6879 Utility ImprovementsCONSOLIDATED-SALINA ORDINANCE NUMBER I (Published in The Salina Journal} 1965) AN ORDINANCE ratifying and confirming a contract with Brown and Brown, Inc. for the construction of Lateral Sanitary Sewer 501, and providing for the issuance of temporary notes to pay the cost thereof, pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance of the City of Salina, Kansas, of the proposal of Brown and Brown, Inc. hereinafter referred to as the "Contractor" as submitted to the Boar of Commissioners on October 4, 1965, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on October 11, 1965, for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Lateral Sanitary Sewer Number 501, described as follows: (1) An 8 inch clay pipe sewer beginning at an existing manhole in Iron Avenue and Iowa Avenue; (2) thence southwesterly 45 feet more or less to the west parking in Iowa Avenue; (3) thence west along a line 5 feet south of the south line of said Lot 19, 165 feet; (4) thence south along a line 160 feet west of the west line of Iowa Avenue 445 feet where a manhole will be built which will be the terminus of Lateral 501. at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made a part of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the Office of the City Clerk which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the Office of the City Clerk and in accordance with the proposals of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attest by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the amount of $5,707.35, for such work, such notes to bear interest at not to exceed 5 per cent per annum and to mature not later than December 1, 1967, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu thereof. Section 4. That this ordinance shall take effect and be in full force from and after its adoption and publication once in the official city paper.
