AN ORDINANCE providing for the paving of the Alley First East of Hancock Street with concret
(Ten (10) feet wide) from the north line of Franklin Avenue to the south line of Venango
Street; curbing, guttering, paving and grading of Kenwood Park Drive with concrete (Thirty-
seven (37) feet wide, back of curb to back of curb) from a point 150 feet east of intersecti
of Kenwood Park Drive and Oakdale Drive to existing county asphalt street; the same being
an intervening connecting street; curbing, guttering, paving and grading of Pacific Avenue
with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east
j side of Thirteenth Street to the west side of Twelfth Street; curbing and guttering of
Ray Avenue from the south line of Neal Avenue to the center line of Laura Street; curbing,
guttering, paving and grading of Riverside Drive with concrete (Thirty-three (33) feet wide
from back of curb to back of curb) from the west line of Columbia Avenue to the east line
of Oakdale Avenue, the same being an intervening connecting street; curbing, guttering,
paving and grading of Riverside Drive with concrete (Thirty-three (33) feet wide from back
of curb to back of curb) from the west line of Des Moines Avenue to the east line of Kansas
Avenue, the same being an intervening connecting street; curbing, guttering, paving and
grading of Riverside Drive with concrete (Thirty-three (33) feet wide from back of curb to
back of curb) from the north line of Johnstown Avenue to the east line of Ohio Street, the
same being an intervening connecting street; curbing, guttering, paving and grading of
Riverside Drive with concrete (Thirty-three (33) feet wide from back of curb to back of
curb) from the west line of Ohio Street to the east side of Des Moines Avenue, the same
! being an intervening connecting street; paving and grading of Second Street with concrete
(Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north line
of Forest Avenue to the south line of Woodland Avenue; curbing, guttering, paving and
grading of Second Street with concrete (Thirty-three (33) feet wide from back of curb to bacl
of curb) fromthe south line of Woodland Avenue to the south line of Pacific Avenue; curbing
guttering, paving and grading of Woodland Avenue with concrete (Thirty-three (33) feet wide
from back of curb to back of curb) from the east side of Thirteenth Street to the west side
of Twelfth Street; and providing for the payment of the cost thereof, and how the same shall
be assessed and the manner of the payment of the cost thereof.
j WHEREAS, by Resolution Numbers 2771, 2760, 2754, 2774, 2759, 2758, 2757, 2756, 2766, 2751,
2753, duly adopted on November 18, 1963, December 9, 1963, January 27, 1964, February 24, 19,
and April 20, 1964 by the Board of Commissioners of the City of Salina, Kansas, have declare
that they deem it necessary to pave the Alley First East of Hancock Street with concrete
(Ten (10) feet wide) from the north line of Franklin Avenue to the south line of Venango
Street; curb, gutter, pave and grade Kenwood Park Drive with concrete (Thirty-seven (37) fee'
wide, back of curb to back of curb) from a point 150 feet east of intersection of Kenwood
Park Drive and Oakdale Drive to existing county asphalt street, the same being an intervening
connecting street; curb, gutter, pave and grade Pacific Avenue with concrete (Thirty-three
(33) feet wide from back of curb to back of curb) from the east side of Thirteenth Street to
the west side of Twelfth Street; curb and gutter Ray Avenue from the south line of Neal
Avenue to the center line of Laura Street; curb, gutter, pave and grade Riverside Drive
with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west
line of Columbia Avenue to the east line of Oakdale Avenue, the same being an intervening
connecting street; curb, gutter, pave and grade Riverside Drive with concrete (Thirty-three
(33) feet wide from back of curb to back of curb) from the west line of Des Moines Avenue
to the east line of Kansas Avenue, the same being an intervening connecting street; curb,
gutter, pave and grade Riverside Drive with concrete (Thirty-three (33) feet wide from back

Street, the same being an intervening connecting street; curb, gutter, pave and grade
Riverside Drive with concrete (Thirty-three (33) feet wide from back of curb to back of curb;
from the -west line of Ohio Street to the east side of Des Moines Avenue, the same being an
intervening connecting street; pave and grade Second Street with concrete (Twenty-eight (28)
feet wide from toe of gutter to toe of gutter) from the north line of Forest Avenue to the
south line of Woodland Avenue; curb, gutter, pave and grade Second Street with concrete
(Thirty-three (33) feet wide from back of curb to back of curb) from the south line of
Woodland Avenue to the south line of Pacific Avenue; curb, gutter, pave and grade Woodland
Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from
the east side of Thirteenth Street to the west side of Twelfth Street.
WHEREAS, each of the said Resolutions was published for six days in the Salina Journal, a
daily newspaper, published in the said City, and being an official city paper, and the
majority of the resident property owners owning a majority of the square feet of the lots
or real estate liable to taxation for the cost of said improvements did not within twenty
days from the date of the last publication thereof file with the City Clerk a sufficient
protest in writing against the making of said improvements, no protests of any kind having
been filed, SO NOW, THEREFORE

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That it is necessary and it is hereby ordered that the Alley First East of
Hancock Street, from the north line of Franklin Avenue to the south line of Venango Street,
an alley in the City of Salina, Kansas, be paved with concrete (Ten (10) feet wide) with
excavation thereof, and graded to the established paving grades and paved between the
guttering lines thereof.
Section 2. That it is necessary and it is hereby ordered that Kenwood Park Drive from
a point 150 feet east of intersection of Kenwood Park Drive and Oakdale Drive to existing
county asphalt street, a street in the City of Salina, Kansas, an intervening connecting
street, be curbed, guttered and paved with concrete (Thirty-seven (37) feet wide from back
of curb to back of curb) with excavation thereof, and graded to the established paving grades
and paved between the guttering lines thereof.
Section 3. That it is necessary and it is hereby ordered that Pacific Avenue from the
east side of Thirteenth Street to the west side of Twelfth Street, a street in the City of
Salina, Kansas, be curbed, guttered, paved with concrete (Thirty-three (33) feet wide from
back of curb to back of curb) with excavation thereof, and graded to the established paving
grades and paved between the guttering lines thereof.
Section 4. That it is necessary and it is hereby ordered that Ray Avenue from the
south line of Neal Avenue to the center line of Laura Street, a street in the City of Salina,
Kansas, be curbed and guttered with excavation thereof, along with such grading as may be
necessary.
Section 5. That it is necessary and it is hereby ordered that Riverside Drive from
the west line of Columbia Avenue to the east line of Oakdale Avenue, a street in the City of
Salina, Kansas, an intervening connecting street, be curbed, guttered and paved with concrete
(Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof,
and graded to the established paving grades and paved between the guttering lines thereof.
Section 6. That it is necessary and it is hereby ordered that Riverside Drive from
the west line of Des Moines Avenue to the east line of Kansas Avenue, a street in the City of
Salina, Kansas, an intervening connecting street, be curbed, guttered and paved with concrete
(Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof,
and graded to the established paving grades and paved between the guttering lines thereof.
Section 7. That it is necessary and it is hereby ordered that Riverside Drive from
the north line of Johnstown Avenue to the east line of Ohio Street, a street in the City of
Salina, Kansas, an intervening connecting street, be curbed, guttered and paved with concrete
(Thirty-three (33) feet wide from back of curb to back of curb) with excavation thereof,
and graded to the established paving grades and paved between the guttering lines thereof.

Section 9. That it is necessary and it is hereby ordered that Second Street from
the north line of Forest Avenue to the south line of Woodland Avenue, a street in the City
of Salina, Kansas, be paved and graded with concrete (Twenty-eight (28) feet wide from toe
of gutter to toe of gutter) with excavation thereof, and graded to the established paving
grades and paved between the guttering lines thereof.
Section 10. That it is necessary and it is hereby ordered that Second Street from the
south line of Woodland Avenue to the south line of Pacific Avenue, a street in the City of
Salina, Kansas, be curbed, guttered, paved with concrete (Thirty-three (33) feet wide from
back of curb to back of curb) with excavation thereof, and graded to the established paving
grades and paved between the guttering lines thereof.
Section 11. That it is necessary and it is hereby ordered that Woodland Avenue from
the east side of Thirteenth Street to the west side of Twelfth Street, a street in the City
of Salina, Kansas, be curbed, guttered, paved with concrete (Thirty-three (33) feet wide
ifrom back of curb to back of curb) with excavation thereof, and graded to the established
paving grades and paved between the guttering lines thereof.
Section 12. That for the work and improvements herein provided for the City Engineer
shall make and file with the City Clerk on or before the day of 1964.
complete plans and specifications for the curbing, guttering, paving and grading with
excavation necessary therefore, of each of the streets or portions thereof described in
Sections 1 to 11, both inclusive, of this ordinance, with the following type of improvements.
Concrete combined curb and gutter on each side thereof, 30 inches
wide from back of curb to paving line, curb 12 inches deep at back,
guttering 6 inches deep; and the necessary grading of each to the
established paving grade, and paving thereof with 6 inch reinforced
concrete, providing that in the event of the non-availability of
reinforced material that then said pavement shall be constructed
with concrete to a depth of 7 inches between the curb and gutter
line on each side thereof and within the limits of said streets
hereinbefore described.

oath, detailed estimates of the cost of such work and improvements.
Section 13. That after such plans and specifications have been made and prepared by
the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners
may advertise published advertisement in the official city paper of the City of Salina,
Kansas for three consecutive days for the receipt of sealed proposals for the improving of
said streets with the kind of material named and specified in the preceeding section hereof,

grades and paved between the guttering lines thereof.
Section 11. That it is necessary and it is hereby ordered that Woodland Avenue from
the east side of Thirteenth Street to the west side of Twelfth Street, a street in the City
of Salina, Kansas, be curbed, guttered, paved with concrete (Thirty-three (33) feet wide
ifrom back of curb to back of curb) with excavation thereof, and graded to the established
paving grades and paved between the guttering lines thereof.
Section 12. That for the work and improvements herein provided for the City Engineer

Kansas for three consecutive days for the receipt of sealed proposals for the improving of
said streets with the kind of material named and specified in the preceeding section hereof,

and for the excavation and grading necessary for the completion of said work, and after the
receipt of such proposals, the Board of Commissioners may and are hereby authorized and
directed to let contracts for the improving of said streets with the materials selected by
them to the lowest responsible bidder or bidders thereof, as determined by the Board of
Commissioners, and for such excavation and grading. Said Board reserves the right to reject
any or all bids.
Section 14. That for the improving of the above mentioned streets, such assessment
shall be made for the full cost thereof according to law on all lots and pieces of land to
the center of the block on either side of the streets to be improved according to the
appraisers valuation thereof, without regard to the buildings or improvements thereon for
the distance to be improved.
Section 15. After the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterested appraisers, householders, who after having
taken an oath to make a true and impartial appraisement, of all lots and pieces of land
liable to assessment and taxation as aforesaid, as may be designated by the Board of
Commissioners of the City of Salina, without regard to the buildings or improvements thereon
and after making such appraisement shall return to the Board of Commissioners of said City
and said Board of Commissioners shall designate a time and place for the hearing of any
complaints that may be made as to the value of any lots and pieces of land appraised as
aforesaid, of which due notice shall be given in the official city paper, at which hearing
the Board of Commissioners may alter any valuation of any lot or piece of land, if, in
their opinion the same has been appraised too high or too low.
Section 16.
That for the purpose of paying the cost of the work and improvements in
this ordinance provided for, the Board of Commissioners are hereby authorized and directed
to issue internal improvement bonds of the City of Salina, in an amount not to exceed the
contract price for the work of such improvements and to run for a period of ten years and
be payable in ten equal installments, together with interest not to exceed five per cent
per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas,
and for the purpose of paying the principal and interest on said bonds as they severally
become due and payable the Board of Commissioners shall apportion and assess against the
lots and pieces of land within the taxing district of such improvements, special assessments
covering the cost of such improvements and the apportionment herein contained shall hold
good for all of the installments that are to be collected from the specific property
chargeable with said improvements. Such assessments and apportionment ordinance shall
contain the total amount of tax apportioned to each tract, piece or parcel of land within
the taxing district and shall state the number of annual installments in which such tax is
to be collected; and thereafter the City Clerk shall annually, at the same time other taxes
are certified, certify to the County Clerk of Saline County, Kansas, a full list of all
property liable to such work and assessments, together with the respective amounts due

on each of said tracts, pieces of land, which amounts shall include the annual installments
and interest on all unpaid balances for one year at the rate of not to exceed five per cent
per annum on such amounts so certified which shall be collected as other taxes are collected;
PROVIDED, that for the purpose of defraying the cost of improving the intersections and
area formed by the crossing of streets and alleys, and for the grading of said street
where the same is provided for in this ordinance as well as where the improvement is
through or adjacent to property of the City for which the City is liable, the assessment will
be made against all taxable property of the City of Salina and paid by the City at large.
Section 17. That this ordinance shall take effect and be in full force and effect
from and after its adoption and publication once in the official city paper.
