AN ORDINANCE providing for the paving and grading of Claflin Avenue with concrete (Twenty-
eight (28) feet wide from toe of gutter to toe of gutter) from the east line of Eleventh
Street to the west line of Ninth Street, the same being an intervening connecting street;
paving and grading of Claflin Avenue with concrete (Twenty-eight (28) feet wide from toe of
gutter to toe of gutter) from the east line of Rush Street to the west line of Pershing
Street, the same being an intervening connecting street; curbing, guttering, paving and
grading of Connecticut Avenue with concrete (Thirty-three (33) feet wide from back of curb
to back of curb) from the north line of Iron Avenue to the south line of Johnstown Avenue;
curbing, guttering, paving and grading of Chicago Street with concrete (Thirty-three (33)
feet wide from back of curb to back of curb) from the south line of Walnut Street to the
south line of Spruce Street; curbing, and guttering on the south side and the paving of

bank of the Smoky Hill River; paving and grading of Johnstown Avenue with concrete (Twenty-

Avenue to the east line of Delaware Avenue, the same being an intervening connecting street;
paving and grading of Johnstown Avenue with concrete (Twenty-eight (28) feet wide from toe

Connecticut Avenue, the same being an intervening connecting street; paving and grading of

line of Indiana Avenue, the same being an intervening connecting street; paving and grading

curb) from the north line of Lincoln Avenue to the south line of Decatur Street; curbing,
guttering, paving and grading of Spruce Street with concrete (Thirty-three (33) feet wide
from back of curb to back of curb) from the east line of Chicago Street to the west line of
Clark Street; curbing, guttering, paving and grading of Third Street with concrete (Thirty-

curbing, guttering, paving and grading of Sietz Drive with concrete (Thirty-three (33) feet
wide from back of curb to back of curb) from the north line of Melrose Lane to the west line
of Eastborough Road; curbing, guttering of the east side of Third Street and the paving wit
concrete (Twenty-eight (28) feet wide from edge of curb to edge of curb) from the north side
of Walnut Street to the south bank of Smoky Hill River; paving and grading of Wisconsin
Avenue, with concrete (Twenty-two (22) feet wide) from the south line of Gypsum Avenue to th
north line of Glennifer Hill Drive, and the paving and grading with concrete (Twenty-two (22
feet wide) from the south line of Wisconsin Avenue to the east line of Greeley Avenue,
the same being an intervening connecting street; and providing for the payment of the cost
thereof, and how the same shall be assessed and the manner of the payment of the cost thereof.
WHEREAS, by Resolution Numbers 2613, 2612, 2639, 2636, 2628, 2610, 2587, 2617, 2616, 2615,
2614, 2560, 2611, 2618, 2554, 2635, 2570, 2553, 2641, 2646, 2645, 2647, duly adopted on
May 1, 1962, July 24, 1962, June 26, 1962, May 29, 1962, January 30, 1962, October 31, 1961,
October 10, 1961, November 21, 1961, July 31, 1962, August 14, 1962 by the Board of
Commissioners of the City of Salina, Kansas, have declared that they deem it necessary to

connecting street.
WHEREAS, each of the said Resolutions was published for six days in the Salina Journal, a
daily newspaper, published in the said City, and being the official city paper, and the
majority of the resident property owners owning a majority of the square feet of the lots
or real estate liable to taxation for the cost of said improvements and did not within
twenty days from the date of the last publication thereof file with the City Clerk a
sufficient protest in writing against the making of said improvements, no protests of any
kind having been filed, SO NOW, THEREFORE
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That it is necessary and it is hereby ordered that Claflin Avenue, from
the east line of Eleventh Street to the west line of Ninth Street, an intervening connecting
Street, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from
toe of gutter to toe of gutter) with excavation thereof, and graded to the established
paving grades and paved between the guttering lines thereof.

Section 2. That it is necessary and it is hereby ordered that Claflin Avenue, from
the east line of Rush Street to the west line of Pershing Street, an intervening connecting
`Street, in said City, be paved and graded with concrete (Twenty-eight (28) feet wide from
toe of gutter to toe of gutter) with excavation thereof, and graded to the established
paving grades and paved between the guttering lines thereof.
Section 3. That is is necessary and it is hereby ordered that Connecticut Avenue, from
the north line of Iron Avenue to the south line of Johnstown Avenue, in said City, be curbed
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb) with excavation thereof, and graded to the established paving grades and paved
between the guttering lines thereof.
Section 4. That it is necessary and it is hereby ordered that Chicago Street, from
the south line of Walnut 'Street to the south line of Spruce Street, in said City, be curbed,
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb) with excavation thereof, and graded to the established paving grades and
paved between the guttering lines thereof.
Section 5. That it is necessary and it is hereby ordered that Euclid Avenue, from
the west line of Fifth Street to the east line of Ninth Street, an intervening connecting
street, in said City, be curbed and guttered on the south side and paved with concrete
(Thirty (30) feet wide from back of curb to back of curb) with excavation thereof, and
graded to the established paving grades and paved between the guttering lines thereof.
Section 6. That it is necessary and it is hereby ordered that Fourth Street, from
the south line of Beloit Avenue to the north line of Minneapolis Avenue, in said City, be
curbed, guttered, paved and graded with 8 inch asphalt (Thirty-one (31) feet wide from toe
of slab to back of curb) on the west side of tracks, with excavation thereof, and graded to
the established paving grades and paved between the guttering lines thereof.
'Section 7. That it is necessary and it is hereby ordered that Greeley Avenue, from
the west side of Ohio 'Street to the east bank of the Smoky Hill River, in said City, be

Section 9. That it is necessary and it is hereby ordered that Johnstown Avenue, from
the east line of Ohio Street to the east line of Connecticut Avenue, an intervening
connecting street, in said City, be paved and graded with concrete (Twenty-eight (28) feet
wide from toe of gutter to toe of gutter) with excavation thereof, and graded to the
established paving grades and paved between the guttering lines thereof.
Section 10. That it is necessary and it is hereby ordered that Johnstown Avenue, from
the east line of Oakdale Avenue to the east line of Penn Avenue, an intervening connecting
street, in said City, be paved and graded with concrete (Thirty-two (32) feet wide ftom toe
of gutter to toe of gutter) with excavation thereof, and graded to the established paving
grades and paved between the guttering lines thereof.
Section 11. That it is necessary and it is hereby ordered that Johnstown Avenue, from
the east line of Front Street to the west line of Oakdale Avenue, an intervening connecting
street, in said City, be paved and graded with concrete (Thirty-two (32) feet wide from toe
of gutter to toe of gutter), with excavation thereof, and graded to the established paving
grades and paved between the guttering lines thereof.
Section 12. That it is necessary and it is hereby ordered that Leslie Avenue, from
the east line of Fourth Street to the east line of the Union Pacific Railroad right-of-way ,
in said City, be paved and graded with concrete (Thirty-three (33) feet wide from back of
curb to back of curb), with excavation thereof, and graded to the established paving grades
and paved between the guttering lines thereof.
Section 13. That it is necessary and it is hereby ordered that Neal Avenue, from the
west right-of-way of the Union Pacific Railroad to a point 200 feet east of the east right -
of way of said railroad, in said City, be curbed, guttered, paved and graded with concrete
(Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof, and
graded to the established paving grades and paved between the guttering lines thereof.
Section 14. That it is necessary and it is hereby ordered that Stapler Avenue, from
the east line of Michigan Avenue to the east line of Indiana Avenue, an intervening
connecting street, in said City, be curbed, guttered, paved and graded with concrete (Thirty-
three (33) feet wide from back of curb to back of curb) with excavation thereof, and
graded to the established paving grades and paved between the guttering lines thereof.
Section 15. That it is necessary and it is hereby ordered that Seventh Street, from
the north line of Lincoln Avenue to the south line of Decatur Street, in said City, be
paved and graded with concrete (Thirty-three (33) feet wide from back of curb to back of c
with excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 16. That it is necessary and it is hereby ordered that Spruce Street, from the
east line of Chicago Street to the west line of Clark Street, in said City, be curbed,
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb) with excavation thereof, and graded to the established paving grades and paved
between the guttering lines thereof.

Section 17. That it is necessary and it is hereby ordered that Third Street, from the
north line of Lamar Street to the south line of Wilson Street, in said City, be curbed,
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb), with excavation thereof, and graded to the established paving grades and
paved between the guttering lines thereof.
Section 18. That it is necessary and it is hereby ordered that Westchester Drive, from
the east line of Berkshire Drive to the east line of Ohio Street, in said City, be curbed,
guttered, paved and graded with 8 inch asphalt (Thirty-three (33) feet wide from back of
curb to back of curb), with excavation thereof, and graded to the established paving grades
and paved between the guttering lines thereof.
Section 19. That it is necessary and it is hereby ordered that Poplar Street, from
the east line of Ohio Street to the west line of Riverside Drive, in said City, be curbed,
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb), with excavation thereof, and graded to the established paving grades and
paved between the guttering lines thereof.
Section 20. That it is necessary and it is hereby ordered that Sietz Drive, from the
north line of Melrose Lane to the west line of Eastborough Road, in said City, be curbed,
guttered, paved and graded with concrete (Thirty-three (33) feet wide from back of curb to
back of curb),with excavation thereof, and graded to the established paving grades and paved
between the guttering lines thereof.
"Section 21. That it is necessary and it is hereby ordered that Third Street, from the
north side of Walnut Street to the south bank of Smoky Hill River, in said City, be curbed
and guttered on the east side and paved and graded with concrete (Twenty-eight (28) feet
wide from edge of curb to edge of curb), with excavation thereof, and graded to the establis e
paving grades and paved between the guttering lines thereof.
Section 22. That it is necessary and it is hereby ordered that Wisconsin Avenue, from
the south line of Gypsum Avenue to the north line of Glennifer Hill Drive, and from the south
line of Wisconsin Avenue to the east line of Greeley Avenue, an intervening connecting street,

in said City, be paved and graded with concrete (Twenty-two (22) feet wide, with excavation
thereof, and graded to the established paving grades and paved between the guttering lines

thereof.
Section 23. That for the work and improvements herein provided for the City Engineer
shall make and file with the City Clerk on or before the 25th day of September, 1962,
complete plans and specifications for the curbing, guttering, paving and grading with
excavation necessary therefore, of each of the streets or portions thereof described in
Sections 1 to 22, both inclusive, of this ordinance, with the following type of improvements

Concrete combined curb and gutter on each side thereof,
30 inches wide from back of curb to paving line, curb 12
inches deep at back, guttering 6 inches deep; and the
necessary grading of each to the established paving grade,
and paving thereof with 6 inch reinforced concrete,
providing that in the event of the non-availability of
reinforced material that then said pavement shall be
constructed with concrete to a deptn of 7 inches between
the curb and gutter line on each side thereof and within the
limits of said streets hereinbefore described; and the
paving thereof with eight inch hot mixed asphaltic concrete
between the curb and gutter line on each side thereof and
within the limits of said streets hereinbefore described.
said Engineer shall on or before the same date, submit to the Board of Commissioners under
oath, detailed estimates of the cost of such work and improvements.
Section 24. That after such plans and specifications have been made and prepared by
the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners
may advertise published advertisements in the official city paper of the City of Salina,
Kansas, for three consecutive days for the receipt of sealed proposals for the improving
of said streets with the kind of material named and specified in the preceding section
hereof, and for the excavation and grading necessary for the completion of said work, and
after the receipt of such proposals, the Board of Commissioners may and are hereby authorize
and directed to let contracts for the improving of said streets with the materials selected
by them to the lowest responsible bidder or bidders thereof, as determined by the Board of
Commissioners, and for such excavation and grading. Said Board reserves the right to reject
any or all bids.
Section 25. That for the improving of the above mentioned streets, such assessment
shall be made for the full cost thereof according to law on all lots and pieces of land to
the center of the block on either side of the streets to be improved according to the
appraisers valuation thereof, without regard to the buildings or improvements thereon for
the distance to be improved.
Section 26. After the passage and publication of this ordinance, the Board o f
Commissioners shall appoint three disinterested appraisers, householders, who after having
taken an oath to make a true and impartial appraisement, of all lots and pieces of land
liable to assessment and taxation as aforesaid, as may be designated by the Board of
Commissioners of the City of 'Salina, without regard to the buildings or improvements
thereon and after making such appraisement shall return to the Board of Commissioners of
said City and said Board of Commissioners shall designate a time and place for the hearing
of any complaints that may be made as to the value of any lots and pieces of land appraised
as aforesaid, of which due notice shall be given in the official city paper, at which
hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if,
in their opinion the same has been appraised too high or too low.
Section 27. That for the purpose of paying the cost of the work and improvements in
this ordinance provided for, the Board of Commissioners are hereby authorized and directed
to issue internal improvement bonds of the City of Salina, in an amount not to exceed the
contract price for the work of such improvements and to run for a period of ten years and

be payable in ten equal installments, together with interest not to exceed five per cent
per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas,
and for the purpose of paying the principal and interest on said bonds as they severally
become due and payable the Board of Commissioners shall apportion and assess against the
lots and pieces of land within the taxing district of such improvements special assessments
covering the cost of such improvements and the apportionment herein contained shall hold
good for all of the installments that are to be collected from the specific property
chargeable with said improvements. Such assessments and apportionment ordinance shall
contain the total amount of tax apportioned to each tract, piece or parcel of land within
the taxing district and shall state the number of annual installments in which such tax
is to be collected; and thereafter the City Clerk shall annually, at the same time other
taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of
all property liable to such work and assessments, together with the respective amounts due
on each of said tracts, pieces of land, which amounts shall include the annual installments
and interest on all unpaid balances for one year at the rate of not to exceed five percent
per annum on such amounts so certified which shall be collected as other taxes are collected
PROVIDED, that for the purpose of defraying the cost of improving the intersections and area
formed by the crossing of streets and alleys, and for the grading of said streets where the
same is provided for in this ordinance as well as where the improvement is through or
adjacent to property of the City for which the City is liable, the assessment will be made
against all taxable property of the City of Salina and paid by the City at large.
Section 28. That this ordinance shall take effect and be in full force and effect from
and after its adoption and publication once in the official city paper.
