ORDINANCE NUMBER 65$1,

AN ORDINANCE ratifying and confirming a contract with G. D. Byler Construction Company for
the construction of Interior Drainage Ditch No. 1 and No. 3 as designated and authorized
by Resolution Number 2519, and providing for the issuance of temporary notes to pay the
cost thereof, pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, of the proposal of the G. D.
Byler Construction Company, hereinafter referred to as the "Contractor" as submitted to the
Board of Commissioners on June 27, 1961, in the amount of $101,162.62, which is hereby found
to be the lowest and best bid for such work, and the contract awarded by the Board of
Commissioners of said City to said Contractor and signed on behalf of the City by its Mayor
on July 11, 1961, for the construction of certain public improvements in the City of Salina,
Kansas, to -wit:
1. Work to be done consists of furnishing all labor, construction
equipment, materials, and performing all operations required to construct
Interior Drainage Ditch No. 1 and No. 3, including excavation,
embankment and grading; drainage pipe and structures; riprap; gravel
surfacing; guard fence; and all other work not shown or specified but
essential to the proper completion of the project, including
precautionary work necessary for the protection of workmen, general
public and existing structures. All work shall be completed, ready
for traffic and use, in accordance with the detailed drawings and
specifications.
2. The sites of the work are located in Saline County, the
exact locations being as shown on the drawings.
3. The drawings governing and controlling the work, and to
which reference is made throughout these specifications, consist of
10 sheets, identified under Project File No. 155-86F, dated
November 1960.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made a part of this ordinance, be and the same is hereb
ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimate of the City Engineer on file in the Office of the City Clerk
which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the Office of
the City Clerk and in accordance with the proposal of said contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time
to time
as the
work progresses in
the manner and
form as
required by
law,
the total amount

exceed the amount

bear interest at not to exceed 5 per cent per annum and to mature not later than July 1,
1964, and to be issued in such amounts and at such times as may the money for the payment o
the cost of such work be required, such notes to be issued to said contractor and to be
redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu there
Section 4. That this ordinance shall take effect and be in full force from and after
its adoption and publication once in the official city paper.
