6575 Utility ImprovementsC:0i7E,C.i,.L'P.1, D-SALYNA ORDINANCE NUMBER 657.____ (Published in The 'Salina Journal 1961) AN ORDINANCE ratifying and confirming a contract with Catherman Construction Company for the construction of Lateral 'Sanitary 'Sewers 442, 443, 444, and providing for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance of the City of 'Salina, Kansas, of the proposal of the Catherman Construction Company, hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on October 24, 1961, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on October 31, 1961, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Lateral 'Sanitary 'Sewer 442 Branch "A" and Branch "B": Branch "A" described as follows: (1) An 8 inch clay pipe sewer beginning with the construction of a manhole over an existing stub -out on the north side of Hazel Court at its intersection with Ohio Street, (2) thence southwesterly following the north parking of Hazel Court to a point 5 feet south of the north line of Greeley Avenue where a manhole will be built which will be the terminus of Branch "A" of Lateral 4-22. Branch "B" described as follows: (1) An 8 inch clay pipe sewer beginning with the construction of a manhole over an existing stub -out on the south side of Hazel Court at its intersection at Ohio Street, (2) thence south in easement back of Lots 1 to 11 inclusive of Hazelwood Addition and with the construction of a manhole at a point 5 feet west of the northwest corner of said Lot 11 which will be the terminus of Branch "B" of Lateral 442. (1) An 8 inch clay pipe sewer beginning at an existing manhole at the interesetion of Ohio `Street and Broadway Boulevard, (2) thence south to a point 5 feet north of the center line of Wayne Avenue which is east of Ohio Street, (3) thence east along a line 5 feet north of the center line of said Wayne Avenue to the center line of Huntington Road where a manhole will be built which will be the terminus of Lateral 443. (1) An 8 inch clay pipe sewer beginning at an existing manhole in the east parking of Channel Road and at the west end of Hillcrest Lane, (2) thence northeasterly paralleling the center line of Channel Road to a point 220 feet north of the south line of Lot 2, 'Surveyor's Plat 34, in the City of Salina, Kansas, where a manhole will be built which will be the terminus of Lateral 444. CUP?SOLI DATED -S ALINA i� 1 at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said a improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk which estimate is hereby referred to and made a part of this ordinance. Section 2. `Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposals of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. 'Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $18,403.00 for such work, such notes to bear interest at not to exceed 5 per cent per annum and to mature not later than December 1, 1962, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improvement bonds are issued in lieu thereof} Section 4. That this ordinance shall take affect and be in full force from and after its adoption and publication once in the official city paper.
