6804 Airport RegulationsCONSOLIDATED-SALINA D 1 j 01 ORDINANCE NO. v" 0� AN ORDINANCE RELATING TO AND ADOPTING RULES AND REGULATIONS FOR THE OPERATION AND GOVERNMENT OF SALINA MUNICIPAL AIRPORT AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: Section 1. DEFINITIONS. For the purpose of this Ordinance, the terms defined in this section shall have the meaning ascribed to them as follows: (a) "Airport" means, Salina Municipal Airport operated.by the City of Salina, County of Saline, State of Kansas. 4 (b) "City", means the City of Salina, County of Saline, State of Kansas. (c) "Manager", means the airport manager or his duly authorized representative appointed by the City Manager to manage, supervise and control the Salina Municipal Airport. (d) "Person", means and includes any individual firm, part- nership, corporation or other legal entity. (e) "F.A.A.", means Federal Aviation Agency or its successors! Section 2. GENERAL OPERATIONS. All persons on any part of the property comprising the airport shall be governed by the regu- lations prescribed in this Ordinance and by such further rules and regulations as may hereafter be adopted by the Governing Body of the City mx relative to the use or occupation of any part of the property comprising the airport. Section 3. AUTHORITY. The airport manager'shall at all times have authority to take action as may be necessary to safe -guard the public and attendants at the airport and to make and enforce such temporary rules and regulations in addition to those provided herein as may be required in any emergency. Section 4. OPERATIONS. The airport manager may suspend or restrict any air or all operations without regatds to weather conditions whenever such action is deemed necessary in the interest of safety. Section 5. AIRCRAFT. No person shall navigate any aircraft over, land upon, or fly the same from, or service, maintain or repair any aircraft on the airport, or conduct any aircraft operations on or from the airport otherwise than 'z conformity with the requirements herain contained, regulations established by the F.A.A. and revisions or ached -1 CONSOLIDATED-SALINA -I 1 ments thereto, and any Kansas State rules and regulations governing aircraft not in conflict with rules and regulations of the United States of America. Section 6. CONDUCT OF BUSINESS. , (a) Commercial Use. No person shall use the airport as s a base or terminal for the carrying on of commercial aviation, or agriculture aviation, or the carrying of passengers for hire, freight, t express, or mail, or student flying, communications, or other commercial or private transportation for-profit without first securing a permit for such privilege, the use of the airport, and its facilities, for services rendered, and.upon the payment of rates and charges prescribed by the airport manager. (b) Concessions. No person shall engage in the Sale of refreshments or any other commodity, including gasoline,oil, or any other service, or solicit funds from the public on the airport for any purpose or place, distribute or display signs, advertisements or handbills at the airport except, with the written approval of the airport manager, and upon the payment of the rates and charges pres- cribed, or the rates specifically agreed on by the airport manager and such person for such use. (c) Petroleum Products. No person shall transport into or ' store upon the airport premises, aviation or automotive petroleum products for personal or resale use without written approval of the airport manager, and upon payment of rates specifically agreed upon by the airport manager and such person for such use. Section 7. ADMISSION tO HANGERS. No person other than the local airport personnel, F.A.A. Personnel, personnel concerned with the operation, repair or maintenance of the hangers, or persons having aircrafts stored therein shall enter any hanger on the airport without permission of the airport manager. Section 8. CONSTRUCTION AND ALTERATIONS. No persons shall do any construction, alteration or work , or electrical wiring in or to any existing hanger or building on the airport without first securing written permission from the airport manager, and all work shall be done in accordance with the City Building Codes. Violators will be required to remove such work at their own expense. Section 9. MOTOR VEHICLES AND MOBILE EQUIPMENT. No person shall operate any motor vehicle or mobile equipment on the airport, CONSOLIDATED-SALINA 1 1 V otherwise in accordance with the rules prescribed by the airport for the control of such vehicles except in case of emergency involving i life or property. The speed limit for all vehicles (except emergency vehicles) on the airport shall be 20 mph. No vehicle shall be driven on the runway, ramp area, or active taxiways, except by permission of the airport manager. No vehicle shall be parked unattended in a position that will obstruct traffic. Section 9. FIREARMS. No person, except peace officers, authorized post office employees, airport employees or members of the Armed Forces of the United States on official duty, shall cary any firearms or any expbsives onthe airport, without the written permission of the airport manager. Section 10. SANITATION. No person shall dispose of garbagg, paperlrefuse or other materials on the airport except in the recepticles provided for that purpose. Section ll. AIRCRAFT REPAIR. No aircraft, aircraft enginep propeller or appliance shall'be repaired or painted in any area on the airport, other than that specifically designated by the airport manager. use Section 12. FIRE HAZARD. No person shall tr inflamable, volatile liquids in the cleaning of the aircraft, aircraft engine=, propellers, and appliances unless such.cleaning operations are conducted in open air areas as designated or any room specifically set aside for that purpose, which room must be properly fireproof and equipped with adequate and readily accessible fire extinguishers. No person shall store or stock material or equipment in such a manner as to constitute a fire hazard. Section 13. OPERATION OF AIRCRAFT. (a) Securing of Unattended Aircraft. No aircraft shall be left unattended on the airport unless properly secured or within a hanger. Owner of such aircraft shall be held responsible for any damage resulting from the failure to comply with this rule. (b) Parking of Aircraft. No aircraft shall be paiked or left unattended within 30 feet of the edge of any taxiway, nor within 175 feet of any runway or on the ramp area, except when parked in designated aircraft parking areas. (c) Clearance. The airport manager may delay or restrict i any flight or any 'opera tions at the airport and may refuse any take- CONSOLIDATED-SALINA 'L, off clearanct to any aircraft when necessary'inhis opinion. (d) Aircraft Storage. Aircraft shall be stored or parked only in spaces designated for that purpose. , (d) Engine OPeration. No person shall start any aircraft engine unless a competent person is in the aircraft attending the engine controls. Blocks shall always be placed in front of the I wheels before starting unless the aircraft is equipped with adequate parking brakes. e Section 14. SMOKING PROHIBITED. No smoking will be permitted within fifty (50) feet of any fuel carrier.. jnen not in motion or when it is being utilized for fueling or draining of fuel from aircraft. Section 15. SUPPLEMENTAL RULES AND REGULATIONS. THe airport - manager, with the consent of the City Manager, is hereby authorized i to prescribe such additional rules and regulations as may be necessary for the operation and maintenance of said airport. Section 16. PENALTIES. Any person, firm or copporation violating or refusing to comply with the provisions of this Ordinance, , or violating the terms and conditions of any permit granted, shall be deemed guilty of a misdemeanor and shall upon conviction thereof, be punished by a fine of not less than $10.00 nor more than $500.00 or be imprisioned in the City jail for a period not to exceed thirty (30) days or both so fined and imprisoned in the discretion of the court. Each day that a violation continues constitutes a separate offense. Section 17. SEVERABILITY CLAUSE. Should any section clause or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this ordinance as a whole or any part -thereof other than the part so declared to be invalid. ij This Ordinance shall be in full force and effect from and after its adoption and publication in the official city newspaper.
