EASEMENT
THIS INDENTURE, made this ,2 ~~~ day of July, 1985, by
and between PLANTERS BANK AND TRUST COMPANY, Trustee UTA
October 1, 1971, No. 122 A/K/A William H. Graves Realty
Trust, and HWS., Inc., a Kansas corporation with principal
offices at 104 N. Hillside, Salina, Kansas, of the First
Part and THE CITY OF SALINA, KANSAS, a municipal
corporation, of the Second Part:
WITNESSETH: The said Parties of the First Part for a
good and valuable consideration, the receipt and sufficiency
of which is hereby acknowledged, do by these presents,
grant, bargain, sell and convey unto the Party of the Second
Part, a permanent easement in, over and across a certain
portion of land owned by the First Parties, more
particularly described as follows:
A Part of Lot One (1), Block Eight (8),
Belmont Addition to the City of Salina, Kansas,
being more particularly described as follows:
Beginning at a point that is the Northeast
corner of said Lot One (1); thence Southwesterly
along the north line of said Lot One (1) a dis-
tance of 83.73 feet; thence east a distance of
67.16 feet to a point on the east line of said
Lot One (1) that is 50.00 feet south of the North-
east corner of said Lot One (1); thence north
along the east line of said Lot One (1) a dis-
tance of 50.00 feet to the point of beginning.
Said tract contains 0.039 acres, more or less,
for all of the rights of ingress and egress of said Second
Party, its servants, officers, employees and contractors,
for the purpose of constructing, installing, repairing,
replacing and maintaining public streets, in perpetuity.
