AN ORDINANCE ratifying and confirming a contract with the 0. M. Wilbur Construction Company
for the construction of certain sidewalks in the City of Salina, Kansas, heretofore
designated as Engineering Job 437, and providing for the issuance of Temporary Notes to
pay the cost thereof, pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the
0. M. Wilbur Construction Company, hereinafter referred to as the "Contractor" as submitted
to the Board of Commissioners on April 16, 1963, which is hereby found to be the lowest and
1 best bid for such work, and the contract awarded by the Board of Commissioners of said City
to said contractor and signed on behalf of the City by its Mayor on April 23, 1963, for the
construction of certain public improvements in the City of Salina, Kansas, to -wit:
A property line sidewalk 4 feet wide, adjacent to Lots 6, 7, 8 and 9,
West Evergreen Park Addition, and Lot 14, Block 2 Replat of Blocks 1
and 2, Evergreen Park Addition on Cloud Street from the east line of
Pershing Street to the west line of Eleventh Street.
A property line sidewalk, 5 feet wide adjacent to Lot 6, Block 6,
Fairview Addition to the City of Salina, Saline County, Kansas.
A property line sidewalk, 5 feet wide adjacent to Lot 16, Block 9,
Bachtold Addition to the City of Salina, Saline County, Kansas.
A property line sidewalk, 5 feet wide adjacent to Lot 18, Block 9,
Bachtold Addition to the City of Salina, Saline County, Kansas.
A property line sidewalk, 5 feet wide adjacent to Lot 20, B7.ock 9,
Bachtold Addition to the City of Salina, Saline County, Kansas.
A property line sidewalk, 5 feet wide adjacent to Lot 24, Block 9,
Bachtold Addition to the City of Salina, Saline County, Kansas.
A property line sidewalk 4 feet wide, adjacent to Lots 4, 5, 6, 7, 8,
9, 10 and 11, Block 3 all in Ingermanson Heights, City of Salina,
Saline County, Kansas on the north side of Talley Drive from the east
line of Ingman Road to the west line of Page Avenue.
A property line sidewalk 4 feet wide, adjacent to Lots 1, 3, 5, 13,
15 and 17, Block 6 Southern View Addition, City of Salina, Saline
County, Kansas, on the south side of Ralph Avenue from Roach Street
to Norton Street.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made a part of this ordinance, be and the same is
hereby ratified and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimates of the City Engineer on file in the Office
of the City Clerk, which estimate is hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the Office of
the City Clerk and in accordance with the proposal of said contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk
be issued from time to time as the work progresses in the manner and form as required by
law, the total amount thereof not to exceed the amount of $3,338.50, for such work, such
notes to bear interest at not to exceed 5 per cent per annum and to mature not later than
December 1, 1964, and to be issued in such amounts and at such times as may the money for

the payment of the cost of such work be required, such notes to be issued to said contractor
and to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in
lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from and after
its adoption and publication once in the official city paper.
