6611 Eminent Domain1 (Published in the Salina Journal k-p'i� 2 1 1962) ORDINANCE NO. 6611 AN ORDINANCE PROVIDING FOR THE CONDEMNATION OF CERTAIN NECESSARY PROPERTY OR INTERESTS IN PROPERTY FOR THE USE OF THE CITY OF SALINA, KANSAS, IN MAKING IMPROVEMENTS FOR OFFSTREET PARKING FACILITIES, PARTICULARLY FOR USE AS A PEDESTRAIN ARCADE OR WALKWAY FOR SAID CITY OF SALIN:, KANSAS, AS PROVIDED IN RESOLUTIONS NOS. 2264, 2289 and 2292. WHEREAS, the Board of Commissioners of the City of Salina, Kansas, has heretofore duly authorized the undertaking of acquiring and improving property for offstreet parking,facilities as provided in RESOLUTIONS NOS. 2264, 2289 and 2292; and WHEREAS, in connection with said offstreet parking facilities the Board of Commissioners deems that the property or interests in property hereinafter described are necessary for the purpose of providing property for said offstreet parking facilities, parti- cularly for a pedestrain arcade or walkway; and WHEREAS, all of the requirements of the laws of the State of Kansas prerequisite hereto have been complied with; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSI(N ERS OF THE CITY OF SALINA, KANSAS: SECTION I. That it is hereby declared necessary that the fol- lowing described property or interest in property located in the City of Salina, Saline County, Kansas, be acquired by condemnation and eminent domain as provided by law for improvement for offstreet parking facilities of the City of Salina, Kansas, particularly for a pedestrain arcade or walkway. SECTION II. That upon taking effect of this ordinance, the City of Salina shall present a written application to the Judge of the District Court of Saline County, Kansas, as provided by law, for the appointment of three (3) Commissioners to make an appraisement of the damages and benefits for said condemnation. SECTION IV. Ordinance No. 6521 is hereby repealed and resdinded. 1 SECTION V. This ordinance shall take effect and be in force from and after the publication once in the official City paper.
