A RESOLUTION REAFFIRMING AND RESTATING THE DELEGATION OF
POWERS BY THE CITY OF SALINA, KANSAS, TO THE HOUSING AUTHORITY OF
THE CITY OF SALINA AND AUTHORIZING THE MAYOR TO EXECUTE A SPECIAL
WARRANTY DEED CONVEYING FROM THE CITY TO THE HOUSING AUTHORITY
THOSE REAL PROPERTIES CURRENTLY TITLED IN THE NAME OF THE CITY FOR
PURPOSES OF THE HOUSING PROGRAMS ADMINISTERED BY THE HOUSING
AUTHORITY.
WHEREAS, on September 11, 1967, the governing body of the City of Salina, Kansas (the
"City") adopted Resolution No. 2454 creating an agent of the City of Salina designated as "Housing
Authority of the City of Salina" (the "Housing Authority") and delegating powers thereto as
authorized by the Municipal Housing Law set forth at K.S.A. 17-2337 et seq.; and
WHEREAS, Resolution No. 2454 delegated to the Housing Authority all powers conferred
upon the City by the Municipal Housing Law, except the powers to execute contracts with an
agency of the Government, borrow money, issue bonds (as defined in the Municipal Housing Law)
and acquire or dispose of any property; and
WHEREAS, on November 6, 1978 the governing body of the City adopted Resolution No.
3395 delegating to the Housing Authority the power to act as a "Parent Entity PHA" as the term is
defined in Part 811, Subpart "A" of Title 24, Code of Federal Regulations; and
WHEREAS, the governing body desires to reaffirm those powers previously granted to the
Housing Authority and to confer upon the Housing Authority the additional powers to acquire or
dispose of any property, other than by exercise of the power of eminent domain; and
WHEREAS, the governing body desires to convey title from the City to the Housing
Authority by special warranty deed those real properties currently titled in the name of the City for
purposes of the housing programs administered by the Housing Authority; SO NOW,
THEREFORE,
BE IT RESOLVED by the governing body of the City of Salina, Kansas:
Section 1. The Housing Authority is delegated all powers conferred on the City by the
Municipal Housing Law, with the following exceptions:
(a) The Housing Authority shall not acquire real property by the exercise of the
power of eminent domain; and
(b) The Housing Authority shall have neither the power to borrow money nor the
power to issue bonds (as "bonds" are defined in the Municipal Housing Law).
Section 2. The Housing Authority is delegated all powers conferred on the City as a
"Public Housing Agency (PHA)" or "Parent Entity PHA" as the terms are defined in Title 24 of the
Code of Federal Regulations, including, but not limited to, the power to contract with the United
States Department of Housing and Urban Development.
Section 3. The Mayor is authorized to execute a special warranty deed conveying from
the City to the Housing Authority all real property currently titled in the name of the City for
purposes of the housing programs administered by the Housing Authority;
Section 4. This resolution shall be in full force and effect from and after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor this 11"' day of April,
2005.
