6702 Levy AssessmentsCONSOLIDATED -SALIVA ORDINANCE NUMBER ( ?� i (Published in The Salina Journal c��c�= Cn , 1963) AN ORDINANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of acquisition of land for the use of the City of Salina, Kansas, for the opening and extending of White Avenue in the City of Salina, Kansas from the west line of Broadway Boulevard to a point approximately eight hundred fifty feet west thereof, the same being more particularly described herein, and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for the cost of acquiring by condemnation proceedings certain real estate for the use of the City of Salina, Kansas, for the opening and extending of White Avenue in the City of Salina, Kansas from the west line of Broadway Boulevard to a point approximately eight hundred fifty feet west thereof, said property being more particularly described as follows; to -wit: A tract of land in the Northwest Quarter (NW4) of Section Fourteen (14) Township Fourteen (14) South, Range Three (3) West of the Sixth Principal Meridian, more particularly described as follows: Beginning at a point on the west line of Broadway Boulevard which is j also the U. S. "81" By -Pass, and 172.5 feet north of the south line of said quarter section; thence west and parallel to said quarter section line 850.5 feet more or less to the center of old channel of Dry Creek; thence southerly along the center of said creek 60 feet south; thence east on a line 112.5 feet north of the said quarter section line to the west line of Broadway Boulevard; thence north on the west line of Broadway Boulevard 60 feet to the point of beginning. as authorized by the provision of Ordinance Number 6654 and Resolution Number 2643, according to the appraised value of such lots and pieces of ground without regard to the buildings or improvements thereon, special assessments covering the cost of the acquisition i of such land, said special assessments being based on the special valuation and appraisement made by three disinterested Commissioners appointed by the Judge of the District Court of Saline County, Kansas, in Case Number 23,925 in the District Court of Saline County, Kansas, which said appraisal is hereby referred to and made a part of this ordinance, and the several amounts levied, and apportioned against the lots and pieces of ground in said area found by the said Commissioners to be benefited by the acquisition of the land aforesaid for the use stated, hereby found and determined to be as set forth in the following section i of this ordinance. Section 2. That for the purpose of the payment of the cost of acquisition of the City at Large - - - - - - - - - - - - - - - - - - - - 833.65 above described land for the use of the City of Salina, Kansas, for the opening and extending of White Avenue in the City of Salina, Kansas from the west line of Broadway Boulevard to a point approximately eight hundred fifty feet west thereof, amounts levied, apportioned and assessed against the lots and pieces of ground which the said Commissioners i have determined to be benefited by the said street development are found and determined to be as follows, to -wit: City at Large - - - - - - - - - - - - - - - - - - - - 833.65 CONSOLIDATED -SALIVA Private Property within the benefit district as follows: 1. A tract of land located in the West Half of Section Fourteen (14) ,` Township Fourteen (14) , Range Three (3) West of the Sixth Principal Meridian, more particularly described as follows: Beginning at a point on the West line of Broadway Boulevard which is also U. S. Highway 81 By -Pass, and 167.5' South of the South line of the Northwest Quarter of said Section 14; thence due North along said West line of Broadway Boulevard 300'; thence due West and parallel with said quarter section line to the center line of Dry Creek; thence due South 300' to a point approximately 167.5' south of the south line of the Northwest Quarter of Section 14; thence due East and parallel j with 'said section line to the point of beginning. Said amounts levied, apportioned, and assessed as aforesaid shall be due and collectible in one equal installment, becoming due with taxes levied for the year 1963 all to be collected with interest as in this ordinance provided, provided, however, that the owner of any piece or parcel of property liable for any such assessment may redeem his property from any such assessment liability by paying into the City Treasury the entire amount chargeable against the same as in this ordinance designated as any time within Thirty (30) days from the publication of this ordinance, and before the issuance of the bonds of said city in payment of the cost of said improvements, and his property so paid on shall not thereafter be liable for any further assessment for the cost of said improve- ments nor for any part of said bonds. Section 4, There is hereby levied and assessed further against said lots and pieces of ground as described in this ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, such rate to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance, CONSOLIDATED-SALINA from the date of the bonds which may be issued at the end of thirty days as specified in the preceding section hereof as by law provided, to the time of collection of the last install- ment as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinance and the fixing of the interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk of said city to annually at the same time other taxes are certified, to certify to the County Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such work and improvements, except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installment of such special assessment together with the interest at the rate to be fixed and provided for in this ordinance being the rate borne by the bonds to be issued on all unpaid balances of such assessments and such amounts so certified as herein provided shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected as all other taxes are collected. Section 5. That this ordinance shall be in effect and force from and after its adoption and publication once in the official city paper.
