ORDINANCE NO.
AN ORDINANCE iMAKING IT UNLAWFUL FOR A 2E1ZSON OR P:I1JSONS TO
TELEPHONE ANOTHER PERSON REPEATEDLY FOR THE PURPOSE OF H,',RASS MENT,
UNLESS A LEGITI1MATE BUSINESS CALL, OR TO USE A TELEPHONE IN ;.
VULGAR, INDECENT, OBSCENE, OR IMMORAL iMANNER, PROVIDING PENALTIES
FOR VIOLATION OF SAID ORDINANCE.
BE IT ORDAINED BY TIIE GOVERNING BODY OF THE CITY OF SALINA,
KANSAS:
23-708. HARASSING OR INDECENT TELEPHONE CALLS
(a) It shall be unlawful for any person or persons to
telephone any other person repeatedly or cause any person to
be telephoned repeatedly for the purpose of harassing-,
molesting, or disturbing the peace of such other person or
his family, whether or not conversation ensues, except for
telephone calls made for legitimate business purposes.
(b) It shall be unlawful for any person or porno_:, tc
u - czn•;, vul ^.; _:: -,_- obscene or immoral language over
any telephone, or to solicit another to commit an immoral
act, or to threaten another with bodily harry or injury.
(c) It shall be unlawful for any person to refuse to
reveal their true identity during the making of any of the
above described telephone calls, if so requested by the
other party.
(d) Every person convicted of one of the offenses
described in subsection (a), (b), or (c) of this section
shall be punished by not less than ten days nor more than
ninety days imprisonment, or by a fine of not less than
Twenty-five Dollars nor more than Five -hundred Dollars, or
by both such fine and imprisonment, and on a second or
subsequent conviction shall be punished by imprisonment for
not less than thirty days nor more than six months, or by a
fine of not less than Fifty Dollars nor more than Five -
hundred Dollars or by both such fine and imprisonment, and
each such violation shall constitute a separate offense.
This ordinance shall take effect and be in force from and
after publication in the official City newspaper.
