04-10194 Zone Long McArthur Add(Published in the Salina Journal on April , 2004) ORDINANCE NUMBER 04-10194 AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NUMBER 8526, THE SAME BEING CHAPTER 42 OF THE SALINA CODE, AND THE ZONING DISTRICT MAP THEREIN AND THEREBY ADOPTED AND PROVIDING FOR THE REZONING OF CERTAIN PROPERTY WITHIN THE CITY AND PRESCRIBING THE PROPER USES THEREOF. WHEREAS, all conditions precedent for the amendment of the Zoning District Map, the rezoning of certain property therein, hereinafter described has been timely complied with, SO NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: Section 1. AMENDMENT. DISTRICT "PC -7". PLANNED HIGHWAY COMMERCIAL DISTRICT. That the Zoning District Map of the City of Salina, Kansas, duly adopted and published as a part of Ordinance Number 8526, the same being Chapter 42 of the Salina Code, be and it is hereby amended so that the following described property be rezoned as follows, to - wit: A parcel of land located in the Southeast Quarter of Section 2, Township 15 South, Range 3 West of the 6th Principal Meridian in Saline County, Kansas, together with a portion of Lot 1, Block 1, Long -McArthur Addition, more particularly described as follows: Commencing at the Southeast corner of said Southeast Quarter, thence on an assumed bearing of N 89°59'54" W along the South line of said Southeast Quarter a distance of 125.79 feet; thence N 00000'00" E a distance of 55.08 feet to a point on the North right-of-way line of Water Well Road, said point is also the POINT OF BEGINNING of the parcel to be described; — thence S 89°56'37" W along said North right-of-way line a distance of 506.76 feet; — thence S 01°43'54" W along said North right-of-way line a distance of 4.44 feet; — thence S 89056'13" W along said North right-of-way line a distance of 27.31 feet; — thence N 46°39'56" W along said North right-of-way line a distance of 59.00 feet; — thence N 86°22'47" W along said North right-of-way line a distance of 160.31 feet to a point on the East right-of-way line of Interstate 135; — thence N 05018'39" W along said East right-of-way line a distance of 526.28 feet; — thence N 90°00'00" E a distance of 331.41 feet to a point on the East line of Lot 1, Block 1, of said Long -McArthur Addition; — thence S 00'14'04"W along said East line a distance of 100.00 feet to the Southwest comer of Lot 2, Block 1, of said Long -McArthur Addition; . — thence N 90°00'00" E along the South line of said Lot 2 a distance of 522.72 feet to the Southeast comer of said Lot 2, said point being on the West right-of-way line of Ninth Street; — thence S 00°17'30" W along said West right-of-way line a distance of 424.07 feet; — thence S 55°15'26" W along said West right-of-way line a distance of 80.01 feet to the POINT OF BEGINNING; Said parcel contains 9.42 acres, more or less, and is subject to easements, reservations, and restrictions of record shall become a part of District "PC -711. PLANNED HIGHWAY COMMERCIAL. Section 2. CONDITIONS OF APPROVAL. That the use of said described property shall be subject to all the conditions, restrictions and limitations as made and provided for in Ordinance Number 8526, the same being Chapter 42 of the Salina Code with reference to the "C-7" HIGHWAY COMMERCIAL DISTRICT regulations and the regulations of the "CO" CORRIDOR OVERLAY DISTRICT. Development of the property shall be subject to the plans on file with the City Planning L' 1 Commission and/or City Clerk and the following conditions, to -wit: Uses on this 9.42 acre site shall be limited to those permitted and any subsequently approved conditional uses listed in the CO district regulations and shall be subject to the bulk and use limitations of the CO and C-7 district. 2. Signage shall comply with the C-7 district size limitations and the CO district height limitations except that interstate oriented signs may exceed 30 feet in height. A final site development plan for all building sites be submitted to and approved by the Planning Commission prior to issuance of any building permits. 4. A final site plan shall be approved prior to final zoning approval for the site. Section 3. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper.
