Book 3 s Page .3 J? ..:) CŒIVEYANCE OF EASEMENT THIS INDENTu.tŒ, made this -22th day of .r",y ., 1950, by and between ForteI' Brown and Ann Brown, his wife, parties of the first part and the CITY OF SALINA, KANSAS, of the second part. V~S, party of the second part desires to obtain an easement over, upon and through certain land ovmed by first parties, as hereinafter described; and WHEREAS, the parties of the first part are willing to gran:t s8Lid second parties said easement; and SO, NOW, THEREFORE, Witnesseth: That the parties of the first part, in consideration of the payment of the sum of Twenty Five Dollars and other good and valuable consideration, re- ceipt of which is hereby aclmowledged, do by these presents grant, bargain, sell and convey unto second parties an easement in, over and across a certain portion of the land owned by first parties, more particularly described as follows, to-wit: BEGINl,ING at a point which is 209.7 feet east of the south- east corner of Lot 12, Block 2, Country Club Heights Addition to the City of Salina, Kansas, in Saline County, Kansas, thence northwesterly 219.09 feet to a point, which point is 156.5 feet northeasterly from the northeast corner of said Lot 12 and on the south line of Overhill Road; thence 5.0 feet southwesterly along the south line of Overhill Road; thence southeasterly and parallel to the first line described 216.8 feet; thence east 5.1 feet more or less, to the point of BEGImiING, all for the right of ingress and egress by second party, its servants, officers, employees and contractors, for the purl.ose of installing, maintaining, replacing and repairing water mains therein in accordance with the future plans and speci- fications to be provided therefor by said City in carrying on its proprietary function of engaging in the distribution of water.
