AN ORDINANCE relating to and apportioning and levying special assessments on certain lots
and pieces of ground in the City of Salina, Kansas, to pay the cost of paving Alley First,
Fact of Hancock Street with concrete (Ten (10) feet wide) from the north line of Franklin
Avenue to the south line of Venango Street; curbing, guttering, paving and grading of
Kenwood Park Drive with concrete (Thirty-seven (37) feet wide, back of curb to back of curb)
from a point 150 feet east of intersection of Kenwood Park Drive and Oakdale Drive to
existing county asphalt street, the same being an intervening connecting street; curbing,
guttering, paving and grading of Pacific Avenue with concrete (Thirty-three (33) feet wide
from back of curb to back of curb) from the east side of Thirteenth Street to the west side
of Twelfth Street; curbing and guttering of Ray Avenue from the south line of Neal Avenue
to the center line of Laura Street; curbing, guttering, paving and grading of Riverside
Drive with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from
the west line of Columbia Avenue to the east line of Oakdale Avenue, the same being an
intervening connecting street; curbing, guttering, paving and grading of Riverside Drive
with concrete (Thirty-three (33) feet wide from back of curb to back of curb) from the
west line of Des Moines Avenue to the east line of Kansas Avenue, the same being an interven
connecting street; curbing, guttering, paving and grading of Riverside Drive with concrete
(Thirty-three (33) feet wide from back of curb to back of curb) from the north line of
Johnstown Avenue to the east line of Ohio Street, the same being an intervening connecting
street; curbing, guttering, paving and grading of Riverside Drive with concrete (Thirty-
three (33) feet wide from back of curb to back of curb) from the west line of Ohio Street
to the east side of Des Moines Avenue, the same being an intervening connecting street;
curbing, guttering, paving and grading of Second Street with concrete (Thirty-three (33)
feet wide from back of curb to back of curb) from the south line of Woodland Avenue to the
south line of Pacific Avenue; paving and grading of Second Street with concrete (Twenty-
eight (28) feet wide from toe of gutter to toe of gutter) from the north line of Forest
Avenue to the south line of Woodland Avenue; curbing, guttering, paving and grading of
Woodland Avenue with concrete (Thirty-three (33) feet wide from back of curb to back of
curb) from the east side of Thirteenth Street to the west side of Twelfth Street; and
relating to and providing for the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. For the purpose of paying for that part of the cost of improvements in
certain portions of certain streets as hereinafter set forth in the following sections of
this ordinance, which is chargeable to the private property in the assessment districts for
each of such improvements, respectively, as set forth in the following sections of this
ordinance with respect to each of such improvements, there is hereby levied and assessed
on the property liable therefore, being all the lots and pieces of land lying on either
side of said streets so improved, respectively, to the middle of the block for the distance
improved with respect to the improvements mentioned in Sections 2, 3, 4, 5, 6, 75 8, 9, 10,
11, 12 of this ordinance, according to the appraised value of such lots and pieces of ground
with respect to each such improvement, without regard to the buildings or improvements
thereon, special assessments covering the cost of such work and improvements, said special
assessments being based on the special valuation and appraisement of said lots and pieces
of ground therefore made by three disinterested appraisers appointed by the Board of
Commissioners of the City of Salina, Kansas, with respect to each such improvement which
said appraisements are hereby referred to and made a part of this ordinance, and the
several amounts so levied, apportioned and assessed against the lots and pieces of ground
for each such improvement, respectively, for the purpose aforesaid, are hereby found and
determined to be the amounts set forth in the following sections of this ordinance with
respect to each of such improvements.

county asphalt street, the same being an intervening connecting street, which is chargeable
against the private property within the district chargeable therefore, and which cost is
hereby determined to be $44,802.07, there is hereby levied, apportioned and assessed against
the following described lots and pieces of land as provided for in Section 1 of this
ordinance, the following amounts:

Section 13. Said amounts so levied, apportioned and assessed as aforesaid will be due
and collectible in ten equal installments, the first becoming due with the taxes levied for
the year 1965, and one of said installments falling due each and every year thereafter until
all are paid and all to be collected with interest as in this ordinance provided, HOWEVER,
that the owner of any piece of property liable for any such assessment may redeem his
property from such liability by paying to the City Treasury the entire amount chargeable
against the same, as in this ordinance provided, at any time within thirty days after the
publication of this ordinance and before the issuance of bonds of said City in payment of
the balance of the cost of said improvements, the property so paid on shall not thereafter
be liable for any further assessment for the cost of such improvements nor for any part of
said bonds.
Section 14. There is hereby levied further and assessed against such lots and pieces
of ground described in this ordinance, interest at such rate per annum as shall be borne by
the bonds which may be issued at the end of thirty days as specified in the preceding sectio
hereof, as by law provided, to the time of the collection of the installments as provided by
law, which said interest shall be collected annually at the same time and in the same manner
as said installments are collected and after the taking effect of this ordinance and the
fixing of said interest rate when such bonds are authorized and issued, it shall be the

duty of the City Clerk of said City to annually at the same time other taxes are certified
and until all said assessments so apportioned and levied have been certified to the County
Clerk of Saline County, Kansas a full list of all property liable to assessment and taxation
for such work and improvement, except such property on which the special assessments aforesa
have been paid in full as hereinbefore provided, together with the respective amounts due on
each of said lots and pieces of ground which amounts shall include the annual installments
of such special assessments with the interest for one year at the rate to be fixed as
provided for in this ordinance, on all unpaid balances of said assessments, and such amounts
so certified as herein provided shall be placed upon the tax roll by the County Clerk of
Saline County, Kansas, and collected as other taxes are collected.
Section 15. This ordinance shall take effect and be in full force from and after its
adoption and publication once in the official city paper.
