6536 Utility Imp - Holiday AddCONSOLIDATED-$ALINA ORDINANCE NUMBER 6536 (Published in The Salina Journal , 1961) AN ORDINANCE ratifying and confirming a contract with Wilmoth Construction Company for the construction of Lateral Sanitary Sewers 436, 437, 438, 440, and 441, and providing .for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the Wilmoth Construction Company, hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on June 6, 1961, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on June 6, 1961, for the construction of certain public improvements in the City of Salina, Kansas, towit: An 8 inch clay pipe sewer (1) Beginning at an existing manhole at the southeast corner of Lot 29, Block 4, Holiday Addition (2) thence west along easement between Lots 29 and 8, Block 4, Holiday Addition to a point 5 feet west of the east right of way of Broadway Boulevard; (5) thence south along the center line of Smithers Street to a point 120 feet south of the north line of Tract Number 4, Surveyor's Plat Number 51, where a manhole will be constructed which will be the terminus of Lateral 436. An 8 inch clay pipe sewer: (1) Beginning at an existing manhole between Lots 33 and 34, of Block 1 of North Park Addition; (2) thence north in alley first west of Barney Street in said Block 1 to a point 10 feet north of the south line of Lot 18, of said Block where a manhole will be constructed which will be terminus of Lateral 437. (1) an 8 inch clay pipe sewer, beginning at a manhole to be constructed near the west line of Broadway Boulevard and 8' north of the south line of DuVall Avenue, (2) thence west, northwesterly and north following a line 8' from and parallel to the south and west lines of DuVall Avenue to a point 30 feet south of the south line of Crawford Avenue, where a manhole will be constructed which will be the terminus of Lateral 438. An eight inch clay pipe sewer, beginning at a manhole in the intersection of York Street and Francis Street; thence north in Francis Street to a point 50 feet south of the south line of C. R. I. and P. right-of-way, where a manhole will be constructed which will be the terminus of Lateral 440. (1) An 8 inch clay pipe sewer beginning at an existing manhole in the northeast corner of Indian Rock Park, (3) thence south to a point directly east of a line 5 feet north of the south line of Smithers Street, (4) thence west along a line extended 5 feet north of the south line of Smithers Street to a point at the center line of the north and south Smithers Street, (5) thence south along the center line of Smithers Street to a point 120 feet south of the north line of Tract Number 4, Surveyor's Plat Number 51, where a manhole will be constructed which will be the terminus of Lateral 436. An 8 inch clay pipe sewer: (1) Beginning at an existing manhole between Lots 33 and 34, of Block 1 of North Park Addition; (2) thence north in alley first west of Barney Street in said Block 1 to a point 10 feet north of the south line of Lot 18, of said Block where a manhole will be constructed which will be terminus of Lateral 437. (1) an 8 inch clay pipe sewer, beginning at a manhole to be constructed near the west line of Broadway Boulevard and 8' north of the south line of DuVall Avenue, (2) thence west, northwesterly and north following a line 8' from and parallel to the south and west lines of DuVall Avenue to a point 30 feet south of the south line of Crawford Avenue, where a manhole will be constructed which will be the terminus of Lateral 438. An eight inch clay pipe sewer, beginning at a manhole in the intersection of York Street and Francis Street; thence north in Francis Street to a point 50 feet south of the south line of C. R. I. and P. right-of-way, where a manhole will be constructed which will be the terminus of Lateral 440. (1) An 8 inch clay pipe sewer beginning at an existing manhole in the northeast corner of Indian Rock Park, wa, ov.,aux l Y:L-�ALiNA 1 1 (2) thence in a northeasterly direction following a line 25 feet east of the center line of Channel Road 1300 feet, more or less, to a point 5 feet south of the center line of Hillcrest Lane; (3) thence east along a line 5 feet south of the center line of Hillcrest Lane 745 feet, more or less, to a point 5 feet west of the west property line of Lot 9, Mount Barbara Addition, where a manhole will be built which will be terminus of Lateral 441. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk which estimate is hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposals of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $28,182.00 for such work, such notes to bear interest at not to exceed 5 per cent per annum and to mature not later than December 1, 1962, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contracto and to be redeemed and cancelled at the time that Internal Improvement bonds are issued in lieu thereof. Section 4. That this ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
