6614 Eminent Domain1 1 C t� (Published in The Salina Journal, _, 1962) ORDINANCE NUMBER (D614 AN ORDINANCE CONDEMNING CERTAIN LAND WITHIN THE CITY OF SALINA, KANSAS, FOR THE USE OF SAID CITY IN THE RELOCATION AND IMPROVEMENT OF HIGHLAND AVENUE, A MAIN TRAFFICWAY WITHIN THE CITY OF SALINA, KANSAS, FROM A POINT APPROXIMATELY TWO -HUNDRED TWENTY- FIVE (225) FEET SOUTH OF ITS INTERSECTION WITH PRESCOTT AVENUE; THENCE IN A NORTHWESTERLY DIRECTION TC A POINT WHERE SOUTH EIGHTH STREET INTERSECTS PRESCGTT AVENUE; AND PROVIDING THAT THE COSTS THEREOF SHALL BL PAID BY THE CITY AT LARGE IN ACCCRD,1NCE WITH G. S, 1961 SUPP. 12-689. WHEREAS the governing body of the City of Salina, Kansas, did on the 27th day of February, 1962, find it necessary to appropriate certain private property located within the City of Salina, Kansas, for the use of said City in the relocation and improvement of Highland Avenue, a main trafficway within the said City, from a point approximately Two -hundred Twenty-five (225) feet south of its intersection with Prescott Avenue; hence in a northwesterly direction to a point where South Eighth Street intersects Prescott Avenue, and directed the City Engineer of the City of Salina, Kansas, to make a survey and description of the lands required for said property; and, WHEREAS on the 13th day of March, 1962, a survey and description of the lands required for the same was duly filed by the City Engineer with the City Clerk. NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: Section 1. That the following --described tract of land is hereby condemned and appropriated for the use of the City of Salina, Kansas, for the relocation and improvement of Highland Avenue, a main trafficway within the City of Salina, Kansas, from a point approximately Two -hundred Twenty-five (225) feet south of its intersection with Prescott Avenue; thence in a northwesterly direction to a point where South Lighth Street intersects Prescott Avenue, to -wit: The East Ninety-eight (98) feet of Lots Two and Four (2 L 4) and the East Ninety-eight (98) feet of the North Twenty-five (25) feet of Lot Six (6) all on Highland Avenue in Prescott 21ddition to the City of Salina, Saline County, Kansas. Section 2. That it is found that all of the property within the city limits of Salina, Kansas, will be specifically benefited by reason of the acquisition of said land for the purpose of improvement of said main trafficway, and that the City at large shall be known as the "benefit district". Section 3. That for payment of the costs thereof the City of Salina, Kansas, may issue temporary notes in an amount not to exceed the total cost of acquiring said land herein condemned, which said temporary notes shall be paid from funds authorized by G. S. 1961 Supp. 12-689 or by issuance of general improvement bonds. Section 4. That L. C, Bengtson, City Attorney, is hereby ordered and directed to forthwith prepare and present in the name of the Board of Commissioners of the City of Salina, Kansas, a written application to the Judges of the District Court of Saline County, Kansas, praying for an order of appointment of commissioners to make appraisement and assessment of damages arising from the appropriation of said real estate and to do and perform all things in and about the procurring and recording of said order of appropriation required by law. 1 1 C Section 5.
