6715 Eminent Domain1 1 J (Published in the Salina Journal, , 1963) ORDINANCE NU11I3 R (t AN ORDINANCE CONDEMNING CERTAIN LAND AND EASETMENTS THEREIN WITHIN THE CITY OF S<`.LINA, KANSAS, FOR THE USE OF SAID CITY IN THF: WIDENING, EXTENSION, AND IMPRO'VETvENT CF CHIC STREET IN THE CITY OF S.=:LINA, KANSAS, SOUTH FROM THE CENTER LINE OF PACIFIC AVENUE APPROXIMATELY 3500 FEET TO 111 POINT WHERE SAID CHIC STREET INTERSECTS THE CHANNEL OF THE SMOKY HILL RIVI IL; AND FIXING THi: BENEFIT DISTRICT THEREFORE; AND PROVIDING FOR THE PAYMENT OF THE COSTS THEREOF. WHEREAS the governing body of the City of Salina, Kansas, did cri the 13th day of May, 1963, by Resolution No. 2714 find it necessary to appropriate certain private property located in the City of Salina, Kansas, for the use of said City in the widening, extension, and improvement of Ohio Street in the City of Salina, Kansas, south from the center line of Pacific Avenue approximately 3500 feet to a point where said Ohio Street intersects the channel of the Smoky Hill River and directed the City Engineer of the City of Salina, Kansas, to make a survey and description of the lands and easements therein so required; and, WHEREAS on the 20th day of May, 1963, a survey and description of the lands and easements in land so required was duly filed with the City Clerk. NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: Section 1. That the following -described land is hereby condemned and appropriated for the use of the City of Salina, Kansas, for the widening, extension, and improvement of Chio Street in the City of Salina, Kansas, south from the center line of Pacific .°avenue approximately 3500 feet to a point where said Ohio Street intersects the channel of the Smoky Hill river, to -wit: 1 1 TRACT NO. 1 A tract of land in the West half (VII) of the Southwest Quarter (SN4) of Section Seven (7), Township Fourteen (14) South, Range Two (2) Nest of the Sixth Principal Meridian, North of the Smoky Hill River, described as follows: Beginning at a point one - thousand Fifty-six (1056) feet south of the Northwest Corner of the Southwest Quarter (SI94) of said section; thence east forty (40) feet; thence south parallel to said section line a distance of ninety (90) feet, plus or minus, to the north side of the Smoky Hill River; thence west a distance of forty (40) feet, plus or minus to the west line of said section; thence north ninety (90) feet, plus or minus, to the point of beginning, containing 0.07 acres, more or less. TRACT NO. 2 A tract of land in the West Half (VII of the Southwest Quarter (SW -41) of Section Seven (7), Township Fourteen (14) South, Range Two (2) Nest of the Sixth Principal Meridian, described as follows: Beginning at a point seven -hundred twenty-six (726) feet south of the Northwest Corner of the Southwest Quarter (SIY4) of said section; thence east forty (40) feet; thence south and parallel to said section line a distance of three -hundred thirty (330) feet; thence west forty (40) feet to the west line of said section; thence north three -hundred and thirty (330) feet to the point of beginning, containing 0.30 acres, more or less. That the following -described easements in land are hereby condemned and appropriated for temporary construction easements and permanent easements for the use of the City of Salina, Kansas, for the widening, extension, and improvement of Ohio Street in the City of Salina, Kansas, south from the center line of Pacific Avenue approximately 3500 feet to a point where said Ohio Street intersects the channel of the Smoky Hill River, to -wit: 1 J 1 TRACT NO. 30 A strip of land forty (40) feet in width and three -hundred (300) feet in length which lies twenty (20) feet either side of a line that begins at a point on the west property line of North Ohio Street and three -hundred twenty-five (325) feet south of the south property line of North Street; thence in a westerly direction a distance of three -hundred (300) feet to the east bank of the Smoky Hill River, said tract containing 0.3 acres, more or less. TRACT NO. 31 A -strip of land thirty (30) feet in width and thirty (30) feet in length which begins thirty (30) feet south of the property line of North Street on the west property line of North Ohio Street; thence west thirty (30) feet; thence north thirty (30) feet; thence east thirty (30) feet; thence south thirty (30) feet to point of beginning, said tract containing 0.02 acres, more or less. TRACT NO. 32 A strip of land ten (10) feet in width and three -hundred (300) feet in'length which lies five (5) feet either side of a line that begins at a point on the west property line of North Ohio Street and three -hundred twenty-five (325) feet south of the south property line of North Street; thence in a westerly direc- tion a distance of three -hundred (300) feet to the east bank of the Smoky Hill River, said tract containing 0.08 acres, more or less. 1 Section 3. That it is hereby found that the following - described real estate within the city limits of the City of Salina, Kansas, will be specially benefitted by reason of the acquisition of said land and easements therein, and the same shall be known as the "benefit district", to -wit: C u� 1 1 BENEFI^1 DISTRICT Beginning at a point two -hundred forty (240) feet east of the center line of Ohio Street and in the center of the Smoky Hill River, City of Salina, Saline County, I{ansas; thence north on a line two -hundred forty (240) feet east and parallel to the center line of Ohio Street to the Southeast Corner of Lot Fourteen (14), Cloverdale Annex; thence continuing north along the east line of Lots Fourteen (14), Fifteen (15), and Sixteen (16) of said Cloverdale Annex to the south line of Prospect Avenue; thence east along the south line of Prospect Avenue thirty-one (31) feet; thence north across Prospect Avenue and along the east line of Lots Twenty (20), Twenty-one (21), and Twenty-two (22), Block One (1), Cloverdale Addition; thence northwest to a point on the south right-of-way line of Chicago, Rock Island, and Pacific Railroad which'point being two -hundred (200) feet east of the center line of Ohio Street; thence north on a line two-hundrei (2,00) feet east and parallel to the center line of Ohio Street to the north line of Pacific Street; thence west along the north line of Pacific Street to a point two -hundred (200) feet west of the center line of Ohio Street; thence south on a line two-hundre4 (200) feet west and parallel to the center line of Ohio Street to the south line of the Chicago,Rock Island and Pacific Railroad right-of-way to the north line of Lot One (1), East Garden Addition, City of Salina, Kansas; thence west along the north line of said Lot One (1), to the Northeast Corner of said Lot One (1); thence south along the west line of Lots One (1), Two (2), Three (3), Four (4), Five (5), Six (6), and Seven'(7), East Garden Addition; thence northeast along the south line of Lot Seven (7), to a point two -hundred forty (240) feet west of the center line of Ohio Street; thence south along a line two -hundred forty (240) feet west and parallel to the center line of Ohio Street to the center line of the Smoky Hill River; thence south- east along the center line of the Smoky Hill River to the point o: beginning. 11 1 Li Section 4. That L. O. Bengtson, City Attorney, is hereby ordered and directed to forthwith prepare and present in the name of the Board of Commissioners of the City of Salina, Kansas, a written application to the Judges of the District Court of Saline County, Kansas, praying for an order of appointment of commissioners to make appraisement and assessment of damages arising from the appropriation of said real estate and easements therein and to do and perform all things in and about the procurring and recording of said order of appraisement required by law. Section 5. That for the payment of the costs thereof the City of Salina, Kansas, may issue improvement bonds of the City of Salina, Kansas, in an amount not to exceed the total cost of acquiring said land herein condemned, except as herein provided, to be payable in one installment to bear interest not to exceed 5 per cent per annum from the date of such bonds, and for the purpose of paying such bonds and interest as they severally mature,the Board of Commissioners shall: (A) Apportion and assess the lots and pieces of ground within the benefit district, special assessments covering such portions of the cost of such land so acquired as shall be chargeable to said benefit district, such assessment and apportionment ordinance shall contain the total amount of tax appropriated to such tract, piece, or parcel of land within such taxing districts, and thereafter the City Clerk shall, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such public improvements, together with the respective -numbered amounts due on each of said tracts, pieces, or parcels of land which shall be collected as other taxes are collected. (B) Levy a tax upon all real and personal property within the City of Salina, Kansas, in an amount sufficient to pay the portion of the costs of such land so acquired as shall be payable to the City at large, and pending the issue of such bonds temporary notes may be issued according to law to pay the costs of acquiring such land. Section 6. This ordinance shall take effect and be in force from and after its passage and publication in the official City newspaper. Introduced this 'r day of May, 1963.
