RESOLUTION 93-4584
A RESOLUTION ADOPTING A POLICY FOR PUBLIC ACCEPTANCE OF
MAINTENANCE RESPONSIBILITY FOR STORM WATER DETENTION PONDS IN
THE CITY OF SALINA.
WHEREAS, a stated purpose of the adopted Subdivision Regulations of
the City of Salina is to assure adequate drainage and storm water runoff
control; and
WHEREAS, Sec. 36-75 of said Subdivision Regulations provides that
storm water runoff control may be accomplished through the use of detention
ponds which may be dedicated either in fee simple or by drainage easement; and
WHEREAS, the Salina Board of City Commissioners wishes to provide
subdivision developers with an alternative to private maintenance of storm
water detention ponds; SO NOW, THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina,
Kansas:
Section 1. In lieu of establishing a homeowners association to
assume private responsibility for the maintenance of storm water detention
ponds in new subdivisions, the developer may make a lump sum payment to the
city for public maintenance. Upon payment of the fee, the city will accept
ownership and perpetual maintenance responsibility. The standard of
maintenance performed by the city will be similar to that provided to other
non -park open space such as the flood control levee.
Section 2. The amount of the lump sum detention pond maintenance
fee shall be calculated on a case-by-case basis taking into consideration such
factors as size and shape of the pond, type of pump, personnel and equipment
charges and other applicable cost items. The cost shall be calculated for the
initial 10 years of public ownership and shall be transformed into a present
value figure reflecting interest earnings and inflation.
Section 3. In order to exercise the alternative of city acceptance
and maintenance of the detention pond, the developer shall pay the fee in full
prior to approval of the final plat and acceptance of dedications by the Board
of City Commissioners.
Section 4. This resolution shall be in full force and effect from
and after its adoption.
Adopted by the Board of City Commissioners of the City of Salina,
Kansas and signed by the Mayor this 26th day of April, 1993.
