6531 Levy AssessmentsCONSOLIDATED-SALINA 1 U ORDINANCE NUMBER —==f— (Published in The Salina Journal (J1� 1961) AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of constructing Lateral Sanitary Sewer Districts Numbered 426, 427, and 428, and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for the cost of building and constructing Lateral Sanitary Sewer Districts Numbered 426, 427, and 428, as authorized by the provisions of Ordinance Numbers 6491, 6463, and 6488, the cost of which has been duly ascertained as shown by the City Engineer's final estimate of cost, which has been duly approved by the Board of Commissioners, there is hereby levied,and assessed on the property liable therefor , being all lots and pieces of ground lying in the sewer districts mentioned above as created by Ordinance Numbers 6491, 6463, and 6488, according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assessments covering the cost of such improvements constructed in said sewer districts, said special assessments being based on the special valuation and appraisement made by three disinterested appraisers appointed by the,,Board of Commissioners of the City of Salina, Kansas, which said appraisement is hereby referred to and made a part of this ordinance and the several amounts levied, and apportioned against the cost of improvements constructed in such district being hereby found and determined to be as set forth in the following section of this ordinance. Section 2. That for the purpose of the payment of the cost of construction of Lateral Sanitary Sewer 428, An eight inch clay pipe sewer beginning at a manhole in Rocket Avenue and on the center line of easement extended on the south line of Lot 9, Block 1, of the Replat of Moose Addition, CONSOLIDATED-$ALINA �1 1 F- L (1) thence west along the center line of easement on the south line of Block 4 of said Addition to a manhole to be constructed on the line common to Lot 6 and 7 of Block 4, of said addition, (2) thence north on easement between Lot 6 and 7 to a point 20 feet north of the south line of Elgin Drive where a manhole will be constructed and sewer will branch east with Branch "A" and west with Branch "B", (3) Branch "A" will begin at said manhole and thence east along a line 20 feet north of the south line of Elgin Drive to a manhole to be constructed 20 feet west of the east line of Jameson Avenue,, (4) thence north along a line 20 feet west of the east line of Jameson Avenue to a point 10 feet north of the south line of Lot 2, Block 2, of said Addition where a manhole will be built which —ill be the terminus of Branch "A". Said amounts levied, apportioned and assessed as aforesaid shall be due and collectible in ten equal installments, the first becoming due with the taxes levied in 1961, and one of said installments falling due each and every year thereafter until all are paid, all to be collected with interest as in this ordinance provided for, however, that the owner of any piece or parcel of property liable for any such assessment may redeem his property from any such assessment liability by paying into the City Treasury the entire amount chargeable against the same as in this ordinance designated at any time within thirty days from the publication of this ordinance, and before the issuance of bonds of said City, in payment of the cost of said improvements, as his property so paid shall not thereafter be liable for any further assessment for any cost of said improvements nor for any part of said bonds. Section 6. There is hereby levied and assessed further against such lots and pieces of ground as described in this ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, such rate to be hereafter determined and fixed by ordinance when such bonds are issued, all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days, as specified in the preceding section hereof as by law provided, to the time of collection of the last installm as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinance and the fixing of the interest rate when such bonds are authorized and issued,it shall be the duty of the City Clerk of said City to annually at the same time other taxes are certified, to certify to the County Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and improvements, except such property on which the special assessments have been paid in full as hereinbefore provided, t A 7 CONSOLIDATED-SALiNA 1 together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest at one year at the rate to be fixed and provided for in this ordinance, being the rate borne by the bonds to be issued on all unpaid balances of such amounts so certified as herein provided shall be placed upon the tag roll by the County Clerk of Saline County, Kansas, and collected as all other taxes are collected. Section 7. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city paper.
