6699 Tree Trimming LicensesCONSOLIDATED-SALIMA I (illublished in the Salina Journal, 3kin-ne-h 1963) ORDIN,:�.NCE NUMBER L ',N ORDINANCE RELATING TO THE T11I11,1MING AND TREATING OF TREES AND SHRUBS IN THE CITY OF SiiLINii, KANSAS; PRESCRIBING RULES AND REGULATIONS; PROVIDING FOR TILE LICENSING OF PERSCITS, PtiRTNERSHIPS, ASSOCIATIONS, OR CORPORATIONS ENGAGED IN TRIMMING AND TREATING OF TREES A14D SHRUBS; DEFINI1,TL� AN PAN G CERTIUDLIC OFFENSES D PROVIDING PENALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: Section 1. Definitions. The following terms are for the purpose of this ordinance defined as follows: (a) "Person" means any individual, partnership, association of persons or corporation who engage in the business or trade of trimming trees, shrubs, or treating trees or shrubs for the control of 1,)osts. (b) "Pest" means any fungus, insect, or rodent which by its presence in or on a tree or shrub, may damage or destroy said tree or shrub. Section 2. Licensing. No person, partnership, association, or corporation shall engage in the business or trade of trimming trees or shrubs or treating trees or shrubs for the control of posts within the city without first having obtained a license therefor; said license shall be issued by the City Clerk only aft( , -tngoverning body, application therefor has been approved by the o.nd shall exuire on the 31st day of December of the year for whicl the same is issued. Section 3. Application. A written application for the trimming of trees or shrubs or treating of trees or shrubs shall be filed with the City Clerk. Said application shall meet the following requirements: (a) Name, business address, and phone number of applicant. (b) Description of the e, -.tent of work intended to be licensed. (c) Compliance with the laws of the State of Kansas relating to "Post Control Operators", where applicable. (d) Filing of required bond and certificate of liability insurance. (c) Payment of the required license fee. Section 4. License Fee. The City Clerk shall collect the following license fees from applicants: , -- %-Q (a) For the trimming of trees and shrubs ..... Ij __ C V (b) For the treating of trees and shrubs ..... $ (c) For the tripming and treating of trees and shrubs .... $ CONSOLIDATED-SALINA Ll 1 Section 5. Bonds and Liability Insurance. Each person who makes application for a license or renewal thereof shall furnish an acceptable surety bond and certificate of liability insurance covering the work in which they are engaged, and upon the terms and conditions hereinafter set out. Said bond shall be executed by the applicant as principal and by a solvent corporation authorized to do business within the State of Kansas as surety in the sum of Five -thousand Dollars ($5,000.00). Said bond shall be for the term of not to exceed one year and shall extend to cover the licensing period; shall be to the City of Salina, Kansas, for use and benefit of such persons as may suffer by breach thereof; and shall be conditioned upon compliance by the principal, his agents, servants, employees, with the provisions of this ordinance. Said certificate of insurance shall show that the applicant is covered by an effective liability insurance policy issued by a solvent corporation authorized to do business within the State of Kansas and shall be issued with minimum limits of $25,000.00-$50,000.00 for bodily injury and $10,000.00 for property damage. Said bond and insurance policy shall riot be cancelled or terminated until at least twenty (20) days after a notice of cancellation of said bond or insurance policy is receiv- ed by the City Clerk. Section 6. Refusal to Grant or Revocation of License. The governing body may at any time revoke a license or decline to grant a license under the following circumstances: (a) The licensee doing business as a Pest Control Operator under the laws of the State of Kansas, has had his Kansas license revoked; provided, said license, whore applicable, shall be revoked only as to the treating of trees and shrubs. (b) Said licensee shall fail to furnish an acceptable surety bond or an acceptable written certificate of public liability insurance within twenty (20) days from the date notice is received from the City of Salina, Kansas, that the surety bond or insurance policy previously furnished by said licensee is to be cancelled or terminated. (c) The licensee or any employee, solicitor, agent, or representative of said licensee has made any material misrepresentations for the purpose of defrauding any member of the public. (d) The licensee or any employee, solicitor, agent, or representative of said licensee has used any method or material which is not suitable for the purpose for which it is employed or provided, or has used any method or material without respect to public health, safety, and welfare in the treating of trees and shrubs. Revocation of license shall be effected by giving, notice in writing posted not less than fifteen (15) days prior to the date set for revocation of said license and mailing said notice to the licensee at his address as shown by the records of the city. Section 7. License not Transferable. "IX license granted hereunder shall not be transferable. Vv hen there is a change in the business status of the licensee, the successor shall have sixty (60) days within which to obtain a license as provided by the terms and conditions of this ordinance; Provided, that in the event of the death of an individual, his heirs or reprosenta- tives shall be allowed sixty (60) days within which to obtain a license and such additional times as may be granted by the city for cause within its discretion.
