commissioners to make an appraise-
ment of the damages and benefits for said conderanation.
SECTION IV. This ordinance shall take effect and be in force
