AN ORDINANCE ratifying and confirming a contract with the Brown and Brown, Inc. for the
construction of certain improvements on certain streets in the City of Salina, Kansas, and
providing for the issuance of temporary notes to pay the cost thereof pending the issuance
and sale of bonds.

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
I
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the
Brown and Brown, Inc. hereinafter referred to as the "Contractor" as submitted to the Board
of Commissioners on June 15, 1964, which is hereby Eound to be the lowest and best bid for
such work, and the contract awarded by the Board of Commissioners of the City of Salina,
Kansas to said contractor and signed on behalf of the City by its Mayor on June 22, 1964

for the construction of certain public improvements in the City of Salina, Kansas, to -wit:
i
The paving of the Alley First East of Hancock Street with concrete
Ten (10) feet wide from the north line of Franklin Avenue to the south
line of Venango Street.
The curbing, guttering, paving and grading of Kenwood Park Drive with
concrete (Thirty-seven (37) feet wide, back of curb to back of curb)
from a point 150 feet east of intersection of Kenwood Park Drive and
Oakdale Drive to existing county asphalt street, the same being an
intervening connecting street.
The curbing, guttering, paving and grading of Pacific Avenue with
concrete (Thirty-three (33) feet wide from back of curb to back of curb)
from the east side of Thirteenth Street to the west side of Twelfth Street
The curbing and guttering of Ray Avenue from the south line of Neal Avenue
to the center line of Laura Street.
The curbing, guttering, paving and grading of Riverside Drive with
concrete (Thirty-three (33) feet wide from back of curb to back of curb)
from the west line of Columbia Avenue to the east line of Oakdale Avenue,
the same being an intervening connecting street.
The curbing, guttering, paving and grading of Riverside Drive with
concrete (Thirty-three (33) feet wide from back of curb to back of curb)
from the west line of Des Moines Avenue to the east line of Kansas Avenue,
the same being an intervening connecting street.
The curbing, guttering, paving and grading of Riverside Drive with
concrete (Thirty-three (33) feet wide from back of curb to back of curb)
from the north line of Johnstown Avenue to the east line of Ohio Street,
the same being an intervening connecting street.
The Curbing, guttering, paving and grading of Riverside Drive with
concrete (Thirty-three (33) feet wide from back of curb to back of curb)
from the west line of Ohio Street to the east side of Des Moines Avenue,
the same being an intervening connecting street.
The paving and grading of Second Street with concrete (Twenty-eight (28)
feet wide from toe of gutter to toe of gutter) from the north line of Forest
Avenue to the south line of Woodland Avenue.

at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of said improvements
as shown by the sworn estimates of the City Engineer on file in the Office of the City Cler
which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the Office of
the City Clerk and in accordance with the proposal of said contractor and under the terms
of said contract, all of which are hereby referred to and made a part of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk
be issued from time to time as the work progresses in the manner and form as required by
law, the total amount thereof not to exceed the amount of $150,635.00 for such work, such
notes to bear interest not to exceed 5 per cent per annum and to mature not later than
December 1, 1965, and to be issued in such amounts and at such times as money for the
payment of the cost of such notes being issued to said contractor and to be redeemed and
cancelled at the time that permanent bonds are issued in lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from and after
its adoption and publication once in the official city paper.
