6774 Utility ImprovementsCONSOLIDATED -SAUNA 1 1 i ORDINANCE NUMBER (Published in The Salina JournalG�C 1 1964) AN ORDINANCE ratifying and confirming a contract with Brown and Brown, Inc. for the construction of Lateral Sanitary Sewer 491 and providing for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds.,! BE IT ORDAINED by the Board of Commissioners of the City of Salina., Kansas: Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of the Brown and Brown, Inc. hereinafter referred to as the "Contractor" as submitted to the Board of Commissioners on March 2, 1964, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on March 9, 1964, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Lateral Sanitary Sewer Number 491 described as follows: An 8" V. C. P. sewer beginning at a manhole to be constructed over an existing 27" V. C. P. sewer which is 53' northwest of an existing manhole located in the easement between Lots 11 and 12, Block 8 Replat of Faith Addition; thence northwesterly 254.8' to a point 10' south and 12' east of the southwest corner of Lot 13, Block 9, Replat of Faith Addition; thence west on a line 10' south of the south line of Lots 12, 11, 10, 9, 8, 7, 6, 5 and 4 a distance of 751.4' to a point which is 10' west of the southeast corner of Lot 3, Block 9 Replat of Faith Addition where a manhole will be constructed, which will be the terminus of Lateral 491. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk which estimate is hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposals of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $5,147.00 for such work, such notes to bear interest at not to exceed 5 per cent per annum and to mature not later than December 1, 1965, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu thereof. Section 4. That this ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
