ORDINANCE NUMBER 05-10272
AN ORDINANCE LEVYING SPECIAL ASSESSMENTS ON LOTS, PIECES AND
PARCELS OF GROUND IN THE CITY OF SALINA, KANSAS FOR THE PURPOSE OF
PAYING A PORTION OF THE COST OF CERTAIN IMPROVEMENTS IN THE CITY.
WHEREAS, the Governing Body of the city of Salina, Kansas (the "City") has authorized
the following improvements (collectively, the "Improvements") in the City:

STREET, DRAINAGE AND SIDEWALK IMPROVEMENTS
Curbing, guttering, paving, grading, and drainage of Cedar Ridge Drive and sidewalk improvements
from Columbine Circle southeast to the intersection of Cloud Street.

CEDAR RIDGE ADDITION, PHASE II
STREET, DRAINAGE AND UTILITY IMPROVEMENTS
Curbing, guttering, paving, grading, and drainage of approximately 1350 lineal feet of Pinecrest
Circle, approximately 175 lineal feet of Timber Ridge Drive and approximately 300 lineal feet of
Edgewood Drive.
Installation of sanitary sewer and watermains.

STREET, DRAINAGE AND UTILITY IMPROVEMENTS
Curbing, guttering, paving, grading, drainage, and street lighting of Overlook Drive from the south
property line of Lot 8, Block 4 to the cul-de-sac at the north end of Block 2; all of Stoneridge Lane;
all of Stoneridge Loop; all of Springer Court; all of Marymount Road Loop; and RiverRun Parkway
from Marymount Road to Overlook Drive.
Installation of drainage crossing under RiverRun Parkway and the Drainage Pond Restoration.
Installation of sanitary sewer and water mains.

HOLLY LANE, PHASE I
STREET AND DRAINAGE IMPROVEMENTS
The curb, guttering, paving, grading, and drainage of Holly Lane from Crawford Street to the
southern boundary of the benefit district.
WHEREAS, the Governing Body has after due notice, met and determined the amount of
such special assessments; and
WHEREAS, the Governing Body held a public hearing to consider each of the proposed
assessments.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. Special assessments to pay the cost of the Project are hereby levied against
several lots, pieces and parcels of land liable for special assessments for said Improvements, as
follows:

Section 2. Said amounts so levied, apportioned and assessed as aforesaid will be due and
collectible in fifteen equal installments, the first becoming due with the taxes levied for the year
2005, and one of said installments falling due each and every year thereafter until all are paid and
all to be collected with interest as in this ordinance provided; HOWEVER, that the owner of any
piece or parcel of property liable for any such assessments may redeem his property, in whole or in
part, from such liability by paying to the City Treasurer the entire amount, or a portion thereof,
chargeable against the same, as in this ordinance provided, at any time within thirty days after the
first publication of this ordinance and before the issuance of bonds of said City in payment of the
balance of the cost of said improvements, and to the extent of any such payment, the property so
paid on shall not thereafter be liable for any further assessments for the cost of said improvements,
nor for any part of said bonds.
Section 3. There is hereby levied further and assessed against such lots and pieces of
ground described in this ordinance, interest at such rate per annum as shall be borne by bonds
hereinafter to be issued for the payment of the remaining unpaid cost of such improvements to be
hereafter determined and fixed by ordinance. Interest on the assessments shall begin to accrue in
accordance with Section 2 above.
Section 4. This Ordinance shall take effect from and after its passage and publication in the
official City newspaper.
