6672 Flood Control EasementCONSOLIDATED-SALINA 1 1 ORDINANCE NO. v � 7 �­z_ (Published in The Salina Journal ZLC_-_tJL1!1 , 1962) AN ORDINANCE providing for the abandonment and vacation of a certain tract of land heretofore acquired and appropriated for use in the Salina, Kansas, Flood Control System. WHEREAS, the City of Salina acquired and appropriated a perpetual easement over and through all of that part of the Northwest Quarter (NWk) of Section Twenty-three (23), Township Fifteen (15) South, Range Three (3) West of the 6th P. M. in Saline County, Kansas, lying South and East of the new channel of Dry Creek; and, WHEREAS, subject, only, to the right hereinafter reserved, no public purpose or need exists requiring that said perpetual easement be retained. THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: SECTION 1: That the perpetual easement to that part of the North- west Quarter (NWk) of Section Twenty-three (23), Township Fifteen (15) South, Range Three (3) West of the 6th P. M. in Saline County, Kansas, lying South and East of the new channel of Dry Creek, be and it is hereby abandoned and vacated; provided, however, that the City of Salina, Kansas, hereby reserves the right of ingress and egress over an area South and East of the said new channel as may be necessary for its use in the maintenance and repair of the said new channel and other components of the Flood Protection Works of the said city. SECTION 2: That the rights in land hereby vacated and abandoned, subject to the reservation, aforesaid, shall revert to the Northwest Quarter (NWk) of said Section Twenty-three (23) from which it was carved. SECTION -3: That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city paper.
