6741 Issue Bond P-194CONSOLIDATED -SALIVA I ORDINANCE NUMBER lL' (Published in The 'Salina Journal , 1963) i i AN ORDINANCE AUTHORIZING AND PROVIDING FOR THE ISSUANCE OF Internal Improvement Bonds of th City of Salina, Kansas, all in the sum of $986,218.15, to pay the cost of improving certain streets and other improvements in said City to be designated as Series Number P»194. WHEREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following streets and other improvements in the City of Salina, Kansas, to -wit: I This improvement consists of the curbing, guttering and paving of: Quincy Avenue from the north line of Lot 7, Block 6, Belmont I Addition to the north line of Magnolia Road. Magnolia Road from the west line of Quincy to the east line of Ohio Street. I Ohio Street from the south line of Oxford to the north line of Magnolia Road. I I Saxwood Drive from the east line of Belmont Boulevard to the north line of Magnolia Road. Montclair Drive from the east line of Quincy Avenue to the west line of Belmont Boulevard and from the east line of Belmont j Boulevard to the north line of Magnolia Road. Belmont Boulevard from the south line of Mayfair Drive to the north line of Magnolia Road. Mayfair Drive from the north line of Lot 30, Block 20, Belmont Addition to the north line of Magnolia Road. Kensington Road from the north line of Lot 11, Block 20, Belmont Addition to the North line of Magnolia Road. I Wesley Avenue from the north line of Lot 9, Block 18, Belmont Addition to the west line of Edward Street. Edward Street from the north line of LaShalle to the north line of Magnolia Road. j Brentwood Drive from the south line of Roach Street to the north line of Magnolia Road. LaShalle Lane from the east line of Kensington to the west line of Wesley, and from the east line of Wesley to the west line of Edward, and from the east line of Edward to the west line of Roach Street, and from the east line of Roach to the west line of Pearl Street. Water main to be installed in all the above described streets except Ohio Street which has an existing 6" water main. Sanitary 'Sewer to serve all lots and parcels within the benefit district. as provided for by Resolution Numbers 2525, 2532 and 2533. This improvement consists of the curbing, guttering and paving of: Highland Avenue from the south line of Parkway to the north line of Cottonwood Road. Ninth Street Place from the south line of Parkway to the north line of Belmont Boulevard. Simmons Street from the south line of Parkway to the north line of Roy Avenue. a CONSOLIDATED-$ALINA I Larson Street from the south line of Parkway to the north line of Key Avenue. i I Belmont Boulevard from the south line of Parkway to the east line of US 81 Highway. Fourth Street from the south line of Parkway to the north line of Cottonwood Road. I Hartland Avenue from the east line of Larson to the west line j of U. P. Railroad. Roy Avenue from the east side of Highland to the north side of Cottonwood Road. Key Avenue from the east line of Ninth Street Place to the north line of Cottonwood Road. I Morland Avenue from the east line of Highland to the south line of Key Avenue. I i Dawn Street from the south line of Belmont Boulevard to the north line of Cottonwood Road. � I Allen Street from the south line of Belmont Boulevard to the north line of Cottonwood Road. Daley Street from the south line of Belmont Boulevard to the north line of Cottonwood Road. Cottonwood Road from the east line of U5 81 Highway to the west line of U. P. Railroad. Water main to be installed in all the above described streets. I Sanitary Sewer to serve all lots and parcels within the benefit district hereinafter described. I Sidewalks at all intersections and corner lots in each block of the benefit district. as provided for by Resolution Numbers 2586, 2591 and 2596. WHEREAS, the Total cost of said improvements has been ascertained and the portion thereof in the amount of $197,099.76 was apportioned to the City at large of this amount $17,869.38 has been duly paid by the City Water Department to cover cost of water pipe and hydrants, leaving a balance of $179,230.38,, to be paid by general taxes to be levied upon all taxable property within said City for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets, where the same is through or adjacent to property of the City for which the City is liable, for which bonds a are to be issued; and j WHEREAS, the total cost of said curbing, guttering, paving and grading of said streets, which are to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering, paving and grading in said streets, has been ascertained and has been hereby found and determined to be the sum of $833,869.93 which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefore according to law provided for in the Ordinances of the City of Salina, Kansas, relating thereto, duly passed and approved of which amount the sum of $26,882.16 has been duly paid by the property owners liable therefor, leaving the amount of $8063987._77 for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $986,218.15 are to be issued to pay the actual cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: jSection 1. Said bonds shall be signed by the Mayor and shall be attested by the signature of the City Clerk and the corporate seal of the City shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithograph facsimile signatures of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered in the Office of the City Clerk and in the Office of the Audito of State as required by law. Section 3. Said bonds shall be designated as Series P-194 and shall be in the form and shall contain recitals substantially as follows, to -wit: CONSOLIDATED -SALIVA UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA INTERNAL IMPROVEMENT BOND NO. Series P-194 $ KNOW ALL MEN BY THESE PRESENTS, That the City of Salina, in the County of Saline, State of Kansas, acknowledges itself to be indebted and for value received hereby promises to pay to the bearer the sum of dollars in lawful money of the United States of America, on the first day of , 19 with interest thereon from the date hereof and at the rate of per cent per annum, payable semiannually on May 1, and November 1, in each year, on presentation and surrender of the interest coupons hereto affixed as said coupons become severally due, both principal of and interest on this bond being payable at the Office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansas, and said City of Salina, Kansas, is held and firml bound by these presents and the full faith, credit and resources of said city are hereby irrevocably pledged for the payment of said principal and interest at maturity. This bond is one of a series of 986 bonds of like date and tenor, excepting denomination, interest rate and maturity, aggregating the principal sum of $986,218.15 issued by the City of Salina, Kansas for the purpose of paying the cost of constructing certain street and other improvements in said City by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the 'State of Kansas, including Sections 10-101 to 10-127 General 'Statutes of Kansas, 1949, and Sections 12-6a01 to 12-6a18 G.S. 1961 Supp. and amendments thereto, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. IN WITNESS WHEREOF, the said City of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor and its corporate seal to be hereto affixed, attested by its City Clerk and the coupons hereto attached to be signed with the facsimile signatures of said officers and this bond to be dated the first day of November, 1963. Attest: 1 City Clerk Mayor And it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not exceed any constitutional or statutory limitation.
