6521 Parking Improvements(Published in the Salina Journal 6T 19 1961) ORDINANCE NO. Cr JAI AN ORDINANCE PROVIDING FOR THE CONDEMNATION OF CERTAIN NECESSARY PROPERTY OR INTERESTS IN PROPERTY FOR THE USE OF THE CITY OF SALINA, KANSAS, IN MAKING IMPROVEMENTS FOR OFFSTREET PARKING FACILITIES, PARTICULARLY FOR USE AS A PEDESTRIAN ARCADE OR WALKWAY FOR SAID CITY OF SALINA, KANSAS, AS PROVIDED IN RESOLUTIONS NOS. 2264, 2289 and 2292. WHEREAS, the Board of Commissioners of the City of Salina, Kansas, has heretofore duly authorized the undertaking of acquiring and improving property for offstreet parking facilities as provided in RESOLUTIONS NOS. 2264, 2289 and 2292; and WHEREAS, in connection with said offstreet parking facilities the Board of Commissioners deems that the property or interests in property hereinafter described are necessary for the purpose of providing property for said offstreet parking facilities, parti- cularly for a pedestrian arcade or walkway; and WHEREAS, all of the requirements of the laws of the State of Kansas prerequisite hereto have been complied with; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS: SECTION I. That it is hereby declared necessary that the fol- lowing described property or interest in property located in the City of Salina, Saline County, Kansas, be acquired by condemnation and eminent domain as provided by law for improvement for offstreet parking facilities of the City of Salina, Kansas, particularly for a pedestrian arcade or walkway. SECTION II. That the following interest in property located in Salina, Saline County, Kansas, be and it is hereby condemned: A perpetual easement in and to a portion of the North Seven feet of the South Eight feet Five inches of: Lot One Hundred Twenty-two (122) on Santa Fe Avenue in the Original Town (now City) of Salina, in Saline County, Kansas, said tract being bounded on the top by a horizontal plane, parallel to and 9 feet above the ground floor level of the existing building and bounded on the bottom by a horizontal plane parallel to and one foot six inches below the ground floor level in the existing building, and including the right to control the north surface of the south wall of said existing building within said above described area, and reserving to the owners thereof full use and enjoyment of the area above and below said horizontal planes, and the right of access onto said arcade; and A temporary easement in a portion of the South Twenty feet of Lot One Hundred Twenty-two (122) on Santa Fe Avenue in the Original Town (now City) of Salina, in 1 1 Saline County, Kansas, for the purpose of constructing an arcade and relocating stairways to the second floor and basement above condemned for an arcade, which easement is particularly described in the plans and specifications filed in the office of the Clerk of the City of Salina, Kansas. SECTION III. That upon taking effect of this ordinance, the City of Salina shall present a written application to the Judge of the District Court of Saline County, Kansas, as provided by law, for the appointment of three (3) Commissioners to make an appraisement of the damages and benefits for said condemnation.
