ORDINANCE NUMBER 6550

AN ORDINANCE ratifying and confirming a contract with R. R. Ballou Construction Company for
the construction of Euclid Avenue Dry Creek Crossing as designated and authorized by
Resolution Number 2477, and providing for the issuance of temporary notes to pay the cost
thereof, pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, of the proposal of the R. R.
Ballou Construction Company, hereinafter referred to as the "Contractor" as submitted to t
Board of Commissioners on June 27, 1961, in the amount of $9,647.40 which is hereby found
to be the lowest and best bid for such work, and the contract awarded by the Board of
Commissioners of said City to said contractor and signed on behalf of the City by its Mayor
on July 11, 1961, for the construction of certain public improvements in the City of Salina
Kansas, to -wit:
1. Work to be done consists of furnishing all labor, construction
equipment, materials, and performing all operations required to construct
the Euclid Avenue Dry Creek Crossing, including construction of temporary
dikes, dewatering the construction site, stabilizing the pipe bed,
installation of drainage pipe, construction of compacted fill and all
other work not shown or specified but essential to the proper completion
of the project, including precautionary work necessary for the protection
of workmen, general public and new and existing structures.
2. The site of the work is located within the city limits of Salina,
Kansas, approximately 800 feet west of the intersection of Euclid
Avenue and North Ninth 'Street (U. S. Highway 81).
3. The drawings governing and controlling the work and to which
reference is made throughout these specifications consist of 3 sheets
dated March 1961, identified under Project No. 155-86P, titled and
indexed as follows:

3. Manhole and Guard Fence Details
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made a part of this ordinance, be and the same is hereb
ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimate of the City Engineer on file in the office of the City Clerk
which estimate is hereby referred to and made a part of this ordinance.
Section 2. 'Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the office of
the City Clerk and in accordance with the proposal of said contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
I Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time to time as the work progresses in the manner and form as required by law,

the total amount thereof not to exceed the amount of $9,647.40 for such work, such notes

to bear interest at not to exceed 5 per cent per annum and to mature not later than July 1,
1964, and to be issued in such amounts and at such times as may the money for the payment

of the cost of such work be required, such notes to be issued to said contractor and to be
redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu
thereof.
Section 4. That this ordinance shall take effect and be in full force from and after
its publication once in the official city paper.
