6663 GO Bonds P-1911. CONSOLIDATED -SALIVA U ORDINANCE NUMBER_' (Published in The Salina Journal ` , 1962) AN ORDINANCE AUTHORIZING AND PROVIDING FOR THE ISSUANCE OF Internal Improvement Bonds of the City of Salina, Kansas, all in the sum of $456,283.76, to pay the cost of improving certain streets in said City to be designated as Series Number P-191. WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements in the City of Salina, Kansas, to -wit: This improvement consists of a 6" reinforced concrete pavement with incidental work thereto, to service all lots and parcels of land included within the boundaries of the benefit district; a 4" concrete sidewalk, water service, and an 8" sanitary sewer to serve all the lots in Shalimar Plaza Addition to the City of Salina, Kansas: Shalimar Drive: Grading, paving and curbing 33' back to back from the east line of Ohio Street to the north line of Wayne Avenue. Albert Avenue: Grading, paving and curbing 33' back to back from the east line of Ohio Street to the eastline of Mission Road. Glendale Road: Grading, paving and curbing 33' back to back from the south line of Albert Avenue to the north line of Corsaut Court. Mission Road: Grading, paving and curbing 33' back to back from the south line of Albert Avenue to the north line of Sarah Lane. Lambertson Lane: Grading, paving and curbing 33' back to back from the north line of Sarah Lane to the west lineof Mission Road. Sarah Lane: Grading, paving and curbing 33' back to back from the east line of Shalimar Drive to the east line of Lot 10, Block 14 Shalimar Plaza Addition. Corsaut Court• Grading, paving and curbing 33' back to back from Lot 12, Block 10, Shalimar Plaza Addition to the west line of Mission Road. as provided for by Resolution Numbers 2315, 2318 and 2321. This improvement consists of a 6" reinforced concrete pavement with incidental work thereto, to service all lots and parcels of land included within the boundaries of the benefit district, a 4" concrete sidewalk and an 8" sanitary sewer to service all the lots in Rolling Hills Addition to the City of Salina, Kansas. Marymount Road: paving, grading and curbing 41' back to back of curb from the south line of Ruskin Road, to the south line of Crawford Ave. Crawford Avenue: paving, grading and curbing 41' back to back of curb from the west line of Marymount Road to the west line of Rolling Hills Addition. Starlight Drive: paving, grading and curbing 33' back to back of curb from the north line of Crawford Avenue to the west line of Marymount Road. Aspen Road: paving, grading and curbing 33' back to back of curb from the east line of Starlight Drive to the north line of Crawford Avenue. Ridglea Drive: paving, grading and curbing 33' back to back of curb from the west line of Rolling Hills Addition to the west line of Briarcliff Road. Briarcliff Road: paving, grading and curbing 33' back to back of curb from the north line of Crawford Avenue to the south line of Starlight Drive. Claremont Drive: paving, grading and curbing 33' back to back of curb from the north line of Starlight Drive to north line of Rolling Hills Addition. as provided for by Resolution Numbers 22871, 2313 and 2314. CONSOLIDATED-SALINA _J 1 WHEREAS, the total cost of said improvements has been ascertained and the portion thereof in the amount of $"248.01 to be paid by general taxes to be levied upon all taxable property within said City for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets, where the same is through or adjacent to property of the City for which the City is liable, for which bonds are to be issued; and WHEREAS, the total cost of said curbing, guttering, paving and grading of said streets, which are to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering, paving and grading in said streets have been ascertained and has been hereby found and determined to be the sum of $407_,035.,,75 which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefore according to law provided for in the Ordinances of the City of Salina, Kansas, relating thereto, duly passed and approved of which the property owners are liable therefor have not paid any part thereof, leaving the amount of $407,035.75 for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $456,283.76 are to be issued to pay the actual cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby adopted as a part of this ordinance and that for the purpose of providing funds to pay the cost of improvements hereinabove referred to and described in the ordinances and resolutions of said City and hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $456,283.76 which shall consists of 456 bonds numbered 1 to 456 inclusive all dated November 1, 1962 and bearing interest as follows: Bonds 1 to 138, inclusive, shall bear interest at the rate of two and one half (22) per cent per annum, bonds 139 to 322, inclusive, shall bear interest at the rate of two and three quarters (2 3/4)% per cent per annum, bonds 323 to 368, inclusive, shall bear interest at the rate of two and seven eighths ( 2 7/8%) per cent per annum and bonds numbered 369 to 456 inclusive, shall bear interest at the rate of three (3%) PER cent per annum, from and after said date until the respective maturities of said bonds, payable semiannually on May 1, and November 1, in each year, said interest to be evidenced by interest coupons as herein provided for and said bonds shall become due as follows: Bonds Numbered 1 to 12 for $1,000.00 each except Number 1 is for $1,283.76 due May 1, 1963. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the City shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signatures of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered in the Office of the City Clerk and in the Office of the Auditor of State as required by law. Section 3. Said bonds shall be designated as Series P-191 and shall be in the form and shall contain recitals substantially as follows, to -wit: R CONSOLIDATED -SALIVA 1 1 UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND No. Series P-191 $ KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of dollars in lawful money of the United States of America, on the first day of , 19 with interest thereon from the date hereof at the rate of per cent per annum, payable semiannually on May 1, and November 1, in each year, on presentation and surrender of the interest coupons hereto affixed as said coupons become severally due, both principal of and interest on this bond being payable at the Office of the State Treasurer of the Slate of Kansas, in the City of Topeka, Kansas, and said City of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 456 bonds of like date and tenor, excepting denomination, interest rate and maturity, aggregating the principal sum of $456,283.76 issued by the City of Salina. Kansas for the purpose of paying the cost of constructing, -ffigt ,improvements in said City by the authority of and in full compliance with the provisons, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-127,3$:cb?=..Gi_T General Statutes of Kansas, 1949, and amendments thereto,, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation. IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City Clerk and the coupons hereto attached to be signed with the facsimile signatures of said officers and this bond to be dated the first day of November, 1962. The Mayor and City Clerk are hereby authorized and directed to prepare and execute the bonds hereinbefore described and to advertise and sell the same in the manner provided by law, and when duly executed and registered to deliver said bonds to the purchaser or purchasers thereof. Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall be and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually make provisions for the payment of the principal and interest on said bonds as they severally become due by levying taxes and assessments upon the property liable therefor as provided for by law. Section 6. This ordinance shall take effect and be in force from and after its adoption and publication once in the official city paper.
