6716 Street ImprovementsCONSOLIDATED-SALINA l � ORDINANCE NUMBER j (Published in The Salina Journal —i , 1963) AN ORDINANCE providing for the paving of the Alley First East of Santa Fe Avenue with concrete (Ten (10) feet wide) from the south line of Mulberry Street to the north line of South Street; paving and grading of the Alley First North of Ellsworth Avenue with concretes (Sixteen (16) feet wide) from the west line of Santa Fe Avenue west 175 feet; curbing, guttering, paving and grading of Antrim Avenue with concrete (Thirty --three (33) feet wide from back of curb to back of curb) from the west line of Santa Fe Avenue to the east line of Eighth Street, the same being an intervening connecting street; curbing, guttering, paving and grading of Beechwood with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Northwood to the south line of Greeley; curbing, guttering, paving and grading of Driftwood Road with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the north line of Northwood Lane to the north line of Greeley Avenue; curbing, guttering, paving and grading of Greeley Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Marymount Road to the west line of Beechwood Road; curbing, guttering, j paving and grading of Greeley Avenue with concrete (Thirty three (33) feet wide from back of curb to back of curb) from the west line of Driftwood Road to the west line of Beechwood Road; curbing, guttering, paving and grading of Harsh Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west line of Tenth Street to the east line of Eleventh Street, the same being an intervening connecting street; curbing guttering, paving and grading of Indiana Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Stack Avenue to the north side of Greeley, the same being an intervening connecting street; curbing, guttering, paving and grading of Indiana Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Iron Avenue to the north line of Stapler Avenue; curbing, guttering, paving and grading of Northwood Lane with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Beechwood Road to the west line of Driftwood Road; curbing, guttering, paving and grading of Riverside Boulevard with concrete (Thirty-three (33) feet wide from back of curb to back of curb from the west line of Columbia Avenue to the east side of Kansas Avenue; curbing, guttering, paving and grading of Twelfth Street with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the north line of Pacific Avenue to the south line of Harsh Avenue, the same being an intervening connecting street; and providing for the payment of the cost thereof, and how the same shall be assessed and the manner of the payment of the cost thereon. I WHEREAS, by Resolution Numbers 2661, 2597, 2656, 2678, 2700, 2707, 2708, 2657, 2679, 2706, 2701, 2690 and 2682 duly adopted on October 2, 1962, March 13, 1962, September 25, 1962, November 27, 1962, March 26, 1963, April 9, 1963, February 5, 1963, December 4, 1962 by the Board of Commissioners of the City of Salina, Kansas, have declared that they deem it necessary to pave the Alley First East of Santa Fe Avenue with concrete (Ten (10) feet wide) from the south line of Mulberry Street to the north line of South Street; pave and grade the Alley First North of Ellsworth Avenue with concrete (Sixteen (16) feet wide) from the west line of Santa Fe Avenue west 175 feet; curb, gutter, pave and grade Antrim Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west line of Santa Fe Avenue to the east line of Eighth Street, the same being an intervening connecting street; curb, gutter, pave and grade Beechwood with concrete (Thirty-three (33) j feet wide from back of curb to back of curb) from the south line of Northwood to the south line of Greeley; curb, gutter, pave and grade Driftwood Road with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the north line of Northwood Lane to the north line of Greeley Avenue; curb, gutter, pave and grade Greeley Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Marymount Road to the west line of Beechwood Road; curb, gutter, pave and grade Greeley Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of cu )from the west line of Driftwood Road to the west line of Beechwood Road; curb, gutter, pave and grade Harsh Avenue with concrete (Thirty-three (33) feet wide from back of curb to back 11 of curb) from the west line of Tenth Street to the east line of Eleventh Street, the same being an intervening connecting street; curb, gutter, pave and grade Indiana Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Stack Avenue to the north side of Greeley, the same being an intervening connecting street; curb, gutter, pave and grade Indiana Avenue with concrete (Thirty-three) feet wide from back of curb to back of curb) from the south line of Iron Avenue to the north line of Stapler Avenue; curb, gutter, pave and grade Northwood Lane with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Beechwood Road to the west line of Driftwood Road; curb, gutter, pave and grade Riverside Boulevard with concrete (Thirty-three (33) feet wide from back of curb to back of curb from the west line of Columbia Avenue to the east side of Kansas Avenue; curb, gutter, pave and grade Twelfth Street with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the north line of Pacific Avenue to the south line of Harsh Avenue, the same being an intervening connecting street. j WHEREAS, each of the said Resolutions was published for six days in the Salina Journal, a daily newspaper, published in the said City, and being an official city paper, and the majority of the resident property owners owning a majority of the square feet of the lots or real estate liable to taxation for the cost of said improvements and did not within twenty days from the date of the last publication thereof file with the City Clerk a sufficient protest in writing against the making of said improvements, no protests of any kind having been filed, SO NOW, THEREFORE CONSOLIDATED-SALINA I � I BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: I I Section 1. That it is necessary and it is hereby ordered that the Alley First East of Santa Fe Avenue, from the south line of Mulberry Street to the north line of South j Street, an alley in the City of Salina, Kansas, be paved with concrete (Ten (10) feet wide) with excavation thereof, and graded to the established paving grades and paved between the i guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that the Alley First North i of Ellsworth Avenue, from the west line of Santa Fe Avenue west 175 feet, an alley in the I City of Salina, Kansas, be paved and graded with concrete (Sixteen (16) feet wide) with i I excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. i � I Section 3. That it is necessary and it is hereby ordered that Antrim Avenue from the I west line of Santa Fe Avenue to the east line of Eighth Street, a street in the City of Salina, Kansas, an intervening connecting street, be curbed, guttered and paved with concrete (Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 4. That it is necessary and it is hereby ordered that Beechwood, from the south line of Northwood to the south line of Greeley, a street in the City of Salina, Kansas, i be curbed, guttered and paved with concrete (Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 5. That it is necessary and it is hereby ordered that Driftwood Road, from the north line of Northwood Lane to the north line of Greeley Avenue, a street in the City of Salina, Kansas, be curbed, guttered and paved with concrete (Thirty-three (33) feet wide i from back of curb to back of curb) with excavation thereof, and graded to the established I paving grades and paved between the guttering lines thereof. Section 6. That it is necessary and it is hereby ordered that Greeley Avenue, from I j the east line of Marymount Road to the west line of Beechwood Road, a street in the City of Salina, Kansas, be curbed, guttered and paved with concrete (Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 7. That it is necessary and it is hereby ordered that Greeley Avenue, from I I the west line of Driftwood Road to the west line of Beechwood Road, a street in the City of Salina, Kansas, be curbed, guttered and paved with concrete (Thirty-three (33) feet wide I from back of curb to back of curb) with excavation thereof, and graded to the established paving grades and paved between the guttering lines thereof. Section 8. That it is necessary and it is hereby ordered that Harsh Avenue, from the west line of Tenth Street to the east line of Eleventh Street, an intervening connecting street in the City of Salina, Kansas, be curbed, guttered and paved with concrete (Thirty- three (33) feet wide from back of curb to back of curb) with excavation thereof, and graded I to the established paving grades and paved between the guttering lines thereof. J CONSOLIDATED-SALINA CONSOLIDATED-SALINA 1.111.. F of said streets with the kind of material named and specified in the proceeding section hereof, and for the excavation and grading necessary for the completion of said work, and after the receipt of such proposals, the Board of Commissioners may and are hereby authorize( and directed to let contracts for the improving of said streets with the materials selected by them to the lowest responsible bidder or bidders thereof, as determined by the Board of Commissioners, and for such excavation and grading. Said Board reserves the right to reject any or all bids. Section 16. That for the improving of the above mentioned street, such assessment shall be made for the full cost thereof according to law on all lots and pieces of land to the center of the block on either side of the streets to be improved according to the appraisers valuation thereof, without regard to the buildings or improvement thereon for the distance to be improved. Section 17. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appraisement, of all lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of the City of Salina, without regard to the buildings or improvements thereon and after making such appraisement shall return to the Board of Commissioners of said City and said Board of Commissioners shall designate a time and place for the hearing of any complaints that may be made as to the value of any lots and pieces of land appraised as aforesaid, of which due notice shall be given in the official city paper, at which hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in their opinion the same has been appraised too high or too low. Section 18. That for the purpose of paying the cost of the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds of the City of Salina, in an amount not to exceed the contract price for the work of such improvements and to run for a period of ten years and be payable in ten equal installments, together with interest not to exceed five per cent per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas, and for the purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improvements and the apportionment herein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with said improvements. Such assessments and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piecesor parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable to such work and assessments, together with the respective amounts due CONSOLIDATED -SALIVA 1 on each of said tracts, pieces of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five percent per annum on such amounts so certified which shall be collected as other taxes are collected; PROVIDED, that for the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets and alleys, and for the grading of said street where the same is provided for in this ordinance as well as where the improvement is through or adjacent to property of the City for which the City is liable, the assessment will be made against all taxable property of the City of Salina and paid by the City at Large. Section 19, That this ordinance shall take effect and be in full force and effect from and after its adoption and publication once in the official city paper.
