CONSOLIDATED-SALINA
ORDINANCE NUMBER

AN ORDINANCE ratifying and confirming a contract with Brown and Brown, Inc., for the
construction of certain improvements on certain streets in the City of Salina, Kansas, and
providing for the issuance of temporary notes to pay the cost thereof pending the issuance
and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salinaa Kansas:
Section 1. That the acceptance by the City of Salina, of the proposal of Brown and

Brown, Inc., hereinafter referred to as the "Contractor" as submitted to the Board of
Commissioners on February 19, 1963, which is hereby found to be the lowest and best bid for
such work, and the contract awarded by the Board of Commissioners of the City of Salina to
said contractor and signed on behalf of the City by its Mayor on February 26, 1963, for the
construction of certain public improvements in the City of Salina, Kansas, to -wit:
1. The curbing, guttering and paving of:
(a) Otto Avenue, from the east line of Haskett Avenue to the west
line of Broadway Boulevard.
(b) Venus Avenue, from the east line of Neptune Avenue to a
point 360 feet east of the east line of Hageman Avenue.
(c) Jupiter Avenue, from the east line of Neptune Avenue to the
west line of Hageman Avenue.
(d) Mercury Avenue, from the east line of Hageman Avenue to a
point 345 feet east.
(e) Mars Avenue, from the south line of Otto Avenue to a point
395 feet south.
(f) Neptune Avenue, from the south line of Otto Avenue to a
point 565 feet south.
(g) Hageman Avenue, from a point 140 feet north of the north
line of Otto Avenue to the south line of Jupiter Avenue.
(h) Tulane Avenue, from a point 140 feet north of the north
line of Otto Avenue to a point 130 feet south of the south
line of Otto Avenue.
2. Water main to be installed in all the above described streets with a
1 inch copper service provided at each lot.
3. The Sanitary Sewer to serve all lots and parcels within the benefit
district.
4. Sidewalks at all intersections and corner lots in each block of
benefit district.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of said improvements

as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk,

which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the Office of
the City Clerk and in accordance with the proposal of said contractor and under the terms
of said contract, all of which are hereby referred to and made apart of this P t s ordinance

Section 3.
That temporary notes signed by the Mayor and attest by the City Clerk be
issued from time
to time as the work progresses in the manner and form as required by law,
the total amount
thereof not to exceed the amount of $285,673.70? for
such work, such notes j
to bear interest
not to exceed 5 per cent per annum and to mature not
later than December 1 a
1964, and to be
issued in such amounts and at such times as money for
the payment of the
cost of such notes being issued to said contractor and to be redeemed
and cancelled at the

time that permament bonds are issued in lieu thereof.
Section 4.
That this ordinance shall take effect and be in full
force from and after
its adoption and
publication once in the official city paper.
