6742 Auth Bonds P-195CONSOLIDATED-SALINA I j ORDINANCE NUMBER I li (Published in The Salina Journal 1963) I I AN ORDINANCE authorizing and providing for the issuance of Internal Improvement Bonds of the City of Salina, Kansas, all in the sum of $803,072.90, to pay the cost of improving certain streets and other improvements in said City to be designated as Series P-195. IWHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following streets and other improvements in the City of Salina, Kansas, to -wit: 1 A. This improvement consists of the curbing, guttering and paving of: I (a) Magnolia Road, from the west line of Belmont Boulevard to the east line of U. S. 81 By-pass. (b) Belmont Boulevard, from the north line of Magnolia Road to the south line of Parkway Avenue. (c) Hart Street, from the west line of Belmont Boulevard to the east line of Gebhart Street. (d) Fourth Street, from the south line of Parkway Avenue to the south line of Hart Street. (e) Reed Avenue, from the west line of Belmont Boulevard to the east line of Larson Street. (f) Parkway Avenue, from the west line of Fourth Street to the east line of U. S. 81 Highway. (g) Highland Avenue, from the south line of Magnolia Road to the north line of Parkway Avenue. (h) Simmons Street, from the south line of Magnolia Road to the north line of Parkway Avenue. (i) Larson Street, from the south line of Magnolia Road to the north j line of Parkway Avenue. (j) Gebhart Street, from the south line of Magnolia Road to the north line of Reed Avenue. B. Water main to be installed in all the above described streets. C. The sanitary sewer to serve all of Blocks 1, 2, 3, 4, 5, 6, 7, 8, 12, 27, 282 29 and Lots 1, 12, Block 9, Lots 1, 2, 3, 9, 10, Block 10 and Lots 1, 2, 3, 10, 11, Block 11 Key Acres Addition. as provided for by Resolution Numbers 2479, 2484 and 2494. 1. This improvement consists of the curbing, guttering, paving and grading of: (a) Edgevale Drive from the east line of Ohio Street to the west line of Moundview Avenue. (b) Manchester Road from the south line of Edgevale Drive to the north line of McAdams Road. 2. Water mains to be installed in the above described streets. 3. A sanitary sewer to serve Blocks 2, 5 and 6 of Faith Addition in the City of Salina, Kansas. 4. Sidewalks to be built at the corners of each street which is within the right-of-way of streets and adjacent to the west line of Lot 1, Block 5 adjacent to the east line of Lot 12, Block 5 adjacent to the west line of Lot 1, Block 6 adjacent to Lot 12, Block 6. as provided for by Resolution Numbers 2599, 2607 and 2609. CONSOLIDATED -SALIVA 1. This improvement consists of the curbing, guttering and paving of: i Arlington Drive from the west line of Berkshire Drive to the south line of Greeley Avenue. Delaware Avenue from the south line of Indian Rock Lane to the south line of Stratford Drive. Stratford Drive from the west line of Berkshire Drive to the west line of Delaware Avenue. 2. Water main to be installed in the above described streets. 3. Sanitary sewer to serve Blocks 3, 4, 6, 7 and 8 of Indian Rock Addition. as provided for by Resolution Numbers 2600, 2620 and 2623. The paving and grading of Alley with concrete (Sixteen (16) feet wide) first north of Wayne Avenue from Roach Street to Lewis Street, as provided for by Resolution Number 2429 and Ordinance Number 6552. The paving and grading of Antrim Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west side of Tenth Street to the west line of Eleventh Street, as provided for by Resolution Number 2427 and Ordinance Number 6552. The curbing, guttering, paving and grading of East Ash Street with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east side of Ohio Street to the east line of Riverside Drive, as provided for by Resolution Number 2497 and Ordinance Number 6552. The curbing, guttering, paving and grading of the East side of Fourth Street with concrete (Thirty (30) feet wide from back of curb to the edge of pavement) from the south line of Wilson Street to the south line of Lamar Street, as provided for by Resolution Number 2472 and Ordinance Number 6552. The curbing, guttering, paving and grading of Stack Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west side of Missouri Avenue to the east side of Indiana Avenue, as provided for by Resolution Number 2444 and Ordinance Number 6552. I The curbing, guttering, paving and grading of South Second Street with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from a point 23 feet north of the south line of Lot 15, Block 7 Hutchinson's Addition to the south line of Lot 19 of said block, as provided for by Resolution Number 2456 and Ordinance Number 6552. The curbing, guttering, paving and grading of Wayne Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the east line of Ohio Street to the west line of Huntington Road, as provided for by Resolution Number 2515 and Ordinance Number 6552. The curbing, guttering, paving and grading of Beechwood Road with 8 inch asphalt, (Thirty-three (33) feet wide from back of curb to back of curb) from the north line of Northwood Road to the north line of Brookwood Road, as provided for by Resolution Number 2489 and Ordinance Number 6553. The curbing, guttering, paving and grading of Country Club Road with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the west line of Overhill Road to the east line of Eastborough Road, as provided for by Resolution Number 2538 and Ordinance Number 6567. The curbing, guttering, paving and grading of Des Moines Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the south line of Lot 16, Block 4 of Riverside Park Addition to the north line of Lot 18 of said Addition, as provided for by Resolution Number 2528 and Ordinance Number 6567. CONSOLIDATED-$ALINA per annum and from and after said date until the respective maturities of said bonds, payable semiannually on May 1, and November 1, in each year, said interest to be evidenced by interest coupons as herein provided for and said bonds shall become due as follows: Bonds Numbered 1 to 41 for $1,000.00 each except Number 1 is for $1,072.90 due on May 1, 1965. The paving and grading of Missouri Avenue with concrete (Twenty-eight (28) feet wide from toe of gutter to toe of gutter) from the north line � ! i of Stack Avenue to the north line of Greeley Avenue, as provided for Numbered 83 by Resolution Number 2543 and Ordinance Number 6567. 122 for WHEREAS, the total cost of said improvements has been ascertained and the portion thereof each due in the amount of $276,893.68 was apportioned to the City at Large and of the amount $51,528.53 has been duly paid by the City Water Department to cover costs of water pipe Numbered 123 and hydrants, leaving a balance of $225,365.15 to be paid by general taxes to be levied 163 for upon all taxable property within said city for the improvement of squares and areas formed each due by the crossing of streets and alleys and for the improvement of any of said streets, where the same is through or adjacent to property of the City for which the City is liable, Numbered 164 for which bonds are to be issued; and 203 for WHEREAS, the total cost of said curbing, guttering, paving and grading of streets, which each due jare to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering, paving and grading of said streets has Numbered 204 been ascertained and has been hereby found and determined to be the sum of $731,803.56 244 for which amount has been heretofore duly assessed and apportioned to the several lots and each due pieces of ground liable therefor according to law provided for in the Ordinances of the City of Salina, Kansas relating thereto, duly passed and approved of which amount the sum of $154,095.81 has been duly paid by the property owners liable therefor, leaving a balance of $5Z 7Q -7--Z5 for which bonds are to be issued, and WHEREAS, bonds in the aggregate sum of $803,072.90 are to be issued to pay the actual cost thereof. Numbered 245 BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: 284 for Section 1. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the City shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signature of the Mayor and City Clerk of said City and said bonds and interest coupons shall be registered in the Office of the City Clerk and in the Office i itof the Auditor of State as required by law. Section 3. Said bonds shall be designated as Series P-195 and shall be in the form and shall contain recitals substantially as follows, to -wit: CONSOLIDATED-SALINA 1 C7 UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALIVA INTERNAL IMPROVEMENT BOND No. Series P-195 $ KNOW ALL MEN BY THESE PRESENTS, that the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of dollars in lawful money of the United States of America, on the first day of , 19 with interest thereon from the date hereof at the rate of per cent per annum, payable semiannually on May 1, and November 1, in each year, on presentation and surrender of the interest coupons hereto affixed as said coupons become severally due, both principal of and interest on this bond being payable at the Office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas, and said city of Salina, Kansas, is held and firmly bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 803 bonds of like date and tenor, excepting denomination, interest rate and maturity, aggregating the principal sum of $803,072.90 issued by the City of Salina, Kansas for the purpose of paying the cost of constructing, curbing, guttering, paving and grading and other improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas, including Sections 10-101 to 10-127, 12-601 to 12-608, and 13-1011 and 13-1011a, all of the General Statutes of Kansas, 1949 and Sections 12-6a01 to 12-6al8 G. S. 1961 Supplement and amendments thereto and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said City, including this series of bonds, does not exceed any constitutional or statutory limitation. Hedrick, State Auditor of Kansas, hereby certify that a transcript of the proceedings leading up to the issuance of this bond has been filed in my office and that this bond and the coupons attached thereto were registered in my office according to law this State Auditor of Kansas By: Director of Post Audits CONSOLIDATED-SALINA F L 1 Section 4, The Mayor and City Clerk are hereby authorized and directed to prepare and execute the bonds hereinbefore described and to advertise and sell the same in the manner provided by law, and when duly executed and registered to deliver said bonds to the purchaser or purchasers thereof. Section 5, The full faith, credit and resources of the City of Salina, Kansas, shall be and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually make provisions for the payment of the principal and interest on said bonds as they severally become due by levying taxes and assessments upon the property liable therefor as provided for by law.
