ORDINANCE NUMBER 6 7 -

AN ORDINANCE providing for the regulation and control of dogs within the City of Salina,
Kansas; providing for the vaccination and registration of all dogs, the procedure and
fees therefore; prohibiting the running at large of dogs within the city; providing for
the impounding of dogs, the costs therefore and the disposal of unclaimed dogs; providing
for the control of vicious dogs and rabies suspects and the impounding and disposal
thereof; providing penalties for violation of said ordinance, and repealing sections
5-201 to 5-206, both inclusive, of the Code of the City of Salina, Kansas, 1960.
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS of the City of Salina, Kansas:
Article 2. Dogs.
5-201. DEFINITIONS. For the purposes of this Article, the following definitions
shall prevail.
(a) Dog. The term "dog" where ever used in this ordinance, shall apply to both male
and female dogs, whether spayed or unspayed, except where so stated.
(b) Inoculation, Vaccination or vaccination for rabies. Whenever these terms are
used, they shall mean the inocculation of a dog with an anti -rabies vaccine approved by
the US Department of Agriculture. Such vaccination to be performed by a duly licensed
veterinarian.
(c) Own. The term "own" shall be deemed to mean and include, own, keep, harbor, or
have control, charge or custody of a dog.
(d) Owner. The term "owner" shall mean any person owning, keeping, harboring, or
having charge or control of, or permitting any dog to habitually be or remain on, or be
lodged or fed within, such persons house, yard or upon his premises.
5-202. REGISTRATION AND ANTIRABIES VACCINATION REQUIRED. It shall be unlawful for
any person living within the corporate limits of the City of Salina to own any dog over
five (5) months of age without first having had the dog inocculated against rabies and
paying a registration fee. The registration and anti -rabies inocculation shall then be
set up on an annual basis and shall be accomplished at the office or clinic of any registered
veterinarian in Saline County.
5-203. REGISTRATION FEES. At the time of the first or the annual anti -rabies
inocculation, the licensed veterinarian administering the vaccine shall collect a
registration fee of Two Dollars ($2) for all dogs, except unspayed female dogs, whose
owners reside within the corporate limits of the City of Salina. For unspayed female dogs
the registration fee shall be Five Dollars ($5) per year. Each licensed veterinarian shall
keep on hand the proper registration forms and shall forward the completed original
registration form on each dog to the City Clerk of the City of Salina between the first
and tenth of each month for dogs receiving anti -rabies vaccine during the preceding month.
5-204. PROCEDURE FOR REGISTRATION. The licensed veterinarian registering said dog
shall:
(a) Fill out a numbered registration certificate, in triplicate, on the proper form
giving the owners name and address, a description of the dog as to color, breed, sex, age,
name (if any), date of vaccination and type of anti -rabies vaccine used.
(b) Issue to each dog so vaccinated, and registered, a tag of metal or other durable
substance having stamped or otherwise marked thereon the registration number, which
corresponds to the number of the registration certificate.
(c) Instruct the owner of the dog that the registration tag issued shall be attached
to a metallic, leather, or other suitable collar and shall be kept on the dog at all times.
(d) After performing (a), (b) and (c) above, give one copy of the registration
certificate to the owner of the dog, keep one copy for filing in his office or clinic,
and send the original copy to the City Clerk of the City of Salina as given in Section
5-203. The registration tag so issued will be good for one year from the date of issuance.
5-205. REGISTRATION FORMS TO BE KEPT ON HAND. The City Clerk of the City of Salina
shall keep on hand the necessary registration forms and shall issue the same to any licensed
veterinarian in Saline County at a price agreed upon by the City Commissioners of the City
of Salina.
5-206. RUNNING AT LARGE PROHIBITED. It shall be unlawful for the owner of any dog
to permit such dog to run at large within the corporate limits of the city at any time.
Any dog shall be deemed to be running at large when found off the premises of the owner.
It shall be lawful for any city police offic er or other person duly appointed by the
City Manager, to pursue and capture such dog so running at large. Provided, that any dog
kept securely tied or kept securely within an enclosure on private premises or led by a
leash, chain, strap or rope and so in the control of its owner or keeper shall not be
deemed to be running at large within the meaning of the provisions of this article.

5-207. IMPOUNDING, EUTHANIZING OR OTHERWISE DISPOSING OF.
(a) Any dog found running at large within the city limits shall be captured or taken
up by any police officer of the city or other person duly appointed by the City Manager and
impounded in a place provided for that purpose by the City and a record of all dogs so
impounded, with their description and date of impounding, shall be kept. If the dog so
impounded has no current registration tag, as provided for by Section 5-204, it shall be
kept for three (3) days and, if within that time, the owner does not appear and claim such
dog, it shall be sold, euthanized or otherwise disposed of. If within three (3) days from
the impounding date the owner of an impounded dog shall appear and claim such dog, he
shall pay the sum of Five Dollars ($5) for impounding and keeping the dog and such dog
shall be turned over to the person claiming it. Provided, that the claiming of a dog so
impounded shall be prima facie evidence of the violation by such owner of Section 5-202
and shall subject such owner to the penalty provided for such violation, and in addition
to any such penalty, he shall be required to fulfill the requirements of Sections 5-203
and 5-204.
(b) Any impounded dog which has not been claimed within the three (3) day limit may
be sold to any person and that person shall be required to have the dog duly registered
and inocculated and provided for by Sections 5-203 and 5-204.
(c) If the dog so impounded has a current registration tag attached to a metalic,
leather or other suitable collar, the owner of such dog, as shown by the records of the
City Clerk, shall be notified as soon as possible within a five (5) day impounding period.
If the owner cannot be located within a period of five (5) days after impounding, the Health
Officer shall be notified and he shall have another five (5) days time in which to find or
locate the dogs owner. If, at the end of the ten (10) days impounding period, neither the
pound nor the Health Officer have been able to find or locate the owner, then the dog may
be sold, euthanized, or otherwise disposed of.
(d) If the dog so impounded has a current registration tag and the owner is duly
notified but refuses to redeem the dog within a period of five (5) days from the date of
impoundment, then the dog may be sold, euthanized or otherwise disposed of.
(e) The payment of an annual registration fee and the wearing of a current tag shall
not prevent the impounding, sale, euthanizat ion or other disposition of any dog found
running at large in violation of Section 5-206 when the other provisions of the section
have been carried out.

5-208. VICIOUS DOGS. UNLAWFUL TO KEEP OR HARBOR. It shall be unlawful for any
person to keep or harbor any vicious dog, as legally defined, within the City Limits of
the City of Salina. Dogs determined to be vicious shall be removed from the city limits,
euthanized or otherwise disposed of by order of the Chief of Police.
5-209. NOT TO ENTER BUILDINGS. EXCEPTION. No dog over five (5) weeks of age shall
be allowed to enter any theatre, store, or other public place or building in the city,
whether accompanied by its owner or person in charge or otherwise. Exception; In the
case of a person legally blind who has charge of an is accompanied by a seeing -eye dog,
as defined by State statute.
5-210. IMPOUNDMENT OF RABIES SUSPECTS. Any dog which is suspected of having rabies,,
or any dog which has bitten a person and has thereby caused an abrasion of the skin of
such person, such dog shall be seized and confined in the City Pound, or in a veterinary
hospital, for a period of ten (10) days; provided, that where such dog has been properly
inoculated and licensed, it may be confined by its owner, away from the public, for a like
term, and no such dog shall be removed from the city limits until released from such
confinement by the Health Officier after veterinary examination. Impounding in either the
City Pound or veterinary hospital shall be at the owners expense. Fees for impounding such
animals at the City Pound shall be One Dollar ($1) per day and, if such dog should exhibit
any signs of illness or should die within the ten (10) day impounding period, any costs
for veterinary examination shall be added, including any pathological studies required for
proper diagnosis, and the owner of such dog shall be required to pay such costs.
5-211. ANIMALS BITTEN BY RABID ANIMALS. Any dog bitten by a known rabid animal shall
be impounded in an approved kennel for a period of six months or immediately euthanized.
If the owner is unwilling to destroy the exposed animal, the following alternatives may be
used:
(a) If no previous vaccination has been given within a period of two years with LEP
chick -embryo vaccine, or within one year with phenolized vaccine, approved post -exposure
treatment may be administered by a licensed veterinarian and the dog confined in an
approved kennel for three months.
(b) If the animal has been previously vaccinated within the time limits stated in
(1), the dog shall be revaccinated and confined in an approved kennel for thirty days.
5-212. PENALTY. Any person violating any of the provisions of Sections 5-201 to
5-211, both inclusive, shall upon conviction thereof, be fined in any sum not exceeding
twenty-five dollars ($25) in addition to the other fees and penalties provided for under
such sections.
5-213. EXCEPTIONS TO LICENSE. TRANSIENT DOGS. The provisions of this article with
respect to licensing shall not apply to any dog owned by any person temporarily remaining
within the city less than thirty (30) days, or any dog brought into the city for bench or
show purposes, or hunting dogs brought into the county for less than 30 days. Such dogs
shall be kept under strict supervision of the owner. It shall be unlawful to bring any
dog into the city which does not comply with the laws of the State of Kansas regarding
the handling and importation of dogs.

5-214. In the event that a rabies epidemic shall occur or may be deemed by the Health
Officer to be imminent, all of Chapter V, the Code of the City of Salina, may be declared
temporarily suspended by order of the Mayor and such emergency measures as are necessary
may be substituted by proclamation of the Mayor.
