Salina, Kansas, hereinafter referred to as the "City", pursuant to the provisions of Sections 10-1201 to 10-1212, inclusive, General Statutes of Kansas, 1949j, and all amendments thereto, by Ordinance No. 5798 of said City, passed August 3, 19532 authorized the issuance of its 10iraterworks Revenue Bonds, Series B, in the principal amount of ,1,000,000, dated August 1, 1953, of which bonds $748,000 principal amount, being bonds numbered 253 to 1,000, inclusive, each in the denomination of $1,000, remain outstanding and unpaid, and, pursuant to the provisions of said ordinance and of said bonds, said City will call said bonds for redemption and payment on August 1, 1961, and will refund said bonds, and WHEREAS, said City, pursuant to the provisions of Sections 10-1201 to 10-1212, inclusive, General Statutes of Kansas, 1949, and all amendments thereto, by Ordinance No. 6011 of said City, passed November 8, 1955, authorized the issu- ance of its Waterworks Revenue Bonds, Series C, in the principal amount of $600,000, dated October 1, 1955, of which bonds $431,000 principal amount, being bonds num- bered 167 to 6003 inclusive, each in the denomination of $1,000, remain outstanding and unpaid, and, pursuant to the provisions of said ordinance and of said bonds, said City will call said bonds for redemption and payment on August 1, 1961, and will refund said bonds, and WFE EAS, pursuant to the provisions of Sections 10-1201 to 10-1212, in- clusive, General Statutes of Kansas, 1949, and all amendments thereto, the govern- ing body of the City of Salina, Kansas, adopted a resolution providing for the alteration, improvement, extension and enlargement of the waterworks owned by said City at a total cost not exceeding $1768,000, such cost to be paid with the pro- ceeds of an issue of waterworks improvement revenue bonds of said City in a prin- cipal amount not exceeding $768,000, to be issued in accordance with the provisions u of said statutes, and tdHEREAS, notice of the intention of the City to make said alterations, improvements, extensions and enlargements and to pay the cost thereof by the issu- ance of the City's waterworks improvement revenue bonds was duly published as re- quired by law, and no written protest against the making of said alterations, im- provements, extensions and enlargements was filed in the office of the City Clerk, and the governing body of said City is now authorized to issue revenue bonds under said statutes for the purpose of paying the cost of said improvements, and WHEREAS., pursuant to the provisions of Sections 10-1201 to 10-1212, in- clusive, General Statutes of Kansas, 1949, and all amendments thereto, the governing body of the City of :Salina, Kansas, adopted a resolution providing for the altera- tion, improvement, extension and enlargement of the sanitary sewer system ovined by said City at a total cost not exceeding $1,650,0003 such cost to be paid with the proceeds of an issue of sewer system revenue bonds of said City in a principal amount not exceeding $lp650,000, to be issued in accordance with the provisions of said statutes, and �'aHEREAS, notice of the intention of the City to make said alterations, improvements, extensions and enlargements and to pay the cost thereof by the issuance -2- u 1 u of the City's sewer system revenue bonds was duly published as required by law, and no to issue revenue bonds under said statutes for the purpose of paying the cost of said improvements, and 'IHEREAS, pursuant to the provisions of Sections 12-856 to 12-868, in- clusive, 1959 Supplement to the General Statutes of Kansas, 1949s the governing body of the City of Salina, Kansas, by Ordinance No. ��� , passed June 27, 19613 has combined the waterworks system and the sewage disposal system of said City, as said systems are defined and referred to in said Sections 12-856 to 12-868, in- clusive, 1959 Supplement to the General Statutes of Kansas, 199, and said combined water and sewage system will, from and after July 11 1961s be operated and financed in accordance with the provisions of said statutes, and _ZiEREAS, pursuant to the provisions of said Sections 12-856 to 12-868, inclusive, 1959 Supplement to the General Statutes of Kansas, 19119, and particularly Section 12-868, the governing body of the City of Salina, Kansas, will issue its Combined 'dater and Sewage System Revenue Bonds in the aggregate principal amount of $3,6OO,000 for the purpose of redeeming and paying the outstanding 1,7aterworks Reve- nue Bonds of the City, Series B, dated August 1, 1953, and Series C, dated October 1, 1955, hereinbefore referred to, and for the purpose of altering, improving, ex- tending and enlarging the water and sewer system of said City as hereinbefore re- ferred to, and ZEREAS, under the provisions of said statutes, it is the duty of the governing body of said City to make provision for the payment of the Combined Water and Sewage System Revenue Bonds of the City to be issued as aforesaid by fixing rates, fees or charges for the use of or services rendered by said water and sewage system, which rates, fees or charges shall be sufficient to pay the cost of opera- tion, improvement and maintenance of said utility and to pay the principal of and the interest upon said revenue bonds when due, —3— 1 NW, THEREFORE, DE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS, AS FOLLOWS: Section 1. The governing body of the City of Salina, Kansas, hereby finds and determines that upon the issuance of the Combined Vater and Sewage System Reve- nue Bonds of the City of Salina, Kansas, hereinbefore referred to, the rates, fees or charges for the use of and services rendered by the combined water and sewage system of said City, in order fully to meet the requirements of the statutes of the State of Kansas, will be as hereinafter specified, subject, however, to such changes therein and revisions thereof as may be made from time to time by said City. Section,, from and after the date of the issuance of any of the :*3,600,000 principcunt of Combined Yater and Sewage System Revenue Bonds of the City of Salina, Kansas, the initial monthly water rates to be charged and collected for water service furnished to ,any user by the waterworks system of the City, the same being a part of the combined water and sewage system of the City, shall be as follows: Rates Inside City First 2,000 cu. ft. r@ .25 per C cu. fto or 33.33 per M gallons; Next 3,000 cue ft. @ .22 per C cue ft. or 29.33 per M gallons; Next 5,000 cu. ft. @ .19 per C cu. ft. or 25.336 per M gallons; All over 10,000 cu. fto ® .15 per C cu. ft. or 20.000 per M gallons. Except for the minimum amounts allowed, the following are hereby established as the minimum charges for regular uses of water using the prescribed size of meter and not to exceed the maximum volume of water for each minimum charge on a monthly basis t, -4- Monthly Meter Minimum Cu. The minimum charge for water consumed E� or used outside the limits of the City of Salina shall be two times the minimum charge for water consumed within the city. For water consumed or used outside f the city in a volume in excess of the minimum for each meter shall be charged at the regular rate plus twenty-five per cent (25%) thereof. The rates prescribed herein shall not apply to situations wherein the Waterworks Department of the City of Salina is bound by noncancellable contracts to provide water at other rates to consumers or users outside the city. 1 1 1 1 Section 3. No water or sanitary sewage service shall be ;furnished or rendered by the City's combined ,•nater and sewage system free of cl" arg e . Section 6. Y 11 water meters shall be _read and bills for water and sewage :services (or either) rendered monthly, and such bill shall be collected as a combined bill for water and sewage service furnished each customer. Each bill shall becor.,e due and ,Jayable upon the render- ing of such bill and, if not paid within t8n: days after the date on !-which the bill is rendered, such bill s'r_all be considered delinquent and an additional charge of shall be rade on t_�e gross amount of said bill, and notification by mail --hall be given to the cu.storae"r at the address of the water or sewer connection that such bill, tiith said °' delinquency charge, shall be paid ,,iithin ten days or grater or sewer service, or both., to the property will be disconnected, and a "5 disconnection charge will be assessed.
