AN ORDINANCE CONDEMNING CERTAIN LAND WITHIN THE CITY OF 5ALINA, KANSAS, FOR THE USE OF SAID CITY IN THE WIDENING AND IMP,ROVI �­IENT OF RIVERSIDE DRIVE FROM ASH STREET TO ELH STREET A14D FIXING Tril t3ENEFIT DISTRICT THEREFORE AICD PROVIDING FOR THE PAYMENT OF THE COS`: THEREOF. WHEREAS the Governing Body of the City of Salina, Kansas :did on the 9th day of March, 1964, by Resolution No. 2771 find it 'necessary to appropriate certain private property located in the ;City of Salina, Kansas for the use of said City in the widening and "improvement of Riverside Drive from Ash Street to Elm Street and 'idirected the City Engineer of the City of Salina, Kansas, to make a survey and description of the land so required; and, WHEREAS on the 16th day of March, 1964, a survey and ,description of the land so required was duly filed with the City Xlerk. NOW THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF TH� ;;CITY OF SALINA, KANSAS: Section 1. That the following described land is hereby ,.condemned and appropriated for the use of the City of Salina for th+ widening and improvement of Riverside Drive in the City of Salina, Kansas, from Ash Street to Elm Street, to -wit: i. Part of Lot Fourteen (14), Block Two (2), Riverview Addition more particularly des- cribed as follows: Beginning at the South- east corner of Lot Fourteen (14), thence West along the South Line of said Lot a dis- tance of Fifteen (15) Feet; Thence North- westerly a distance of Eighty-six (86) Feet, more or less to a point on the Northeast Line of Lot Fourteen (14), and a distance of Twenty-five (25) Feet, more or less from the Northwest Corner of Lot Fourteen (14); Thence Southeasterly along the Northeast Lot (: Line a distance of Ninety-one (91) Feet, more or less to the point of beginning con- taining 1221 sf or .028 ac. Section 2. That it is hereby found that the following `described real estate within the City of Salina, Kansas, will be �,speciall_y benefited by reason of the acquisition of said land and that the same shall be known as the "benefit district", to -wit: Lots Eleven (11), Twelve (12), Thirteen (13), and Fourteen (14) in Block Two (2) in River- view Addition to ethe City of Salina, Saline County, Kansas. Section 3. That L. 0. Bengtson, City Attorney, is here- by ordered and directed to forthwith prepare and present in the name of the Board of Commissioners of the City of Salina, Kansas, ai :;written application of the Judges of the District Court of Saline ,County, Kansas, praying for an order of appDintment of commissioners to make appraisement and make assessment of damages arising from ;the appropriation of said real estate and to do and perform all ithings in and about the procuring and recording of said order of appraisement required by law. Section 4. That for the payment of the costs thereof the City of Salina, Kansas, may issue improvements bonds of said city in an amount not to exceed the total cost of acquiring sold ;s ;land herein condemned, except as herein provided, to be payable in ,:,one installment and the bear interest not to exceed five percent (5$) per annum from the date of such bonds and for the purpose of 1 paying such bonds and interest as they mature, the Board of Commis -i isioners shall: ` i CONSOLIDATED-SALINA 1 1 (a) Apportion and assess against the lots and pieces jof ground within the benefit district, special assessments covering '!such portions of the cost of such land so acquired as shall be chargeable to said benefit district, such assessment and apportion ment ordanance shall contain the total amount of the tax apportioned Ito such tract, piece or parcel of land within such taxing district, land thereafter the City Clerk shall at the same time that other taxes +are certified, certify to the County Clerk of Saline County, Kansasd +a full list of all property liable for such public improvements, '!together with respective numbered amounts due on each of said trach , ,pieces or parcels of land which shall be collected as other taxes .are collected. (b) Levy a tax upon all real and personal property with+ - in the City of Salina in amounts sufficient to pay the portion of ;,the cost of said land so required as shall be payable by the city ,at large and pending the issuance of such bonds temporary notes may. issue therefore accoding to law to pay the costs of acquiring such land. Section 5.
